Significant Developments In Labor Law During The Last Half-Century, Russell A. Smith Jun 1952

Significant Developments In Labor Law During The Last Half-Century, Russell A. Smith

Michigan Law Review

It is common knowledge that dramatic and almost revolutionary developments have taken place in labor law since the turn of the century. Indeed, "labor law" has only during this period achieved the distinction of a recognized branch of the law. Concurrently, trade unions have experienced an amazing growth, as well as changes in basic structure, and it may fairly be stated that the enlargement of the pertinent body of law has both stimulated and been influenced by the augmentation of union power. This article is intended as a survey of significant developments in the law, not as a treatment of …

The Unhappy History Of Civil Rights Legislation, Eugene Gressman Jun 1952

The Unhappy History Of Civil Rights Legislation, Eugene Gressman

Michigan Law Review

The enforcement by federal legislation of the constitutional right of individuals is a story written largely in terms of confusion, distortion and frustration. Seldom, if ever, have the power and the purposes of legislation been rendered so impotent. Indeed, this story constitutes one of the saddest chapters in the historic struggle to effectuate the American ideal of freedom and equality for all.

Television Tort, Burt Derieux May 1952

Television Tort, Burt Derieux

Mercer Law Review

Our new medium of television has opened up entirely new vistas of entertainment, news coverage, and advertising. Though this medium is somewhat like radio and somewhat like that of the motion picture, the resulting combination of the two physical attributes of those two mediums, plus the factor of network-wide publication of events at the time those events are happening, has had unprecedented appeal to the public resulting in a stupendous increase in the number of television receivers in all parts of this country within range of television transmitters.

Restraints On Alienation Of Legal Interests In Michigan Property: Iii, William F. Fratcher May 1952

Restraints On Alienation Of Legal Interests In Michigan Property: Iii, William F. Fratcher

Michigan Law Review

In England the impossibility of inter vivos creation of interests in expectancy in chattels and the unsuitability for the purpose of the devices of bailment and contract have tended to restrict attempts to restrain the alienation of chattels to the trust device and provisions in wills for forfeiture on alienation. The trust device involves equitable interests, which are beyond the scope of this study. In connection with a bequest of the use and occupation of chattels for life or a term of years the English courts would probably sustain the validity of a provision for forfeiture on alienation by way …

Legal Fraternities, Kenneth H. York May 1952

Legal Fraternities, Kenneth H. York

Michigan Law Review

No exact computation of the number of practicing attorneys who are members of legal fraternities is available. However, well over 120,000 law students have in the past 82 years affiliated with a legal fraternity-no account being taken of the numbers belonging to purely local societies. Since the great majority of these individuals have entered into the practice, it is apparent that the Survey of the Legal Profession would not be exhaustive without some reference to such organizations. Professional Greek-letter fraternities now exist in practically all conceivable fields from Animal Husbandry to Textile Arts. Their legal counterpart furnished the model.

Taxation-Federal Income Tax-Gain On Sale Of Livestock, David F. Ulmer S.Ed. May 1952

Taxation-Federal Income Tax-Gain On Sale Of Livestock, David F. Ulmer S.Ed.

Michigan Law Review

Taxpayer was engaged in the business of raising and breeding beef cattle. Each year he would add to the breeding herd the young females raised the previous year and would cull from the herd those older cows who had outlived their most productive years and such young heifers as had proved unproductive. These culls were sold on the market, and taxpayer returned the amounts received from these sales as capital asset gain. The Commissioner assessed a deficiency claiming the sales resulted in ordinary income. Held, the sale of culls from a breeding herd is treated as a sale of …

Taxation-Federal Income Tax-Exempt Corporations-Statutory Interpretation, Patrick J. Ledwidge Apr 1952

Taxation-Federal Income Tax-Exempt Corporations-Statutory Interpretation, Patrick J. Ledwidge

Michigan Law Review

Plaintiff corporation was organized in 1947 by physicians who had formerly maintained a clinic for the practice of medicine as a partnership. The articles of incorporation provided that there should be no capital stock and no dividends, and stated that plaintiff was organized as a non-profit corporation for the purpose of providing medical treatment and hospitalization to sick and injured persons without regard to ability to pay therefor, and of providing such other incidental charitable services as the "trustees" of the corporation should prescribe. Pursuant to its by-laws, plaintiff paid such annual salaries to its member physicians as the trustees, …

Evidence As A Problem In Communicating, Edward W. Cleary Apr 1952

Evidence As A Problem In Communicating, Edward W. Cleary

Vanderbilt Law Review

The law of evidence is sagging to the point of collapse under its own weight. It has cracked visibly in the administrative sphere, and what saves it in the courts is probably a rather general ignorance of what is actually between the covers of Wigmore, plus the fact that lawyers and judges often seem to be downright ashamed to push the rules to their logical extremes. Evidence in action is, happily perhaps, somewhat different from evidence in books. Nevertheless, among people who are thoughtful about such things there is general agreement that something ought to be done.
