Taxation-Federal Income Tax-Enjoining Collection, D. Michael Kratchman S.Ed.
Michigan Law Review
Taxpayer sued to enjoin collection of federal insurance contributions and unemployment taxes with respect to certain fishermen who worked on boats operated by the corporate taxpayer. The Government contended that under the Internal Revenue Code an injunction could not be sustained on a showing of non-liability. The district court issued the injunction on the grounds that the tax was illegal because no employer-employee relationship in fact existed and that collection of the tax would ruin the corporation financially. The court of appeals affirmed, holding that a taxpayer may enjoin the collection of a federal tax when he shows its illegality …

Providing For The Use Of Lands In The Garrison Dam Project By The Three Affiliated Tribes Of The Fort Berthold Reservation, United States Congress, Us Senate
US Government Documents Related to Indigenous Nations
This report from the United States (US) House Committee on Interior and Insular Affairs, dated July 12, 1962, was written to accompany US Senate Bill 1161 which proposed to restore grazing rights to the Three Affiliated Tribes of the Fort Berthold Reservation on lands that were taken by the United States government for the Garrison Dam project. This report recommends an amendment to the wording of the bill. This amendment mirrors language used in similar bills relating to the Lower Brule and Crow Creek Indian Tribes. This bill resolves the grazing rights issues on these lands and will benefit the …

Psychosexuality And The Criminal Law, Ralph Slovenko, Cyril Phillips
Psychosexuality And The Criminal Law, Ralph Slovenko, Cyril Phillips
Vanderbilt Law Review
It is common knowledge that sexual mores vary in every culture. Sexual ethic and social structure are interrelated. Sexual morality is not the same in an industrially advanced society as it is in a primitive agriculture regime (the industrial revolution's influence upon sexual morals will so attest) Sexual mores vary in different parts of the same country (Puritan Massachusetts and pioneer Wyoming could not be expected to develop the same set of rules), and indeed between different social strata in the same one locality. Every society imposes regulations and codes upon sexual relations, and quite rightly. However, the striking fact …
Subnormal Mentality As A Defense In The Criminal Law, John E.V. Pieski
Subnormal Mentality As A Defense In The Criminal Law, John E.V. Pieski
Vanderbilt Law Review
Although little is left of the theory which ascribed to mental deficiency causative force in criminal conduct, the entire episode taught at least two valuable lessons to modem criminologists. First, it served as a warning against superficial research and hasty conclusions, thus inducing subsequent scholars to take a more scientific approach to similar problems. Second, it aided in alerting others that, although not all or even most criminals are mentally deficient, there are an appreciable number of criminals who possess a subnormal mentality, and who must be reckoned within the criminal law. Notwithstanding that the legal profession has utilized the …

The Extension Of Insurance Subrogation, Spencer L. Kimball, Don A. Davis
The Extension Of Insurance Subrogation, Spencer L. Kimball, Don A. Davis
Michigan Law Review
When an insured loss occurs under circumstances that make a third person liable to reimburse the insured, there are various possible ways to adjust the loss among the three persons involved. One solution would permit the policyholder to recover both on the insurance and from the third person, i.e., would permit double recovery for the loss. A second solution would give the third person the benefit of the insurance by denying recovery from him. A third solution would subrogate the insurer to the policyholder's rights against the third person. Combinations of these three solutions are possible by applying sometimes …
