Life After Google V. Oracle: Three Reflections On A Theme, Daryl Lim
Life After Google V. Oracle: Three Reflections On A Theme, Daryl Lim
IP Theory
In 2004, Professor Leaffer published an article titled Life after Eldred: The Supreme Court and the Future of Copyright. He wrote about three cases decided in or after 2001 to provide a snapshot of the Supreme Court’s position on copyright issues. This Article discusses three reflections on this theme. The first reflection flows directly from Google. It discusses fair use in Andy Warhol Found. for Visual Arts, Inc. v. Goldsmith, as well as text and data mining for artificial intelligence uses. This Article then reflects on Arnstein v. Porter’s lessons for modern copyright infringement law. Finally, it reflects on the …

Information Privacy And The Inference Economy, Alicia Solow-Niederman
Information Privacy And The Inference Economy, Alicia Solow-Niederman
Northwestern University Law Review
Information privacy is in trouble. Contemporary information privacy protections emphasize individuals’ control over their own personal information. But machine learning, the leading form of artificial intelligence, facilitates an inference economy that pushes this protective approach past its breaking point. Machine learning provides pathways to use data and make probabilistic predictions—inferences—that are inadequately addressed by the current regime. For one, seemingly innocuous or irrelevant data can generate machine learning insights, making it impossible for an individual to anticipate what kinds of data warrant protection. Moreover, it is possible to aggregate myriad individuals’ data within machine learning models, identify patterns, and then …

Proportionality: Reconsidering The Application Of An Established Principle In International Law, Rüdiger Wolfrum
Proportionality: Reconsidering The Application Of An Established Principle In International Law, Rüdiger Wolfrum
International Law Studies
Traditionally, the principle of proportionality is defined as limiting State action to rational and reasonable means with the view to achieve a goal permissible under international law without unduly encroaching on the protected rights of another State, States, or individuals. The principle applies to the planning, as well as the implementation, of State activities. The application of the principle of proportionality is common in national constitutional and administrative law. A vast national jurisprudence exists in this regard. However, due to the plurality of approaches in the various national legal systems, it is hardly possible to draw any general legal conclusions …
Legislating Emotion, Reading Grief: Bereavement Leave For Miscarriage And Stillbirth In New Zealand Law, Gillian Calder
Legislating Emotion, Reading Grief: Bereavement Leave For Miscarriage And Stillbirth In New Zealand Law, Gillian Calder
Dalhousie Law Journal
This paper looks at New Zealand’s Holidays (Bereavement Leave for Miscarriage) Amendment Bill (No 2), an Act that changes Employments Standards legislation to allow bereavement leave for people and their partners at miscarriage and stillbirth. The paper is prompted by the huge media attention that this small change in law received globally. What might Canadian legislators learn by taking a careful look at this New Zealand law that permits an employee time off work to grieve a pregnancy loss? The questions that the legislation provokes are read through the lens of law and emotions literature, situated in the ways that …

A Pact For The Future: Improving Animal Protection Legislation For Captive Orcas, Emily Lively
Pace Environmental Law Review
Using SeaWorld as a case study, this Note will argue that existing federal and state legislation fails to protect captive orcas from cruel and harmful treatment while in captivity.
Part I of this Note will address the gaps in federal and state animal welfare and cruelty legislation relevant to captive orcas. Part II will discuss the enactment of the Preventing Animal Cruelty and Torture Act of 2019 (“PACT Act”), the first federal animal cruelty statute. Part III will use SeaWorld as a case study to test the effectiveness of the PACT Act in criminalizing animal cruelty at the federal level. …

Silent Spring Revisited – Is It Time To Ban Lead? An Argument For A Federal Ban Of The Use Of Lead Ammunition For Hunting Game Pursuant To The Endangered Species Act, Jaclyn Mcbain Cohen
Pace Environmental Law Review
This note will explore EPA’s authority under the Endangered Species Act (“ESA”) to promulgate regulations banning the use of lead ammunition for any purpose. Section II discusses the impact of lead on the environment and wildlife and demonstrates how even small amounts of lead discharged into the environment through hunting practices can have lethal effects on wildlife, especially scavengers, such as the California condor and the grizzly bear. Section III discusses the current regulations that exist to control the discharge of lead into the environment from the use of other common substances, such as paint and gasoline, demonstrating that the …
Decarceration's Inside Partners, Seema Tahir Saifee
Decarceration's Inside Partners, Seema Tahir Saifee
Fordham Law Review
This Article examines a hidden phenomenon in criminal punishment. People in prison, during their incarceration, have made important—and sometimes extraordinary—strides toward reducing prison populations. In fact, stakeholders in many corners, from policy makers to researchers to abolitionists, have harnessed legal and conceptual strategies generated inside the walls to pursue decarceral strategies outside the walls. Despite this outside use of inside moves, legal scholarship has directed little attention to theorizing the potential of looking to people on the inside as partners in the long-term project of meaningfully reducing prison populations, or “decarceration.”
Building on the change-making agency and revolutionary ideation inside …
Fostering Implementation Of The United Nations Sustainable Development Goals In Africa: Prospects Of Revenue Generation Under The Tax Treaties Signed By Nigeria, Tanzania, And Botswana, Oladiwura Ayeyemi Eyitayo-Oyesode
PhD Dissertations
African countries are behind in social and economic development. The citizens of these countries experience high levels of poverty and hunger, unemployment, maternal and infant mortality, lack of access to quality education, gender inequality and other social, economic and environmental ills. To fix these development challenges, African countries have been encouraged to improve on domestic resource mobilization. This is regarded as a more viable and sustainable way of actualizing the UN Sustainable Development Goals (SDGs) against reliance on aids and grants. Also, emphasis is placed on taxation as the primary source of revenue for funding development because it ensures ownership …
Artificial Intelligence Inventions, Haochen Sun
Artificial Intelligence Inventions, Haochen Sun
Florida State University Law Review
In the new technological era, artificial intelligence (AI) reigns supreme. With the assistance of AI systems, society is undergoing a radical transformation. AI may not only soon replace human labor in many industrial sectors, but as AI gains the power to generate greater inventions, it may also outsmart human inventors. How should patent law and policy adapt to the formidable challenges of the AI era? One of these challenges, addressed by patent offices and courts in 2020 and beyond, is whether AI inventorship should be recognized. The United States Patent and Trademark Office and European Patent Office declined to recognize …
Local Action For Animals As A Stepping Stone To State Protections, Jo Anderson
Local Action For Animals As A Stepping Stone To State Protections, Jo Anderson
Law
Municipal ordinances can be an effective way to create animal protection laws at the local level, and could lead to great success at the state level. Passing laws at the local level allows people to help animals in their communities, while providing a model for other cities and jurisdictions. Local laws can also create momentum for statewide initiatives, which demonstrates a state’s strong commitment to protecting animals.
Legislation is a key avenue animal advocates use to effect change at scale, but there is not much research about how to choose tractable issues and lobby for them successfully. The goal of …

The Texas Heartbeat Act (S.B. 8) prohibits abortions following detection of a fetal heartbeat while delegating exclusive enforcement through private civil actions brought by “any person,” regardless of injury, for statutory damages of a minimum of $10,000 per prohibited abortion. Texas sought to impose costly litigation and potentially crippling liability on reproductive health providers and rights advocates, with the hope of stopping abortion in the state. Prior to Dobbs v. Jackson Women’s Health Organization overruling Roe v. Wade and eliminating constitutional protection for abortion, the law represented a unique threat to reproductive freedom. But states are spreading S.B. 8’s exclusive …
Confronting State Violence: Lessons From India's Farmer Protests, Smita Narula
Confronting State Violence: Lessons From India's Farmer Protests, Smita Narula
Elisabeth Haub School of Law Faculty Publications
In December 2021, following a year of sustained mass protests, farmers in India forced the repeal of three controversial Farm Laws that attempted to deregulate India’s agricultural sector in service of corporate interests. Farmers feared that the laws would dismantle price supports for key crops, jeopardize their livelihoods, and facilitate a corporate takeover of India’s agrarian economy. This Article situates India’s historic farmer protests in the context of the country’s longstanding agrarian crisis and the corporate capture of agriculture worldwide. I argue that the protests arose in response not only to the Farm Laws, but also to decades of state-sponsored …

Reducing Prejudice Through Law: Evidence From Experimental Psychology, Sara Emily Burke, Roseanna Sommers
University of Chicago Law Review
Can antidiscrimination law effect changes in public attitudes toward minority groups? Could learning, for instance, that employment discrimination against people with clinical depression is legally prohibited cause members of the public to be more accepting toward people with mental health conditions? In this Article, we report the results of a series of experiments that test the effect of inducing the belief that discrimination against a given group is legal (versus illegal) on interpersonal attitudes toward members of that group. We find that learning that discrimination is unlawful does not simply lead people to believe that an employer is more likely …

Going Concerns And Environmental Concerns: Mitigating Climate Change Through Bankruptcy Reform, Alexander Gouzoules
Going Concerns And Environmental Concerns: Mitigating Climate Change Through Bankruptcy Reform, Alexander Gouzoules
Faculty Publications
This article examines how legislative reforms to the Bankruptcy Code could mitigate the effects of climate change, speed the adoption of renewable energy, and contribute to U.S. compliance with the Paris Agreement of 2015. It analyzes the benefits derived by the fossil fuel industry from Chapter 11, which allows extractive firms to survive boom-and-bust cycles caused by volatile oil and gas prices. Insolvent polluters are preserved as going concerns during price collapses, only to resume and expand production as prices recover.
This article proposes novel legislative reforms to the Bankruptcy Code that would require insolvent fossil fuel producers to liquidate …
Tokenized: The Law Of Non-Fungible Tokens And Unique Digital Property, Joshua A.T. Fairfield
Tokenized: The Law Of Non-Fungible Tokens And Unique Digital Property, Joshua A.T. Fairfield
Indiana Law Journal
Markets for unique digital property—digital equivalents of rare artworks, collectible trading cards, and other assets that gain value from scarcity—have exploded in the past few years. At root is the next iteration of blockchain technology, unique digital assets called non-fungible tokens. Unlike bitcoin, where one coin is the same as another, NFTs are unique, each with different attributes. An NFT that represented ownership of Boardwalk would be quite different from one that represented Baltic Avenue.
NFTs have grown from a few early breakout successes to a rapidly developing market for unique digital treasures. The attraction to buyers is that, unlike …
Revisiting The Ox-Bow Incident: The Almost Forgotten Western Classic About The Lynching Of Three Innocent Men Is As Relevant As Ever, Marc Bookman
Washington and Lee Journal of Civil Rights and Social Justice
The concept of lynching, several hundred years old and unclear in its origins, has never really left the lexicon. The word itself, however, has taken on different meanings over the years, from a mob’s taking the law into its own hands, to an organized utilization of racial violence as a means of societal control and intimidation; and finally to the more casual and defensive use of the word (“high tech lynching”) by current Supreme Court justices Thomas and Kavanaugh and others after being questioned about their past behaviors. Many academics have opined that the modern system of capital punishment is …
