Law And Psychology In Conflict. By James Marshall, Stanley E. Willis Ii Jun 1967

Law And Psychology In Conflict. By James Marshall, Stanley E. Willis Ii

San Diego Law Review

The author of Law and Psychology in Conflict, Mr. James Marshall, is a successful and respected member of the New York Bar. Constitutional law experts may remember him for his successful representation of the NAACP in the second of the "Texas primary election cases" (Grovey v. Townsend, 295 U.S. 45). His skills are not merely those of advocacy. He had been an Adjunct Professor of Law at New York University, has been the president of the New York City Board of Education, and has written several books and articles on political philosophy. Mr. Marshall is a successful blend of brilliance, …

The Labor Court Idea, R. W. Fleming Jun 1967

The Labor Court Idea, R. W. Fleming

Michigan Law Review

When the War Labor Board first began to exert pressure on companies and unions to adopt grievance arbitration clauses during World War II, there was a considerable hesitance on both sides. Both groups worried that while third party decision making might momentarily improve productive efficiency, it would do so at the price of a long-run loss in institutional integrity and autonomy, and peace at any price held little fascination for either side. Nevertheless, grievance arbitration was accepted and gradually became the normal mechanism for resolving contractual disputes in the United States.

Legal Implications Of Clinical Investigation, Howard N. Morse May 1967

Legal Implications Of Clinical Investigation, Howard N. Morse

Vanderbilt Law Review

There is an increasing concern among the members of the medical profession with legal rights, obligations and limitations affecting clinical investigation. This is understandable in light of the virtual explosion of clinical investigation within medical science. Clinical investigation is the systematic collection, evaluation and reporting, by or under the supervision of physicians, of data about other human beings for the purpose of advancing scientific medical knowledge. Thus it includes neither investigation relating to animals (even though such investigation may also advance scientific medical knowledge), nor investigation of human beings for purposes unrelated to medical science, nor the trial of unproven …

Judicial Review: A Tri-Dimensional Concept Of Administrative-Constitutional Law, Frank R. Strong Apr 1967

Judicial Review: A Tri-Dimensional Concept Of Administrative-Constitutional Law, Frank R. Strong

West Virginia Law Review

In an earlier issue of the present volume of the Review, an effort was made to dispel the seeming absurdity that "Separation of Powers, the cardinal principle upon which the federal and all state governments are founded, a great American contribution to the science of government, violates the due process clause!" The quotation is from an able and exhaustive article on Judicial Review of Administrative Action in West Virginia, written by Kenneth Gulp Davis at the beginning of a teaching and writing career which has brought him preminence in the field of Administrative Law. The article appeared in Volume 44 …

Jurisprudence And The Nature Of Language: Contrasting Views Of Hart And Chomsky, Anon Apr 1967

Jurisprudence And The Nature Of Language: Contrasting Views Of Hart And Chomsky, Anon

Washington Law Review

Because much of modern philosophy has been preoccupied with some form of language analysis and because jurists often apply philosophical techniques and insights when attempting to solve jurisprudential problems, theories or views of the nature of language have considerable jurisprudential significance. The point is illustrated by the recent movement toward using the methods of "ordinary language" philosophy in the analysis of legal problems. The pattern is not new; a roughly similar relationship is seen in positivism and its application in jurisprudence. The notion behind this approach is that an understanding of the nature of language contributes to the solution of …

State Trading Activities In Hungary, Stephen Szaszy Mar 1967

State Trading Activities In Hungary, Stephen Szaszy

Vanderbilt Law Review

The influence of the state in the organization and control of foreign trade is, as a matter of course, even greater in socialist states than in Western countries. In socialist countries the characteristic features of foreign trade are state monopolization of foreign trade and foreign exchange. The exclusive bearer and performer of international connections is the state itself. By virtue of its foreign trade monopoly, it not only regulates and directs foreign trade, but it is fully responsible for both concluding and executing international agreements. All operative activities of foreign trading are performed in socialist countries by state-created enterprises, established …

Introduction—U.S./Japanese Trade: Its Scope And Legal Framework, Dan Fenno Henderson Mar 1967

Introduction—U.S./Japanese Trade: Its Scope And Legal Framework, Dan Fenno Henderson

Washington Law Review

For the past several years, the United States has had more trade with Japan than with any other country in the world, except Canada. Furthermore, the state of Washington has had the highest per capita exports to Japan of any of the states, due largely to wheat, logs, and jet aircraft. Besides its obvious benefits, growing trade interdependence has caused its own frictions which have, in turn, required intervention by the American and Japanese governments. This has produced treaties as well as national legal regulation in both Japan and the United States to supplement the private law of sales. Something …

Aec Production And Distribution Of Radioisotopes: State Trading In A Free Enterprise Economy, E. Blythe Stason Mar 1967

Aec Production And Distribution Of Radioisotopes: State Trading In A Free Enterprise Economy, E. Blythe Stason

Vanderbilt Law Review

Among the one hundred or so business-type activities of the Government are certain operations of the Atomic Energy Commission. In this article we shall examine the origin, growth and usefulness of just one phase of these AEC activities, that is, the production and distribution of radioisotopes. This activity is singled out for emphasis partly because of the remarkable success story resulting from the use of such isotopes, but more especially because of an unusual and even unique aspect of "state trading" introduced into the business by the AEC. We refer to, and shall explain in some detail, an unusual self-limiting …

Communist China's Foreign Trade Organization, Gene T. Hsiao Mar 1967

Communist China's Foreign Trade Organization, Gene T. Hsiao

Vanderbilt Law Review

Although as of October 1966 Communist China has been diplomatically recognized by only fifty countries' and thus still remains outside the world legal community, it has trade relations with more than 120 countries and regions. The annual volume of Peking's foreign trade has been estimated at 2.96 billion dollars in 1963 and 4.5 billion dollars in 1966. The latest Western reports from Peking indicate that foreign buyers and sellers see in "China's 700 million people a market with dazzling prospects and a potential source "of supply of goods they can market profitably in their countries." The official organ of the …

Slumlordism As A Tort, Joseph L. Sax, Fred J. Hiestand Mar 1967

Slumlordism As A Tort, Joseph L. Sax, Fred J. Hiestand

Michigan Law Review

The war against poverty has been fought with rather more vigor than its initiators contemplated. Thus far, however, the major engagements have taken place in the streets of Watts and Chicago, which is not quite what they had in mind. Some, who think it odd that as we pass more laws we get more lawlessness, will perhaps content themselves by observing that the feeding hand is always bitten. Those less easily satisfied have begun to see the need for adopting some legal solutions as far reaching as the problems they are designed to abate; the following article is addressed to …
