Washington Water Rights—A Sketch, Arval A. Morris Aug 1956

Washington Water Rights—A Sketch, Arval A. Morris

Washington Law Review

The general water policy applicable to unappropriated land within Washington Territory was that of prior appropriation and was announced by the Congress at an early date.6 Congressional enactments were passed in order to conform policy to the then existing practice of appropriation of water to a beneficial use and to encourage settlement of new areas. The Desert Land Act of 1877 effected a severance of all unappropriated non-navigable water from the public domain and made these waters publici juris. In addition, the states, including those forthcoming from the territories, were given plenary control over the severed water and were allowed …

The Fourteenth Amendment Reconsidered, The Segregation Question, Alfred H. Kelly Jun 1956

The Fourteenth Amendment Reconsidered, The Segregation Question, Alfred H. Kelly

Michigan Law Review

Some sixty years ago in Plessy v. Ferguson the Supreme Court of the United States adopted the now celebrated "separate but equal" doctrine as a constitutional guidepost for state segregation statutes. Justice Brown's opinion declared that state statutes imposing racial segregation did not violate the Fourteenth Amendment, provided only that the statute in question guaranteed equal facilities for the two races. Brown's argument rested on a historical theory of the intent, although he offered no evidence to support it. "The object of the amendment," he said, "was undoubtedly to enforce the absolute equality of the two races before the law, …

Family Responsibility In Tort, William J. Harbison Jun 1956

Family Responsibility In Tort, William J. Harbison

Vanderbilt Law Review

At common law an unmarried woman occupied no special status as far as tort liability was concerned, and the same rules and standards of responsibility applied to her as to society generally. Since marriage imposed upon a woman a very extensive disability, however, there developed a number of special rules concerning tort responsibility of the married woman.

Marriage did not impose upon the wife any special or peculiar liability for wrongful acts committed by her husband at common law, and, except in certain instances hereafter noted, she is not thus liable today. It is true that since the enactment of …

Social Scientists Take The Stand: A Review And Appraisal Of Their Testimony In Litigation, Jack Greenberg May 1956

Social Scientists Take The Stand: A Review And Appraisal Of Their Testimony In Litigation, Jack Greenberg

Michigan Law Review

"How to inform the judicial mind, as you know, is one of the most complicated problems,'' said Justice Frankfurter during argument of the school segregation cases. And as law deals more and more with issues of great public consequence the judiciary's need for knowledge increases. Much of this knowledge is within the realm of what are called the social sciences.

Although jurisprudents and social scientists have long complained of a gulf between law and social science, little notice has been given to the recent, recurrent collaboration between the two at the trial level. In a variety of cases social scientists' …

The Political Process, Milton R. Merrill Apr 1956

The Political Process, Milton R. Merrill

Faculty Honor Lectures

The a priori basis on which this discussion rests is that individual human freedom is desirable. The defense of this thesis is not extensive nor profound-it is rather elementary and personal. There is a further assumption, for which limited historical argument is made, that freedom, the sine qua non of political life, is best achieved and cherished in the atmosphere of parliamentary democracy. There is recognition that such freedom is limited and controlled, but there is full acceptance that in degree it does and should exist.

The argument then proceeds to the analysis of the essential element in a democratic …

The Twilight Zone Of Hearsay, Richmond Rucker Apr 1956

The Twilight Zone Of Hearsay, Richmond Rucker

Vanderbilt Law Review

The twilight zone of hearsay and nonhearsay has provoked searching analyses by eminent authorities in the field of evidence. Although these contributions have doubtless been of inestimable value, exerting a profound influence in the solution of problems dealing with acts and utterances within this area of proof, there is much to be desired in the way of clarity as reflected by innumerable opinions of the courts. No fatuous notion is here entertained that within the limits of this discussion order will be rescued from chaos, or for that matter that an appreciable contribution will be made toward that end. Nevertheless, …

Soviet Law And Soviet Society, By George C. Guins (1954), V. A. Riasanovsky Mar 1956

Soviet Law And Soviet Society, By George C. Guins (1954), V. A. Riasanovsky

Washington Law Review

The present work comprises Soviet Philosophy of Law, Land and Labor Law, State Law, Soviet Justice and also social structure (Soviet Society), International Law (principles and practice) and the legal order in the Soviet satellites. Application of the comparative method allows the author to describe all the differences between the legal system of the modem democratic nations and Soviet law. Owing to the analysis of both systems and their psychological and sociological effects, it becomes easier to understand what the Soviet legal system means for an individual and society, for national economy and morals. It is a new approach to …

Workshops On Legal Problems Of Atomic Energy, University Of Michigan Law School Jan 1956

Workshops On Legal Problems Of Atomic Energy, University Of Michigan Law School

Summer Institute on International and Comparative Law

In 1952 the University of Michigan Law School, as a part of its summer session program, offered an Institute entitled "Industrial and Legal Problems of Atomic Energy. " The 1946 Atomic Energy Act, creating a virtually complete government monopoly, was then in effect, and private development of peaceful uses of atomic energy was for the most part merely a gleam in the eyes of a few forward-looking individuals. The 1952 Institute was devoted to the task of obtaining a preview of atomic affairs to come. The speakers on the program could do no more than look forward and speculate on …
