Recent Trends In Transport Rate Regulation, Leonard S. Goodman
Recent Trends In Transport Rate Regulation, Leonard S. Goodman
Michigan Law Review
The object of this Article is to describe the trends in the Commission's work during the 1960's in some of the areas of rate regulation that could not be settled by mere reference to costs, and in other areas of changing rate policy. This was a prolific period for the Commission, one that involved many rate innovations and a sense of new direction in certain aspects of rate regulation. The present discussion of the Commission's rate work is in no sense complete; and there is no intention to make it so. By emphasizing the decisions of the recent decade, I …

The New Catv Rules: Proceed On Delayed Yellow, Roscoe L. Barrow
The New Catv Rules: Proceed On Delayed Yellow, Roscoe L. Barrow
Vanderbilt Law Review
Elites largely govern our nation's current decision-making process. The average citizen's failure to participate in that process perhaps derives largely from his inability to inform himself adequately on all the issues. However, the ability of cable television (CATV) to place each person in complete command of his informational and entertainment environment has thrust society upon the threshold of an electronic communications revolution. Indeed, if CATV is allowed to develop its full potential, the individual will not have to receive information and entertainment passively. Rather, CATV's virtue of two-way communication will permit him to transmit as well as receive information. His access …
A Second Look At United States Fisheries Management, Thomas A. Clingan Jr.
A Second Look At United States Fisheries Management, Thomas A. Clingan Jr.
San Diego Law Review
Once again commercial fishing is the object of intensive study in certain quarters. Now, as in the past, this study is receiving nurture from the on-going negotiations regarding the broader issues of international law of the sea. Necessary to these discussions is the need to consider the issues important to the fishing nations. Further, it is more than likely that fishing rights are so intertwined with other problems, such as the breadth of the territorial sea, the limits of national jurisdiction on the continental shelf, or the appropriate regime for the governance of the seabeds beyond national jurisdiction, that separate …

The Interests Of Land-Locked States In Law Of The Seas, Patrick Childs
The Interests Of Land-Locked States In Law Of The Seas, Patrick Childs
San Diego Law Review
Approximately one fifth of the nations of the world are landlocked, having no direct access to the sea within the bounds of their territorial jurisdiction. These nations, throughout modern history, have sought to secure for themselves various rights that the coastal nations inherently have due to geographical location. The traditional demand of the inland countries has been that of unrestrained access to the sea, but now, with the significant strides that oceanic sciences have made in the last two decades, their demands have spread into other areas that once held little interest to inland countries. It has become apparent in …

Underwater Search And Rescue For Non-Military Submersibles, Peter A. Joseph
Underwater Search And Rescue For Non-Military Submersibles, Peter A. Joseph
Marine Affairs Theses and Major Papers
A system of underwater search and rescue for non-military submersibles utilizing a helicopter delivered rescue submersible is proposed. In the last 10 years there has been a substantial increase in manned underwater endeavors. This expansion is expected to continue with increasingly greater emphasis in the recreational field. The necessity to overcome the relatively short iife support of the small recreation submersible dictates a rapid response. This system should be capable of providing the lift necessary to rescue the entrapped personnel by bringing the submersible to the surface. At the present time the Coast Guard must rely on other submersible operators …

Groundwater constitutes one of the major sources of water for municipalities, irrigators, and rural dwellers. Conflicts between groundwater users are bound to arise from time to time, as is evidenced by a recent Missouri case, Higday v. Nickolaus, discussed elsewhere in this issue.' Such conflicts may increase in frequency in the future as the demand for groundwater increases. Although a majority of cases will involve allocation of groundwater between users of that class of water, many groundwater diversion cases will involve adverse effects on the flow of water in streams. It is –to the latter situation that this article is …
