Methodology Of Market Definition: Case Of Digital Multi-Sided Platforms, Anzhelika Gerasymenko, Vasyl Hanovskyi
Methodology Of Market Definition: Case Of Digital Multi-Sided Platforms, Anzhelika Gerasymenko, Vasyl Hanovskyi
Yearbook of Antitrust and Regulatory Studies
The rapid expansion of the digital economy has significantly contributed to the increasing market power of digital multi-sided platforms, making its precise measurement increasingly challenging. The main reason is the lack of efficiency of SCP-tools in digital markets that push competition authorities to look for alternative ways of competition regulation in such markets (like the DMA approach), while its results are still poor. This paper provides the methodological grounding of a vertical breakdown of a complex product traded by digital multi-sided platforms to bring back the conventional tools of market definition and to adjust them to the specifics of digital …
Security And Terrorism Vs Free Expression: Analytical Study On The European Court Of Human Rights, Mariam Adel Massoud
Security And Terrorism Vs Free Expression: Analytical Study On The European Court Of Human Rights, Mariam Adel Massoud
Theses and Dissertations
The 11 of September attacks provide a paradigm shift when it comes to protection of national security. It results in a trending vision that prioritized security over national security, which makes it essential to think about balancing national security with free expression as a pillar of democratization. This study focusses on how the balance between freedom of expression and national security interests is achieved. It studies the legal approached of the European court of human rights and its legal assessment to strike this balance. The findings of this analytical study asserts that in order for the ECtHR to achieve this …
Dual-Purpose Communications And The Modern Attorney's Need For Circuit Court Uniformity, Kipp Garrett
Dual-Purpose Communications And The Modern Attorney's Need For Circuit Court Uniformity, Kipp Garrett
St. John's Law Review
(Excerpt)
In January 2023, the Supreme Court of the United States heard oral arguments in In re Grand Jury regarding the proper and applicable test to determine whether attorney-client privilege can be invoked in dual-purpose communications between a business and its legal counsel. Attorneys across the country were hoping the Court would provide an answer, ending the three-way circuit split concerning the appropriate test. Unfortunately, the Court ultimately dismissed certiorari as “improvidently granted” without an explanation. As a result, there are three major tests that federal courts use to decide whether communications between businesses and their legal counsel are protected: …

Cruel, As Usual: Application Of The Eighth Amendment To The Use Of Juvenile Criminal Records In Higher Education Admissions, Rabab Alajmi
St. John's Law Review
(Excerpt)
This Note addresses the systemic barrier to societal reintegration faced by juvenile offenders applying to enroll in higher education. Specifically, this Note will examine whether, in light of the Fifth Circuit’s recent Hopkins v. Hosemann decision, Eighth Amendment protections against cruel and unusual punishments should be extended to college applicants with juvenile criminal records who have completed their sentences. This Note argues that the Eighth Amendment reasoning in the Hopkins decision should be applied to higher education institutions who consider an applicant’s juvenile criminal record where the applicant has already completed their sentence. While the Hopkins decision concerned “the …
"Intolerable" Inquiries, Zachary R. Cormier
"Intolerable" Inquiries, Zachary R. Cormier
St. John's Law Review
(Excerpt)
A growing majority of courts have broadly accepted travel-plan questions (and their follow-up questions) as a qualifying category of traffic-mission inquiries under Rodriguez, leaving officers with a clear pathway from pretextual traffic stop—to extended discussion about vehicle occupant activities outside the traffic violation—to drug dog sniff—to vehicle search. A closer analysis of Rodriguez, however, precludes such passage through the heart of its traffic-mission rule. This Article will demonstrate that travel-plan questioning cannot qualify alongside the roadway safety checks identified by Rodriguez in its traffic-mission inquiry list because such checks provide direct information about another safety-related traffic violation …
Holding Transnational Corporations Accountable For Ecocide And Climate-Related Human Rights Violations, Njengue Cindy Joanne
Holding Transnational Corporations Accountable For Ecocide And Climate-Related Human Rights Violations, Njengue Cindy Joanne
COP30
The climate emergency and the scale of environmental harm require moving beyond voluntary and overly localized approaches to establish binding legal mechanisms at the global level. Transnational corporations operating in high-impact ecological sectors must be held accountable for their actions — not only to remedy the damage caused, but also to prevent future violations. COP30 in Belém presents a unique opportunity to place legal and institutional accountability at the core of international negotiations. By building on existing instruments, the ethical ambitions of the COP presidency, and strengthened cooperation between states, civil society, and private actors, it is possible to construct …

Akron Law Faculty Publications
This amici curiae brief, filed in Thomson Reuters Enterprise Centre GmbH and West Publishing Corp. v. ROSS Intelligence Inc. before the U.S. Court of Appeals for the Third Circuit, argues that Thomson Reuters failed to state a viable claim for copyright infringement against ROSS Intelligence. The amici—law professors specializing in copyright and technology—contend that Westlaw’s headnotes are uncopyrightable factual summaries of judicial opinions and that the West Key Number System has long been in the public domain. The brief distinguishes between AI “pretraining” and “fine-tuning,” emphasizing that ROSS’s fine-tuning process relied on expert-created materials rather than wholesale copying. It cautions …

Protecting Children's Rights In The National Climate Policies In Greece, Elpis Rerra
Protecting Children's Rights In The National Climate Policies In Greece, Elpis Rerra
COP30
This paper aims to address the question, “How can we ensure that children’s rights are protected in national climate policies?” Ιn the broader field of climate justice, ecocide, and security, the theme of this study is children’s rights in the context of climate change and how the government can truly include them in the climate policies. This paper begins by highlighting the importance of addressing the issue of protecting children's rights from the impact of climate change. Moreover, it underlines the critical and urgent nature of children’s vulnerability to climate change. The paper also examines Greek climate policies and whether …
Cross-Border Climate Adaptation – Transboundary Agreement For Climate Justice & Security, Andre Ferreira
Cross-Border Climate Adaptation – Transboundary Agreement For Climate Justice & Security, Andre Ferreira
COP30
This policy paper shall highlight the need for COP30 negotiators to adopt a Transboundary Adaptation Compact (TAA), a rights-based framework meant to coordinate climate adaptation across shared resources, mobilize finance, and manage the growing challenges of ecocide risks/cross-border migration. While shared bodies of water provide crucial resources for billions of people globally, their international governance is often fragmented. The climate crisis is compounding already existing tensions over water allocations that emerge from lack of cooperation between nation-states, threatening ecocide in river deltas, wetlands, and mangroves. Therefore, this paper aims to draw from existing case studies of successful regional cooperation, such …
The Invisible Chains: Framing Abuse Of Dominant Position In Labor Markets, Giulia Mangiafico
The Invisible Chains: Framing Abuse Of Dominant Position In Labor Markets, Giulia Mangiafico
Yearbook of Antitrust and Regulatory Studies
This paper examines how the concept of abuse of dominant position can be applied to the labour markets, where demand-side concentration and supply-side fragmentation generate monopsonistic dynamics that suppress wages, limit mobility, and reduce job security. It argues that traditional antitrust tools can be adapted to labour-specific contexts by redefining market boundaries through commuting zones, occupational substitutability, and recognition of artificial fragmentation. The study also addresses how exploitative practices such as non-compete agreements illustrate the concrete impact of employer power, and it highlights the need for a more coherent regulatory approach. Ultimately, it suggests that competition law, when enforced alongside …
Collective Dominance Under Scrutiny: Closing The Enforcement Gap Or Complicating Eu Competition Policy?, Miroslava Marinova
Collective Dominance Under Scrutiny: Closing The Enforcement Gap Or Complicating Eu Competition Policy?, Miroslava Marinova
Yearbook of Antitrust and Regulatory Studies
This paper examines the European Commission’s Draft Guidelines on Article 102 TFEU, focusing on their treatment of collective dominance in oligopolistic markets. While the Guidelines adopt a structured framework derived from merger control, they fail to address a key challenge specific to Article 102: the need for clear evidentiary standards in retrospective enforcement. The paper argues that parallel conduct by independent firms can, in certain cases, serve as evidence of collective dominance where such behaviour is not rational absent joint market power. However, the Draft Guidelines offer little guidance on how to integrate such conduct into the dominance analysis. This …
The First Sale Doctrine For The Digital Age, Ethan Thomas
The First Sale Doctrine For The Digital Age, Ethan Thomas
Journal of Intellectual Property Law
For well over a century consumers have long enjoyed the ability to resell, gift, lend, or otherwise transfer their legally purchased copyrighted media. First established in common law and later codified into the Copyright Act of 1976 the first sale doctrine granted the right of transfer to consumers. In 2013, a district court held that the first sale doctrine does not let consumers transfer digital media through file sharing. Instead, a consumer must sell the object the media was downloaded onto. This decision effectively gutted the first sale doctrine’s application to digital media. Further reducing the reach of the first …
Rectifying The Disconnect Between The Policy Of The Doctrine Of Equivalents And Practice, Ian Moore
Rectifying The Disconnect Between The Policy Of The Doctrine Of Equivalents And Practice, Ian Moore
Journal of Intellectual Property Law
The doctrine of equivalents began as a measure to protect inventors from unscrupulous copiers who would make substitutions to avoid liability under literal infringement claims. Prosecution history estoppel was established as a guardrail to the doctrine, as a method of bringing some certainty to the scope of patent claims. However, in the Supreme Court’s zeal to contain the doctrine, they over-curbed its efficacy.
In cases that hinged on the doctrine of equivalents, patentees were only successful 21% of the time in district court, and 22% of the time in the federal circuit. A much lower success rate compared to the …
You Wanted The Best? You Got The Best! If You Can Pay For It... Antitrust Considerations And Artist-Based Solutions For Lower Concert Ticket Prices, Jake Farbman
Journal of Intellectual Property Law
The live music industry has become increasingly inaccessible to fans as ticket prices continue to rise under the dominance of Live Nation Entertainment and Ticketmaster. Since their controversial 2010 merger, the two companies have consolidated control over both the primary and secondary ticketing markets, fostering anticompetitive practices that allegedly include exclusive venue agreements, coercive bundling of promotion and ticketing services, and dynamic pricing schemes. These practices have drawn widespread scrutiny from lawmakers, regulators, artists, and consumers alike, culminating in the Department of Justice’s 2024 antitrust lawsuit seeking to break up the conglomerate.
This Article traces the historical development of the …

Controlling Private Economic Power: Lessons Learned From The Us Experience In The First Decades Of The 20th Century, Thierry Kirat, Frédéric Marty
Yearbook of Antitrust and Regulatory Studies
Concerns related to Big Techs have led to a proliferation of legislative initiatives to complete competition rules with regulatory devices that would lead gatekeepers to be subject to obligations to preserve an equality of opportunities on the market. Within this context, this contribution revisits American decision-making practice from the end of the 19th century and the beginning of the 20th century to show how regulatory-type interventions and the enforcement of competition rules have been activated to control the strategies of firms acting as gatekeepers. What we can learn from this experience is that a big firm having private regulatory power …

Rights In The Eyes Of The Beholder: The Lived Hierarchy Of Rights In India's Democracy, Sehar Abdullah, Keerthana Satheesh, Prashant Narang
Socio-Legal Review
This paper examines how citizens in India perceive and prioritise fundamental rights, with particular attention to the six freedoms under Article 19(1) and the property right. While the freedoms of Article 19(1) remain central to democratic citizenship, the Forty-Fourth Constitutional Amendment of 1978 reclassified the right to property as a constitutional right under Article 300A. This shift prompts an important question: Does the diminished constitutional rank of property correspond to its place in popular hierarchies of rights? Our in-depth interviews with 26 respondents, whose livelihoods make them especially sensitive to changes in both categories of rights, reveal that citizens continue …

The Perceptions And Receptiveness To Responsible Gambling By College Men Who Sports Bet: A Focus Group Study, Chance V. Dow, Matthew D. Andersland, Emily A. Velandia, Rory A. Pfund, James P. Whelan
UNLV Gaming Research & Review Journal
Responsible Gambling (RG) includes prevention messages aimed at mitigating harms. Research examining the experiences of college students who sports bet is lacking, hindering efforts to tailor messaging to college students. This qualitative study explored how college men who sports bet perceive and respond to existing RG messages, gathering their feedback on the characteristics of messages they find effective. Online focus groups were conducted with college men who sports bet (N = 12) using a semi-structured interview guide. The discussions were recorded, transcribed, and analyzed using an open coding Thematic Analysis approach. Codes were independently identified and analyzed resulting in …
Operationalising Blue Carbon: Australia's Framework As A Model For Global Nature-Based Climate Mitigation, Chelsea Golding
Operationalising Blue Carbon: Australia's Framework As A Model For Global Nature-Based Climate Mitigation, Chelsea Golding
COP30
Blue carbon ecosystems offer a critical solution to nature-based climate change mitigation. These habitats not only sequester significant amounts of carbon per hectare but also support biodiversity and increase climate resilience for coastal communities. Yet, despite the widespread recognition of these benefits in global climate discussions, most existing carbon sequestration and crediting frameworks remain focused on terrestrial ecosystems and fail to account for the greater variability in marine and costal habitats. This policy gap creates a significant barrier in the capacity for costal carbon sequestration projects to be scaled globally. Australia has addressed this implementation gap at a national level …
Closing The Governance Gap In Urban Resilience And Multilevel Action In The Global South, Helena Branco Gouveia
Closing The Governance Gap In Urban Resilience And Multilevel Action In The Global South, Helena Branco Gouveia
COP30
By 2050, nearly 70% of the world’s population will live in cities. In the Global South, urban exposure to compound drought–heatwave events is projected to rise by 50% by mid-century, while coastal cities face annual adaptation costs that could exceed 1% of GDP. Despite this accelerating risk, fewer than one-third of National Adaptation Plans establish clear mechanisms for coordination with subnational governments, and less than 10% of adaptation finance reaches the local level. This creates a governance gap that undermines both the effectiveness and fairness of resilience efforts. This policy brief argues that closing this gap is essential to delivering …

Beyond Personal Responsibility: Government Support For The Substantive Human Condition, Martha T. Mccluskey
Beyond Personal Responsibility: Government Support For The Substantive Human Condition, Martha T. Mccluskey
Contributions to Books
Government protection against systemic harm to human well-being is stymied by the liberal idea that power is most legitimately wielded by autonomous individuals taking personal responsibility for their substantive well-being. Instead, a robust vision of democracy and socioeconomic justice requires grounding legitimate power in institutional responsibility, replacing the formal individual actor of liberal theory with the universally embodied, embedded human subject developed in Martha Fineman’s Vulnerability Theory. This chapter connects the message of personal responsibility in neoliberal US welfare reform policies to rationales defending the government’s failure to alleviate systemic human harm in the 2008 financial crisis and the accelerating …
A History Of Native People In Nebraska, Part I, Gabriel Bruguier
A History Of Native People In Nebraska, Part I, Gabriel Bruguier
Truth and Reconciliation History Project
The following isn’t a comprehensive history; the aim is to highlight important events and the ideas of those whose actions brought forth the history of the region and eventually the state of Nebraska. Using an analogy from the book The Nebraska State Constitution, we can think of how the state developed as a sort of fence, a way of separating what is “mine” and “yours”, who is “us” and “them,” and who the “insiders” and “outsiders” are.9 In examining the period leading up to the formation of Nebraska Territory, it is instructive to point to how outside forces desired and …
