Abortion In Perspective, Robert M. Byrn Jan 1966

Abortion In Perspective, Robert M. Byrn

Duquesne Law Review

The abortion controversy is assuming national proportions. The Association for the Study of Abortion, a nationwide organization dedicated to a liberalization of the law, has enlisted a cadre of speakers "to educate the public to reform." The Association seems to be politically as well as pedagogically oriented. One of its spokesmen recently hailed an abortion liberalization bill, introduced at the 1966 session of the New York State Legislature, as a "rallying point for reform forces in the state."' The abortion debate is already in vigorous progress in several states, including Pennsylvania and New York, but these states are not unique. …

Use Of The Legislative Process In Protecting Animals, Hugh Mcnamee Jan 1966

Use Of The Legislative Process In Protecting Animals, Hugh Mcnamee

Laws and Legislation Collection

The statements that I shall make in this address are based upon experience gained by me as a lawyer, and as a member of the Ohio House of Representatives. That experience was applied to the successful pioneer attempt to enact the Ohio Rodeo Law of which I was the author and the pilot. Ohio is the first state in which a law has been passed to prohibit certain cruelty practices prevalent in rodeos and thus virtually eliminate them as a medium of public entertainment.

The origin of legislation is in some comprehension of a condition that needs correction by law. …

Commercial Farm Law: The Uniform Commercial Code, Thomas B. Allington, Clayton K. Yeutter

Department of Agricultural Economics: Faculty Publications

Commercial law includes such topics as sales contracts, notes, checks, shipping and storage documents, and a variety of financing instruments. Over the years much of the law on these topics has become complex, confusing, and often obsolete. The Uniform Commercial Code, or U.C.C., is designed, first, to bring about uniformity in state laws governing commerce, and second, to clarify, simplify, and modernize these laws. The Code's success in this respect is shown by the fact that it has now been adopted by almost all states. It became effective in Nebraska on September 2, 1965. Drafting of the U.C.C. dates back …

Malpractice By Veterinarians, Martin J. Strobel Jan 1966

Malpractice By Veterinarians, Martin J. Strobel

Cleveland State Law Review

The veterinarian's liability is measured by the same basic standards applicable to physicians and surgeons. In both fields the technical nature of the malpractice action creates special problems. To determine the issue of liability the jury must identify both the historical facts and the standard of care. Attempting to resolve issues of medical fact may be difficult for a lay jury; such resolution demanding as it does, not merely an appraisal of the witnesses' demeanor and character, but an evaluation of their stories in the context of the situation giving rise to the cause of action.

A Sentencing Problem: How Far Is A Fall From Grace, H. H. A. Cooper Jan 1966

A Sentencing Problem: How Far Is A Fall From Grace, H. H. A. Cooper

Cleveland State Law Review

It is now almost universally accepted that there are three possible bases underlying sentences imposed by the Courts, following some breach of the criminal law. These are generally described as retribution, deterrence and reformation. Occasionally these qualities are considered in combination under some such title as the "aims of penal measures." Another factor, ever present in a vague though influential form, now seems to be emerging from the shadows to assume more definite shape. Yet to materialize is its relationship to the other established, uncontroverted aims. The emergent element may conveniently be termed "public disapproval," under which may be subsumed …

Traumatic Cancer, Theodore Dyke Jan 1966

Traumatic Cancer, Theodore Dyke

Cleveland State Law Review

The relationship of trauma to cancer may be of minimal import to the medical world; however, it is extremely important to the attorney from the point of view of compensation. The real problem is that no one knows what "causes"cancer. The present state of the medical art indicates that a given cancer may be caused by any of a number of factors, acting singly or jointly. Trauma is one of these factors, but the exac teffect of a single trauma in causing cancer is unknown. Medical experts will honestly differ in their opinions, because in fact they are frequently just …
