Removal Of Voting Power From Members Of Non-Profit Organizations, Timothy L. Nesbitt Jan 1967

Removal Of Voting Power From Members Of Non-Profit Organizations, Timothy L. Nesbitt

Cleveland State Law Review

It is evident that the right to vote in non-profit organizations has been judicially recognized but has received uneven protection. As a general rule, unless the right to vote is specifically restricted, every member of a non-profit organization is entitled to vote. The right to vote maybe defined in the provisions by which the organization is governed, and in that case the right to vote is restricted to those within the terms of the governing provision.

Liability Of Police Officers For Misuse Of Their Weapons, Herbert E. Greenston Jan 1967

Liability Of Police Officers For Misuse Of Their Weapons, Herbert E. Greenston

Cleveland State Law Review

The focus of this article is twofold: it will begin by examining the historical development of the body of law which deals with the liability of the police officer for the negligent use of his weapons, and it will attempt to consider the practical problems confronting the attorney for the injured plaintiff in marshalling his evidence and presenting his case.

Strict Liability In Tort: A Modest Proposal, David G. Epstein Jan 1967

Strict Liability In Tort: A Modest Proposal, David G. Epstein

Law Faculty Publications

Centuries ago, the noted Irish satirist, Jonathan Swift, made a "modest proposal' that the inhabitants of the Emerald Isle remedy a severe food shortage they were experiencing by eating their young. To some, a proposal of the adoption of strict liability in tort-regardless of how limited-is no more a modest proposal than Mr. Swift's. It is submitted that this opposition to strict liability in tort is at least in part due to a misunderstanding of the present state of the law as to a manufacturer's liability to injured consumers. In most jurisdictions, the adoption of strict liability in tort for …

Abortion, The Law And Human Life, Thomas L. Shaffer Jan 1967

Abortion, The Law And Human Life, Thomas L. Shaffer

Journal Articles

The issue in abortion "reform" is whether existing criminal sanctions against doctors and pregnant women should be abolished or liberalized. From one point of view this is the question presented in any discussion of the criminal law—whether people should be put in jail for doing something. From another viewpoint, it is the question presented in any discussion of existing law—whether the reformers, who presumably have the burden of proof, have made a case. The controversy will be especially interesting to Indiana lawyers, who last winter saw an abortion-reform proposal pass both houses of the General Assembly and then die (abort?) …

Control Of Air Pollution Through The Assertion Of Private Rights, Julian Conrad Juergensmeyer Jan 1967

Control Of Air Pollution Through The Assertion Of Private Rights, Julian Conrad Juergensmeyer

Articles by Maurer Faculty

Air pollution is clearly one of the major social problems confronting contemporary American society. Yet the United States is still without an effective federal pollution control program, and those state and local control programs that do exist are largely ineffective. Until government regulation is able to keep the expulsion of air contaminants within tolerable limits, it will be necessary for those seeking to control air pollution to rely upon the assertion of private rights. In this article the author discusses the principal causes of action available to the private pollution controller, and concludes that, although traditional legal concepts may provide …
