The Definition Of Indigency: A Modern-Day Legal Jabberwocky., Charles E. Evans
St. Mary's Law Journal
It is appropriate for legal scholars to attempt to identify what the term “indigency” means as a legal standard as it elicits large disparities in connotation, and therefore, in treatment. In fact, there are so many connotations to choose from that different jurisdictions often look upon the word as a flexible standard which is inherently vague. Such vagueness can only lead to abuse by those who do not really need financial assistance. Three main views exist regarding the proper definition of the word. One group of scholars argues that “indigency” standards should be based on actual income, while a second …

The Tennessee Water Quality Control Act Of 1971: A Significant New Environmental Statute, Julian C. Juergensmeyer
The Tennessee Water Quality Control Act Of 1971: A Significant New Environmental Statute, Julian C. Juergensmeyer
Vanderbilt Law Review
Tennessee's new Water Quality Control Act' is one of the most significant pieces of environmental legislation to be produced in recent years. It is destined not only to revamp water pollution control in Tennessee but also to serve as a model for legislation in other states. The Act and commentary written by its drafter, Professor Frank E. Maloney, are printed following this article. Consequently, no attempt will be made to summarize the entire Act or to provide a detailed guide for its use. The purpose of this introductory article is to examine the salient, often innovative, features of the Act …
The Tennessee Water Quality Control Act Of 1971, Frank E. Maloney
The Tennessee Water Quality Control Act Of 1971, Frank E. Maloney
Vanderbilt Law Review
The text of the Act and commentary that follows is the product of a larger study undertaken by Professor Maloney at the request of the 87th General Assembly of the State of Tennessee. This study was the subject of a seminar on environmental protection at the Vanderbilt University School of Law. Four of the participating students--Elbert E. Edwards, III, Thomas H. Graham, Robert D. McCutcheon, and Paul L. Sloan--drafted the proposed statute and commentary under Professor Maloney's supervision with the research assistance of the other members of the class. For many sections of the statute, the drafters drew heavily from …

The National Industrial Pollution Control Council: Advise Or Collude?, William H. Rodgers, Jr.
Articles
This article analyzes three aspects of the National Industrial Pollution Countrol Coucil's performance: (1) the promise and risks it has presented; (2) its procedural performance, as tested by governing law; and (3) its accomplishments, both on the record and sub rosa, as measured by the expectations. In brief, NIPCC is portrayed as a dangerously anticompetitive institution occasionally doing business in violation of the law. The Council has published both public relations material and some useful data, but it has served more importantly as a lobbying forum for industries chafing under the regulatory bit. The experience of NIPCC forms the basis …

Persuasion In The Courtroom, William C. Costopoulos
Duquesne Law Review
Persuasion is defined as "an act of influencing the minds of others by arguments or reasons, by appeals to both feeling and intellect; it is the art of leading another man's will to a particular choice, or course of conduct." No one doubts this is what trial lawyers do every day in the courtroom-and that is what this article is about.

Courtroom Misconduct By Prosecutors And Trial Judges, Albert W. Alschuler
Courtroom Misconduct By Prosecutors And Trial Judges, Albert W. Alschuler
Articles
As courtroom disruption became a national issue in the late 1960's, public attention focused primarily on the conduct of the criminal defense attorney and his client. Professor Alschuler examines the courtroom misconduct of prosecutors and trial judges both as it relates to disruptive behavior by defendants and defense attorneys and as it poses a threat in its own right to the orderly administration of justice.

Nonprofit Unincorporated Associations, Howard L. Oleck
Nonprofit Unincorporated Associations, Howard L. Oleck
Cleveland State Law Review
Western civilization has been (and is) characterized by voluntary associations of people, from the earliest warrior bands and "churches" to towns and universities and guilds, etc. Corporations, as vehicles for such associations, did not exist until relatively recently, and associations were (and very many still are) unincorporated. Unincorporated associations as a form of organization have been losing ground to the corporation, but are far from obsolete
