Horseplay By Employees, Howard L. Oleck
Horseplay By Employees, Howard L. Oleck
Cleveland State Law Review
A principal type of practical joke (horseplay) injury is that caused by workmen trying to lighten the dull routine of work by playful funmaking. This involves the well established liability of a master for the torts of his servant done in the course and scope of the employment. It also involves the well-known limitation on respondeat superior that results when an employee in effect abandons his employment by making a detour from his business route, or by engaging in "a frolic of his own." This body of law has been greatly limited and changed (but not totally abolished) by enactment …
Liability For Leaving A Firearm Accessible To Children, William C. Gargiulo
Liability For Leaving A Firearm Accessible To Children, William C. Gargiulo
Cleveland State Law Review
Enmeshed in the right to possess a firearm is the duty of care. Thus, the duty of care applies not only to using a firearm, but also to safeguarding the firearm from reasonably anticipated improper use by others. The liability of a person for permitting, or for leaving, a firearm accessible to children has been based upon failure to exercise the required duty of care in regard to a dangerous instrumentality. It is the objective of this note to consider whether or not the doctrine of absolute liability should be extended to hold that when a person permits a child to …

Some Observations On The Law Of Water Allocation As A Variable In Industrial Site Location, Sheldon J. Plager
Some Observations On The Law Of Water Allocation As A Variable In Industrial Site Location, Sheldon J. Plager
Articles by Maurer Faculty
The availability of a water supply is of vital concern to industry. This availability may be affected as much by the applicable legal doctrine as by the accessibility of an adequate water supply. Professor Plager explores the two major riparian doctrines that apply to surface water supplies: "natural flow" and "reasonable use." He concludes that, although the theoretical differences between the two doctrines are often blurred, practical differences are present.

On Interpreting The Ethiopian Penal Code, Peter L. Strauss
On Interpreting The Ethiopian Penal Code, Peter L. Strauss
Faculty Scholarship
The aim of this article is to set out and discuss some general principles of interpreting the Ethiopian Penal Code – that is to say, of using it. Even now, ten years after it came into effect, many people have difficulty in understanding and using the Penal Code in a straightforward way. It seems complex, and many of its fundamental conceptions are unfamiliar to Ethiopian lawyers. This article, discussing at length how the code is built, may help reduce its apparent complexity and thus facilitate its day-to-day application.
The Three Faces Of Meade, Wylie H. Davis
The Three Faces Of Meade, Wylie H. Davis
Georgia Law Review
Y OUTH and middle-ager, I have known David Meade Feild for nigh-on thirty years. But since my first encounter with him in 1939 at Mercer University-as one of his naive freshman law students -my aggregate daily association with him has been a mere three years. Even this all-too-short span has been fragmented by events into three very different time and experience phases. My impressions of Professor Feild and his impact on me bring to mind a fabled phenomenon of human observation and reporting aptly described by a former col- league: The process is remindful of [three] blind men feeling the …
