The State’S Responsibility To Prevent And Investigate Violations Of The Right To Life In The Beirut Port Explosion, Ali Wehbi Dib
The State’S Responsibility To Prevent And Investigate Violations Of The Right To Life In The Beirut Port Explosion, Ali Wehbi Dib
BAU Journal - Journal of Legal Studies - مجلة الدراسات القانونية
The right to life is recognised in International Human Rights Law (IHRL) as the "supreme right." It is considered a jus cogens norm, fundamental for both individuals and society as a whole. IHRL provides a general guarantee of the right to life. To effectively protect it, the state must take all feasible measures to prevent violations of the right to life and to respond to them. This includes investigating incidents and, when appropriate, prosecuting and punishing those responsible.
The Beirut Port explosion on 4 August 2020 was one of the most powerful non-nuclear explosions in history. It resulted in the …

Ethics Under Siege: The Conflict In Tigray Through The Lens Of Just War Theory, Daniela Widya Purba
Journal of Strategic and Global Studies
This research article explains the ethical principles of the conflict in Tigray based on the Just War Theory. By using the descriptive qualitative methodology, this research article draws data from secondary sources which includes; academic journals, news reports, as well as international legal instruments to analyze the moral trajectory of the conflict. This research begins with jus ad bellum, to assess Ethiopia’s government justification in declaring conflict within Tigray. While the government fulfilled the criteria of just cause and legitimate authority, the question stands on the ambiguous political intentions and the failure to enact peaceful alternatives before resulting in waging …
From Minimum To Meaningful: A Use Of Force Training Regimen For Rural Police Departments, Joseph Corley
From Minimum To Meaningful: A Use Of Force Training Regimen For Rural Police Departments, Joseph Corley
Dissertations, Theses, and Projects
This paper examines how small and rural law enforcement agencies can improve use of force training despite limited staffing, budgets, and training opportunities. Current Minnesota POST Board minimum standards establish baseline requirements but allow significant variation in how agencies develop and deliver training, contributing to inconsistent officer preparedness and skill retention. Drawing on current research in police training, motor skill retention, and scenario based learning, this paper argues that infrequent, skills based training is insufficient for preparing officers to manage dynamic, high risk encounters. The paper proposes an evidence based training regimen centered on two department led use of force …

Systematic Review Of The Institutionalization Of Service Learning In Higher Education, Wilmer Hernan Cruz Gutierrez
ASEAN Journal of Community Engagement
An increasing number of universities are integrating service-learning (SL) to fulfill their social mission. However, sustainable institutionalization of SL remains a persistent challenge. This study identifies and analyzes the factors, actors, and strategies that drive and inhibit SL institutionalization in higher education. Using the PRISMA 2020 guidelines, a systematic literature review analyzed 52 documents from seven academic databases (including WoS, Scopus, and ERIC). The findings were grouped into three sections: cultural (integration into institutional values/missions), process (articulation within teaching, research, and outreach), and structural dimensions (dedicated support entities). The results obtained reveal a reciprocal relationship where cultural alignment enables processual …
Rethinking The Legal Status Quo In Cyberspace To Legally Attribute State Responsibility, And Enhance Accountability And Deterrence, Dan Efrony
International Law Studies
The absence of formal legal attributions of State responsibility for malicious cyber operations reflects a strategic choice by influential States—foremost the United States and the United Kingdom—rather than doctrinal certainty. So long as States avoid creating legal rules for attribution, they entrench cyberspace as a legal gray zone and expose the limits of collective attribution as a governance mechanism. This article identifies probative and institutional impediments in the secondary rules of attribution: the effective control test is difficult to satisfy for proxy cyber operations, the lack of an authoritative standard of proof enables plausible deniability, and, absent consent, States remain …

Reinforcing Media Governance In Indonesian Dynamic Cyber Space, Poppy Setiawaty Nurisnaeny, Hendra Kaprisma, Chrisna Yudhawinata, Sudirman Sudirman
International Review of Humanities Studies
Following the rapid change in technology development, the Indonesian mass media have undergone a digital transformation. This digital mass media and its users have evolved, assimilated, and integrated themselves to fit in the cyber world. This distinguishing feature distinguishes them from traditional mass media. The cyber environment's infinite international boundaries are both advantageous and disadvantageous, as it is difficult to govern digital activity outside Indonesia's jurisdiction. This unregulated environment became a breeding ground for cybercrime, making the digital space unsafe for individuals and threatening national security. In response to this issue, the Indonesian government has enacted various laws and policies, …
The Indonesian Conjunction Dan ‘And’ And Its Chinese Correspondences: A Corpus-Based Approach To Syntactic And Register Variation, Hatmi Idris
International Review of Humanities Studies
This study examines how the Indonesian conjunction dan ‘and’ is rendered in Chinese across syntactic units using a corpus-based contrastive approach. Focusing on children’s books, classic novels, and online news, it analyzes coordination at word, phrase, and clause level from a syntactic and register perspective. Findings show that dan ‘and’ does not correspond to a single Chinese form. At the word and phrase level, nominal coordination employs hé (和) ‘and’, yǔ (与) ‘and’, and yǐjí (以及) ‘as well as’ , with formal news discourse favoring yǔ (与) ‘and’ and yǐjí (以及) ‘as well as’. In verbal coordination, bìng (并) ‘furthermore’ …

International Review of Humanities Studies
The research is to analyze the building of Nederlandsche Handel-Maatschappij (NHM) in its position as a Dutch Trade Company in the Dutch East Indies. It shows an influence of the colonial image, that is discriminative against the social condition of the native Indonesian in its structural architecture. By applying a Marxist theory on the analysis of social class, this writing examines the building of the NHM trade office and the material remains that revealed social class and racial segregation. Persuasive Strategies In Umrah Marketing On Social Media: A Comparative Study Of Arabic And Indonesian, Stevania C. Asahri
International Review of Humanities Studies
This study examines persuasive strategies in Arabic- and Indonesian-language Umrah marketing flyers circulated on social media. As public interest in Umrah continues to grow, travel agencies increasingly rely on digital platforms not only to promote travel packages but also to construct spiritual appeal, religious credibility, and consumer trust. This study therefore aims to analyze how spiritual imagery is constructed, how rhetorical and pragmatic persuasive strategies are used, and how persuasive patterns differ between Arabic- and Indonesian-language Umrah marketing flyers. The study adopts a qualitative-dominant convergent parallel mixed-methods design. The qualitative analysis is based on Fairclough’s Critical Discourse Analysis (CDA), integrated …

Constructing Geisha Representation: Textual Analysis Of Memoirs Of A Geisha On Social Media X, Khadijah Hamumpuni Setyawan, Rouli Esther Pasaribu
International Review of Humanities Studies
Geisha are professional entertainers who have mastered Japanese traditional arts and often appear in various media covering Japanese culture. However, there are frequent misunderstandings about geisha outside Japan. The release of the Japanese-produced film Shogun has sparked discussions about older films from the west that are set in Japan, such as Memoirs of a Geisha. This study aims to analyze the representation of geisha in Memoirs of a Geisha (2005) and how that representation is constructed and reinterpreted by Japanese and Western audiences through the social media platform X. Using textual analysis, this study examines the movie as a cultural …

Voters’ Perception Of Nigeria’S Electoral Process: An X-Ray Of The 2023 Presidential Election, Omamurhieme Julia Akpodovhan, Chukwuma Anyanwu Dr
International Review of Humanities Studies
In its six decades of post-independence, Nigeria has experienced the best and worst in military and democratic governance fluctuating from one to the other. It has purportedly settled into a democracy but with highly flawed electoral processes. This paper interrogates the February 25, 2023 Presidential election with a view to assessing the perception of voters in the exercise to determine whether there has been an improvement or otherwise in the status quo of how previous elections were conducted. Drawing from historical antecedents, participant observation and opinion poll research techniques, the authors relied on information from five of ten polling booths …

Southeast Asia remains a region marked by numerous interstate border disputes. Among these, the Thailand–Cambodia border dispute surrounding the Preah Vihear Temple, located between Sisaket Province in Thailand and Preah Vihear Province in Cambodia, represents one of the conflicts with the greatest potential to affect regional stability and harmony in the region. This dispute extends beyond questions of territorial sovereignty, encompassing the construction of national identity, historical memory, and the domestic political dynamics of both countries. This article examines the representation of nationalism in Boundary (2013), a documentary film directed by Thai independent filmmaker Nontawat Numbenchapol. Drawing on perspectives interdisciplinary …

Paediatricians' Liability To Patients' Parents For Negligent Genetic Testing, Anthony Sangiuliano
Paediatricians' Liability To Patients' Parents For Negligent Genetic Testing, Anthony Sangiuliano
Osgoode Hall Law Journal
The Ontario Superior Court of Justice has recently held that a paediatrician might owe a duty of care to a patient’s parents when performing genetic testing on the patient and communicating test results to the parents. The parents may be able to claim damages against the paediatrician for breach of this duty if, in reliance on a miscommunication about the test results, they conceive a subsequent child who is later born with a disability. I call the tort alleged by the parents in these circumstances a subspecies of “paediatric triangular torts.” In this article, I demonstrate the conceptual feasibility of …

Iterative Computational Ethnography, Digito-Vernacularisation, And Transcultural Policing In The Global South Asian Communities: An Emergent Research Agenda For Transdisciplinary Hate Studies, Sandhya Irina Fuchs
Socio-Legal Review
This Article proposes a new transdisciplinary agenda for global hate studies by connecting previously separate debates in anthropology and criminology. It draws on ongoing ethnographic and computational research, which investigates how Hindu nationalist (Hindutva) hate speech originating in India facilitates distinct forms of ethnic and religious exclusion in the United Kingdom and South Africa - two Indian diasporic centres that have recently witnessed escalating Hindu-Muslim conflict in markedly different ways. The Article aims to answer the following question: what forms of transdisciplinary dialogue and conceptual innovation must social scientists engage in to understand how local cultural, legal, and historical factors …
What Counts As Data? Empirical Legal Research With India’S Ecourts Portal, Lubhyathi Rangarajan, Sakshi Rai, Nikita Bansal
What Counts As Data? Empirical Legal Research With India’S Ecourts Portal, Lubhyathi Rangarajan, Sakshi Rai, Nikita Bansal
Socio-Legal Review
This Notes from the Field (‘NFF’) studies an attempt to build a nationwide dataset of cases instituted under the Unlawful Activities (Prevention) Act, 1967 using the eCourts portal, an open access state-led digital repository of all judicial records across India. It uses this experimental attempt to create new methodological and epistemological ways of thinking about data when undertaking socio-legal research. The paper argues that the appearance of judiciary-led digital transparency and visibility masks deeper concerns with data integrity. Through a process of manual data extraction across than 3,647 court complexes on the eCourts portal, the study reimagines technical failures and …

Mobility-Restricting Covenants In Business Contracts: The Case Of Franchising, Francine Lafontaine, Lorenzo G. Luisetto, J.J. Prescott
Articles
Several studies show that restrictive covenants in employment contracts, such as non-compete agreements, may affect employees in detrimental ways, including by reducing mobility and suppressing wages. While such concerns are real, these clauses also have the potential to serve legitimate business purposes by helping companies protect valuable information, which can encourage investment and training and enhance social welfare. This paper explores the use of several types of covenants, including non-competes but also confidentiality and post-relationship non-recruitment clauses, in franchise contracts, an important and accessible category of business contracts. Many of these contracts impose restrictive covenants on franchisees but also on …
Class Struggle And The Socialist Economic Calculation Debate, Tiago Camarinha Lopes
Class Struggle And The Socialist Economic Calculation Debate, Tiago Camarinha Lopes
Emancipations: A Journal of Critical Social Analysis
The socialist economic calculation debate is often portrayed as a sharp and straightforward conflict between two opposing sides. While this characterization is valid given the ideological clash between defenders of capitalism and proponents of socialism, this paper offers a more nuanced perspective on the interaction between the main schools of economic thought involved in the debate, the Marxist and the Austrian. Drawing on the humanist approach of critical pedagogy developed by Brazilian philosopher Paulo Freire (1921–1997), the paper argues that the debate over socialist economic calculation is not only a clear expression of class struggle within economics. It also involves …
Learning (Non-)Planning From Yugoslav Socialism, Annette Freyberg-Inan, Tim Platenkamp
Learning (Non-)Planning From Yugoslav Socialism, Annette Freyberg-Inan, Tim Platenkamp
Emancipations: A Journal of Critical Social Analysis
The advancement of democratic economic planning theory depends crucially on improving our understanding of how technically feasible planning methods and instruments can be embedded in institutionally viable incentive structures, developing a coherent incentive-compatible as well as feasible planning procedure. Our contribution draws lessons for democratic economic planning from the historical experience with Yugoslav socialism, and especially its post-Stalinist, “contractual” phase. From the mid 1970s onwards, workers in Yugoslavia were empowered to plan their activities from the ground upward. Intended to re-energize worker participation in the construction of socialism, this experiment with economic planning from below provides useful insights for the …
