Control Of Air Pollution Through The Assertion Of Private Rights, Julian Conrad Juergensmeyer Jan 1967

Control Of Air Pollution Through The Assertion Of Private Rights, Julian Conrad Juergensmeyer

Articles by Maurer Faculty

Air pollution is clearly one of the major social problems confronting contemporary American society. Yet the United States is still without an effective federal pollution control program, and those state and local control programs that do exist are largely ineffective. Until government regulation is able to keep the expulsion of air contaminants within tolerable limits, it will be necessary for those seeking to control air pollution to rely upon the assertion of private rights. In this article the author discusses the principal causes of action available to the private pollution controller, and concludes that, although traditional legal concepts may provide …

Obscenity: From Hicklin To Hicklin?, Frank W. Smith Jr. Jan 1967

Obscenity: From Hicklin To Hicklin?, Frank W. Smith Jr.

University of Richmond Law Review

Modern advances in printing, distribution and advertisement have accentuated an old problem of social and legal significance-what, if anything, should be done to control obscene publications. Increased concern with the problem has been shown not only by organizations active in this area, by numerous articles and books which have recently been written, but also by the courts, highlighted by the recent Ginzburg, Mishkin' and 'Fanny Hill' cases. These cases have been hailed by some as a license for a full scale war on the "smut peddlers" and by others as a caution to proceed slowly. The obscenity problem brings into …

Note, Medical And Dental X-Rays--A Time For Re-Evaluation And State Action, James H. Seckinger

Journal Articles

In 1956, the National Academy of Sciences in a report on "The Biological Effects of Atomic Radiation" warned the public of the serious consequences that may flow from any type of radiation exposure. The report set forth the relationship between low-level exposure, that type of exposure which is present in the medical and dental use of X-rays, and long-range biological effects. Because of the possibility of such long-range effects, the Academy recommended that the medical authorities take prompt action to eliminate all unnecessary radiation in the use of X-rays.

Despite the strong language used by the Academy, and the lapse …

Trespassing Children: A Study In Expanding Liability, R. Neal Batson Dec 1966

Trespassing Children: A Study In Expanding Liability, R. Neal Batson

Vanderbilt Law Review

When confronted with a case involving a child plaintiff, attorneys and the courts should recognize that the doctrine of attractive nuisance is only one of several theories on which the plaintiff may proceed against a landowner. The status of a plaintiff should first be determined. If the child is a trespasser, then either the constant trespasser theory, the known trespasser theory, or the doctrine of attractive nuisance may be applicable. It is possible, however, that the court may reject any one or all of these theories and decide the particular case under the general negligence principles of foreseeability of harm …

Obscenity: Some Problems Of Values And The Use Of Experts, John P. Frank Aug 1966

Obscenity: Some Problems Of Values And The Use Of Experts, John P. Frank

Washington Law Review

John P. Frank advances the view that for trial convenience, the complainant should be required to make his prima facie case of obscenity, with the literary merit of the work as an independent affirmative defense. He applauds the recent development by the Supreme Court of the "pandering test" as an element of obscenity, but supports the view of Justices Clark and White that the question of "redeeming social value" should merge in the analysis of the dominant theme of the material—or, he suggests instead, should be an affirmative defense. He considers the functions of experts in obscenity cases, reporting the …
