With Great Power Comes Great Responsibility: Superheroes & The Law, Thomas Simmons, Chris Dellicarpini, Rick Collins Oct 2022

With Great Power Comes Great Responsibility: Superheroes & The Law, Thomas Simmons, Chris Dellicarpini, Rick Collins

Faculty Publications

Legal issues and lessons abound in superhero narratives. Caped heroes often act above and outside the law but deliver on law’s promises of justice and mercy in ways that ordinary legal actors cannot. Legal ethics, criminal law, and procedure are all on display. Superheroes supply a framework for examination of multiple legal issues and lessons, including what it means to be ethical (within the context of the rules of professional conduct and also in a broader sense) and how a legal life can be a virtuous one.

‘Xi Jinping Thought’: Lethal Autonomous Weapons Systems And Military Modernization With Chinese Characteristics, Aiden Warren, Alek Hillas

The Journal of International Relations, Peace Studies, and Development

The article seeks to appraise Beijing’s military modernization and positions on Lethal Autonomous Weapons Systems (LAWS). In examining the rhetoric of Chinese policy makers through a qualitative analysis of relevant policy documents and Chinese statements, the article begins by evaluating the relationship between military modernization and the advancement of China’s innovation and civil- ‍military integration strategies in the Xi Jinping era. Secondly, the article considers, via an analysis of diplomatic statements, the context of Chinese discussions on LAWS under the framework of the Convention on Certain Conventional Weapons (CCW). The analysis proposes it is probable that China is seeking to …

“Pigs In The Parlor”: The Legacy Of Racial Zoning And The Challenge Of Affirmatively Furthering Fair Housing In The South, Jade A. Craig Oct 2022

“Pigs In The Parlor”: The Legacy Of Racial Zoning And The Challenge Of Affirmatively Furthering Fair Housing In The South, Jade A. Craig

MC Law Review

The Fair Housing Act of 1968 includes a provision that requires that the Secretary of Housing and Urban Development (HUD) administer the policies within the Act to “affirmatively further” fair housing. Scholars have largely derived their analysis from studying large urban areas and struggles to integrate the suburbs. The literature, however, has not focused on the impact of zoning and discriminatory land use policies within and around low-income rural and small communities or specifically in the southeastern United States. Scholars have also insufficiently considered the implications of these policies on the duty to “affirmatively further” fair housing.

Racial zoning was …

Europe And The Federal Conceit, Paul Linden-Retek Sep 2022

Europe And The Federal Conceit, Paul Linden-Retek

Book Reviews

Reviewing The constitutional theory of the federation and the European Union, by Signe Rehling Larsen.

Crisis can obscure and confuse. The past decade’s tribulations of the European Union and its structures of governance have left theorists grappling to comprehend the precise terms of Europe’s political and constitutional transformation. But crisis also can occasion a return to first principles—often those forgotten or themselves obscured by political transformations—that clarify thinking about political form and might even illuminate the contours of crisis itself. This is what Signe Rehling Larsen has done in her remarkable book on federation and European Union. In what follows, …

#Includetheirstories: Rethinking, Reimagining, And Reshaping Legal Education, Leslie P. Culver, Elizabeth A. Kronk Warner

Utah Law Review

This symposium gathered scholars and practitioners who have been deeply engaged in the work to examine historical roots of the legal profession and discuss best practices for exploring ethnic, gender, and related inequities alongside our law students. It is well established that the legal profession and legal education neither reflect the community they serve nor swiftly respond to the social shifts within the broader society.3 As 2020 grossly revealed, ethnic partiality and division are aches we have yet to really confront and bear. For example, the casebook method format of legal education continues to model Christopher Langdell’s Gilded Age curriculum, …

The entire world was shaken by the events of 2020—a year that the historians will pen with infamy. Along with a global health pandemic that tested both human frailties and social infrastructures, the world witnessed the devastation of George Floyd, an African American man, dying under the knee of Derek Chauvin, a White male police officer. The nation erupted. As 2020 ended, many organizations and institutions clamored both to process ethnic divides and injustices, and to gain tools and skills to create meaningful change and lasting impact. Legal education was one such institution. During the summer and fall of 2020, …

The Five Big Factors Of Personality Among Displaced Syrians And Palestinians Refugees Living In Lebanon, Ahmed M. Abdel-Khalek, Mayssah A. El Nayal, Olfat Khalil Mahmoud

BAU Journal - Society, Culture and Human Behavior

Syrian refugees in Lebanon are a major challenge at the social, economic and psychological levels, in addition to the issue of the Palestinian refugees in Lebanon in the wake of the Naksaa of 1948. The main hypothesis of this study is that the difficult circumstances experienced by the displaced may affect their personality traits. The sample consisted of 430 individuals, (n=204) Syrian refugees and (n=226) Palestinian refugees of both sexes. All the members of the sample responded to the Arabic Inventory of the Five Big Personality Factors. The inventory enjoys good to high alpha coefficients in both samples, and was …

Is The United Nations A Locus Of International Order Imperiality Maintenance? Reflections From The South West Africa Case And Chagos Archipelago Advisory Opinion, Tatiana Cardoso Squeff, Augusto Carrijo, Murilo Borges Aug 2022

Is The United Nations A Locus Of International Order Imperiality Maintenance? Reflections From The South West Africa Case And Chagos Archipelago Advisory Opinion, Tatiana Cardoso Squeff, Augusto Carrijo, Murilo Borges

Indonesian Journal of International Law

The international legal order, seen through third world lenses, is not only embedded with Europe’s colonial past, but also a regime that assimilates the non-European being, its relations and knowledge. Consequently, the possibility of changing such framework is almost an impossible task, being it constantly rejected by hegemonic powers, that is, by a limited number of nations that have been placed in the center of the world order in the turn of modernity and that have not left. Some may argue, yet, that the United Nations presented the international legal order with a different path, breaking with such an imperial …

Criminal Policy To Combat The Spread Of Electronic Rumours (Under Decree-Law No. 34 Of 2021 On Combating Rumours And Cyber Crimes), Ashraf Kandil

Journal of Police and Legal Sciences

The UAE's role in combating electronic rumors and reducing its dissemination has been demonstrated by the legislative development of IT crime laws in the UAE. The most recent is the issuance of the Federal Decree-Law No. (34) of 2021 concerning the fight against rumors and cybercrime. Otherwise, the problem of the current study revolves around the flexibility of drafting the procedural texts in order to deal with the constant development of the forms and circumstances of spreading rumors, as well as to indicate their effectiveness in reducing their effects. Therefore, the current study aims to identify the criminal policy to …

The Real Estate State And Group-Differentiated Vulnerability To Premature Death: Exploring The Political-Economic Roots Of Covid-19’S Racially Disparate Deadliness In New York City In The Spring Of 2020, John Whitlow

Journal of Civil Rights and Economic Development

(Excerpt)

In May 2020, after several bleak months in which Covid-19 took the lives of thousands of New York City’s most vulnerable residents, a vigil was held in Corona Plaza, Queens, to honor the sixty-seven members of Make the Road New York whose time was cut short by the virus. At the event, State Senator Jessica Ramos spoke of the disproportionate toll Covid-19 has taken on working class, immigrant New Yorkers: “[t]hese communities are on the frontlines without adequate protections and have been left to grapple with extreme food insecurity, . . . evictions, and unemployment . . . .” …

Mass Violence, Environmental Harm, And The Limits Of Transitional Justice, Rachel Killean, Lauren Dempster Jul 2022

Mass Violence, Environmental Harm, And The Limits Of Transitional Justice, Rachel Killean, Lauren Dempster

Genocide Studies and Prevention: An International Journal

The relationship between the environment and mass violence is complex and multi-faceted. The effects of environmental degradation can destabilize societies and cause conflict. Attacks on the environment can harm targeted groups, and both mass violence and subsequent transitions can have harmful environmental legacies. Given this backdrop, it is notable that the field of transitional justice has paid relatively little attention to the intersections between mass violence and environmental degradation. This article interrogates this inattention and explores the limitations and possibilities of transitional justice as a means of addressing the environmental harms associated with mass violence. The article makes four key …

The Apostrophic Impasse: Diacritical Remarks On The Stories Of International Law, Legal Decolonial Genealogy And Antony Anghie’S Historiography, Britt L.A.Q. (Haadiya) Hendrix Jun 2022

The Apostrophic Impasse: Diacritical Remarks On The Stories Of International Law, Legal Decolonial Genealogy And Antony Anghie’S Historiography, Britt L.A.Q. (Haadiya) Hendrix

Theses and Dissertations

The (hi)stories of international law have strengthened the tentacles of coloniality in the legal regime as they continue to taunt the precarious lifeworlds of people, our planet and social imaginaries of an otherwise. The flow of coloniality has similarly rematerialized in decolonial legal theories and the postcolonial historiographical accounts of international law. I intend to demonstrate this colonial revival in the groundbreaking text of Antony Anghie Imperialism, Sovereignty and the Creation of International Law (2005) which challenged the (hi)stories of traditional jurisprudence. The latter was not necessarily a rejection nor negation of Western thought, because I argue that postcolonial historiography …

Racial Capitalism In The Civil Courts, Lauren Sudeall, Tonya L. Brito, Kathryn A. Sabbeth, Jessica K. Steinberg Jun 2022

Racial Capitalism In The Civil Courts, Lauren Sudeall, Tonya L. Brito, Kathryn A. Sabbeth, Jessica K. Steinberg

Vanderbilt Law School Faculty Publications

This Essay explores how civil courts function as sites of racial capitalism. The racial capitalism conceptual framework posits that capitalism requires racial inequality and relies on racialized systems of expropriation to produce capital. While often associated with traditional economic systems, racial capitalism applies equally to nonmarket settings, including civil courts.

The lens of racial capitalism enriches access to justice scholarship by explaining how and why state civil courts subordinate racialized groups and individuals. Civil cases are often framed as voluntary disputes among private parties, yet many racially and economically marginalized litigants enter the civil legal system involuntarily, and the state …

Online Legal Help-Seeking For Victims Of Intimate Partner Violence During The Covid-19 Pandemic, Christina S. Walker Jun 2022

Online Legal Help-Seeking For Victims Of Intimate Partner Violence During The Covid-19 Pandemic, Christina S. Walker

Dignity: A Journal of Analysis of Exploitation and Violence

Legal, court, and criminal justice professionals regularly navigate court procedures and processes through online portals. They know where to locate applicable court rules, such as a specific section on a court website or a departmental contact. However, these tasks can be extremely daunting for laypersons seeking court assistance, especially for victims of violence who have limited time away from the abuser. To determine how state judicial branches make information available about protective order procedures and general information to a layperson, especially to victims of intimate partner violence, this study assessed court websites of five states where intimate partner violence (IPV) …

Lighting A Spark, Playing With Fire: Feminism, Emotions, And The Legal Imagination Of Campus Sexual Violence, Daniel Del Gobbo May 2022

Lighting A Spark, Playing With Fire: Feminism, Emotions, And The Legal Imagination Of Campus Sexual Violence, Daniel Del Gobbo

Dalhousie Law Journal

Feminist law and policymakers have been inspired by collectively generated experiences of emotion that help to shape what counts as justice and injustice in campus sexual violence cases. Focusing on events surrounding the Dalhousie University Faculty of Dentistry in 2014–2015, this article explains how emotional incitements in the case contributed to an infrastructure that supported formal and specifically carceral responses to campus sexual violence. Correspondingly, this article explains why alternative modes of legal and political formation that challenged the premises of the formal law, including restorative justice, were misread by some commentators as a form of “weak justice” and therefore …
