Luck Egalitarianism And The Spirit Of Capitalism, Horacio Spector
Luck Egalitarianism And The Spirit Of Capitalism, Horacio Spector
The Journal of Contemporary Legal Issues
This paper is organized in six sections. In the following section, I discuss Dworkin’s and Cohen’s views regarding the function of markets in providing a method of social assessment. I suggest that their treatment of social valuation is of limited use because it is restricted to rudimentary economic systems like the immigrants’ island and the camping trip. In section III, I argue that the principle of responsibility is indeterminate in that it lacks a criterion of social value. I also claim that a Paretian interpretation of social value is the most plausible way to give concrete meaning to the idea …
Michael Perry And Disproportionate Racial Impact, Larry Alexander
Michael Perry And Disproportionate Racial Impact, Larry Alexander
The Journal of Contemporary Legal Issues
I am delighted to be contributing to this festschrift honoring Michael Perry. He and I go back a long way. He may not remember how far back, but I do. In 1980, when Michael was a faculty member at Ohio State’s law school, he organized a symposium on John Ely’s recent Democracy and Distrust, and he invited me to contribute to it, which I did. (The contributions were published in the 1981 volume of the Ohio State Law Journal.) I am not sure Michael knew me then, or why he invited me, but we have known each other and …

The Journal of Contemporary Legal Issues
In this essay, I will discuss these implications, and will reflect on how Michael Perry’s seemingly upbeat book can today be viewed as a harbinger of darker developments that were to come, and that are now upon us.

"Hang The Kaiser:" Philosophically Mediated Explanations Of World War I By The Decisions And Actions Of Those Responsible For The War, Michael S. Moore
The Journal of Contemporary Legal Issues
There has been a long-standing curiosity about why Europe destroyed itself in 1914 by starting the catastrophe known as World War I. In the past decade some of this interest was no doubt due to the coincidental fact that one hundred years had passed since the events in question took place. But the origins of the War hold a much deeper interest than that. Part of that deeper interest stems from the perceived impact that War had on the subsequent history not only in Europe, but in the rest of the world—the Russian Revolution, the end of colonial empires, World …

The Flaws Of Magic Bullet Theory: Retraining Unconscionability To Discretely Target Different Contexts Of Unfairness In Contracts, Marcus Moore
All Faculty Publications
Unconscionability has long been a troublesome area in Canadian jurisprudence. This is of significant concern given unconscionability’s pre-eminence as a protection of contractual fairness. This article elaborates a much-needed reorganization and rationalization of unconscionability in Canada. Under current law, a single doctrine hopelessly targets two divergent purposes. I set out here a proposed redevelopment rather of separate common law doctrines, each fit-for-purpose: (1) An English-style unconscionable bargains doctrine for avoiding bargains that exploited disability, and (2) an American-style unconscionable clauses doctrine to control unfair terms in standard form contracts. Extensive Canadian precedent supports this solution, assuring its feasibility and legitimacy. …

Transnational Corporations And Climate Governance: A Case Study Of Amazon.Com’S Net-Zero Climate Pledge, Jason Maclean
Transnational Corporations And Climate Governance: A Case Study Of Amazon.Com’S Net-Zero Climate Pledge, Jason Maclean
Dalhousie Law Journal
“Net zero” has become the predominant way of framing global, national, and nonstate climate change commitments. Hundreds of countries and thousands of corporations promise to achieve net-zero emissions by 2050 or earlier. Hopeful as this may seem, early evidence suggests the need to carefully scrutinize corporations’ climate promises. Specifically, there is an urgent need to critically assess the claim that strategic collaboration and compromise at the science-business-society interface can deliver the transformative social, economic, and political change required to address climate change.
Analyzing Amazon.com’s net-zero pledge as a case study, this article argues that strategic conflict with—and within—transnational corporations is …

Animal Rights Activism And The Constitution: Are Ag-Gag Laws Justifiable Limits?, Jodi Lazare
Animal Rights Activism And The Constitution: Are Ag-Gag Laws Justifiable Limits?, Jodi Lazare
Osgoode Hall Law Journal
It is a troubling time to be an animal rights activist in Canada. Recently, Alberta adopted legislation to create harsh penalties for trespassing onto private property, for obtaining permission to enter private property based on false pretences, and for interfering with vehicles on public highways. These laws relate to agricultural lands, to private property generally, and, where roads are concerned, to public property. Ontario has adopted similar legislation aimed specifically at agricultural property. The legislation in both provinces purports to protect the security of farmers, their families, and rural property owners generally, as well as the safety of the food …
The New Breed: What Our History With Animals Reveals About Our Future With Robots By Kate Darling, Amanda Turnbull
The New Breed: What Our History With Animals Reveals About Our Future With Robots By Kate Darling, Amanda Turnbull
Osgoode Hall Law Journal
ROBOTS WERE ONCE RELEGATED to roles that were “dirty, dull, or dangerous,”3 such as welding parts on car assembly lines, but today, they occupy more visible spaces in our workplaces, homes, and public areas. This visibility has provoked questions frequently seen in media inciting moral panic: Will robots cause job loss? Will robots become sentient? In The New Breed: What our History with Animals Reveals About our Future with Robots (“The New Breed”), Kate Darling explains that these fears are misplaced and that our tendency to anthropomorphize robots fosters false determinism. Darling imagines a different kind of agency, drawing on …

The Wages Of Crying Life: What States Must Do To Protect Children After The Fall Of Roe, Leah A. Plunkett, Michael S. Lewis
Pepperdine Law Review
In the post-Roe world, can a state rationally claim that the value of human life justifies the imposition of abortion bans but does not demand that a state protect the vulnerable young who are “born human beings”—commonly called “minors” or “children”—and are entitled to protection under a state’s laws? This essay advances the claim that it cannot. This essay asks that those who say they are “Pro-life” in politics and law demonstrate that they protect vulnerable life beyond the abortion context, and that they do so in the most minimal fashion: through a demonstrated commitment to protecting the basic welfare …
Investment Games, James Fallow Tierney
Investment Games, James Fallow Tierney
Duke Law Journal
Popular zero-commission stock trading apps like Robinhood innovate in user-experience design, featuring “gamification” practices—flashy graphics, leaderboards, and the like—that make it attractive, easy, and fun to trade stocks. Regulators are increasingly scrutinizing gamification and other digital engagement practices, with efforts underway at the SEC to adopt rules in broker-dealer and investment-advisor regulation. This attention reflects considerable skepticism about gamification in securities markets. At best, these practices encourage motivation and engagement, and democratize access to financial markets. But at worst, these practices encourage people to trade habitually and unreflectively, and more than they might want. This can lead to undesirable market-wide …
State Institutions And Democratic Opportunity, Miriam Seifter
State Institutions And Democratic Opportunity, Miriam Seifter
Duke Law Journal
The burgeoning commentary on democratic decline in the United States focuses disproportionately on the national level. And seeing a national problem, reformers understandably seek to bolster democracy through large-scale federal solutions. Although their efforts hold popular appeal, they face strong institutional headwinds. As scholars have extensively documented, the Senate, the Electoral College, and the Supreme Court today are skewed against majority rule. Despair grows.
This Article urges legal scholars and reformers to turn their gaze to state-level institutions. State institutions, the Article shows, offer democratic opportunity that federal institutions do not. By design, they more readily give popular majorities a …

Inflation Reduction Act’S Reception By Global Trading Partners, Sophia Hilsman
Inflation Reduction Act’S Reception By Global Trading Partners, Sophia Hilsman
Cardozo International & Comparative Law Review (CICLR) Blog
The Biden Administration touted the Inflation Reduction Act (the “IRA”), signed on August 16, 2022, as “the most aggressive action on tackling the climate crisis in American history.” The world desperately needs climate action. The seven warmest years recorded on Earth were 2015 to 2021. In 2021, global fossil fuel carbon dioxide emissions “returned to the pre-pandemic levels of 2019.”

Unsticking American Tort Theory, Benjamin Sundholm
Unsticking American Tort Theory, Benjamin Sundholm
University of Cincinnati Law Review
In the United States, the debate over the foundations of tort law is at an impasse. On one side of the dispute, economic theorists contend that tort law is primarily concerned with the forward-looking aim of maximizing societal wealth. The most prominent critics of this view claim that an economic analysis of tort law cannot explain the field’s backward-looking concern with achieving corrective justice by remedying wrongs. Despite the strength of this critique, economic theorists have a legitimate response available to them: corrective justice describes the reparative aspect of tort law, but it stops short of providing a justificatory account …

Texas A&M Law Review
This Essay explores how Carrie Menkel-Meadow’s life and work have both highlighted the path of “And”—showing and explaining that it is not only possible but also desirable to seek justice as well as peace, to be both activist and neutral. Of course, tensions will remain. Regarding particular issues in specific moments we all must decide which path we can and should take. Which activism is best, and which goes too far? With whom can we or should we negotiate, and when should we instead say, “I can’t negotiate with this person or group”? When should we talk and listen, and …

Ethical Negotiation And Postcapitalist Politics: An Essay For Carrie, Amy J. Cohen
Texas A&M Law Review
In a 1983 article, Legal Negotiation: A Study of Strategies in Search of a Theory, Carrie Menkel-Meadow took stock of what was motivating a diverse range of scholars to want to reimagine negotiation theory. She described these negotiation scholars as shaped by the exigencies of their own political moments. Some were lawyers concerned about too much litigation of an unsatisfying quality. Many, however, were concerned more broadly about “the general level of hostility in the world,” even haunted by the possibility that nuclear weapons could destroy all of humanity. Negotiation scholars included “[e]conomists and game theorists . . . concerned …

The Law Of Friends, Ezra Rosser
Scholarly Articles in Law Reviews & Journals
A serious law professor would not write an article about the TV show Friends, but having just written a book and an article, I’m on a “break.” Besides, I’m not that serious a law professor. And Friends is as good a topic as any. For those of us of a certain age—too young to have watched M.A.S.H. when it came out and old enough to remember watching broadcast TV and not just through a streaming service on a device—Friends was and is a big deal. It both captured a particular moment in history and helped make that moment.

Demons & Droids: Nonhuman Animals On Trial, Gerrit D. White
Demons & Droids: Nonhuman Animals On Trial, Gerrit D. White
PANDION: The Osprey Journal of Research and Ideas
Nonhuman animal trials are ridiculous to the modern sensibilities of the West. The concept of them is in opposition to the idea of nonhuman animals—entities without agency, incapable of guilt by nature of irrationality. This way of viewing nonhuman animals is relatively new to the Western mind. Putting nonhuman animals on trial has only become unacceptable in the past few centuries. Before this shift, nonhuman animal trials existed as methods of communities policing themselves. More than that, these trials were part of legal systems ensuring they provided justice for all. This shift happened because the relationship between Christian authorities and …

This chapter addresses design research and iterative curriculum design for the Lost & Found games series. The Lost & Found card-to-mobile series is set in Fustat (Old Cairo) in the twelfth century and focuses on religious laws of the period. The first two games focus on Moses Maimonides’ Mishneh Torah, a key Jewish law code. A new expansion module which was in development at the time of the fieldwork described in this article that introduces Islamic laws of the period, and a mobile prototype of the initial strategy game has been developed with support National Endowment for the Humanities. Literary translation is defined as one of the most difficult types of translation because literary texts embrace a lot of figurative devices and aesthetic effects that require skillful translators to render them into the target language successfully. The study is a translation of Nizar Qabbani's Poem titled "Balqees" into English. The study is of the following parts: Part one is concerned with the introduction, while the second part is about an overview with regard to the poet's life. As for part three, it is dedicated to the translation studies, methods, strategies and model of translation. Part four is a Translation …
