Constitutional Law - Freedom Of Religion - Court Ordered Medical Treatment For Infants, Joel M. Dresbold

Duquesne Law Review

The Pennsylvania Supreme Court has ruled that an' infant is not a "neglected child" under the Pennsylvania Juvenile Court Act if the parents, on religious grounds, refuse to allow the infant to have surgery requiring a blood transfusion, when the child's life is not immediately endangered by his physical condition.

Green Appeal, 448 Pa. 338, 292 A.2d 387 (1972).

Attachment In California: Senate Bill 1048, The Interim Response To Randone, John P. Stayner Jan 1973

Attachment In California: Senate Bill 1048, The Interim Response To Randone, John P. Stayner

McGeorge Law Review

In 1971, California's long-standing prejudgment attachment procedures were held unconstitutional. The basis of this decision was that these remedies denied the debtor procedural due process by failing to provide him with notice of the attachment or an opportunity to contest it. The California Supreme Court also made it clear that the fact that attachment remedies reached necessities of life-without a hearing on the validity of the creditors claim was an additional ground for holding it unconstitutional. The Legislature responded to the court's criticisms by enacting a revised attachment procedure. This comment analyzes the court's opinion and tests the constitutionality of …

Overruling Roe V. Wade: An Analysis Of The Proposed Constitutional Amendments, Charles E. Rice

Journal Articles

It is not my purpose here to criticize the abortion decisions in detail. Professor Robert M. Byrn has exposed the many specific errors and evasions found in the majority opinions in those cases. As Professor Byrn demonstrates, the Supreme Court's opinions in Wade and Bolton are an intellectual shambles. I will not try to cover the same detailed ground that Professor Byrn did. Rather, after examining the medical evidence which establishes that the unborn child is a human being from the moment of conception, this article will evaluate the propriety of excluding this class of human beings from the protections …

The Constitutional Dilemma Of A Person Predisposed To Criminal Behavior, John A. Chandler, Stanley F. Rose Jan 1973

The Constitutional Dilemma Of A Person Predisposed To Criminal Behavior, John A. Chandler, Stanley F. Rose

Vanderbilt Law Review

The basic premise of American criminal jurisprudence is that individuals are capable of controlling their behavior.' The threat of incarceration is intended to be a deterrent to antisocial conduct. State and federal penal systems are called "correctional institutions"--implying that a person is incarcerated in order to modify unacceptable behavior. Criminal laws are drafted with goals of discouraging antisocial conduct, punishing and reforming the guilty, and protecting society against dangerous individuals. The first two purposes are served only if a person can respond to negative reinforcement by conducting himself in socially acceptable ways. Individuals incapable of controlling antisocial behavior are not accounted …

An Examination Of Legislation For The Protection Of The Wetlands Of The Atlantic And Gulf Coast States, Anthony J. Haueisen

Gulf and Caribbean Research

The most useful aquatic areas in the world are in serious danger of destruction. The estuaries, where fresh water, land and sea meet in a dynamic and highly productive zone, are today gravely threatened through unwise and unplanned excessive use of their valuable but finite capacities. Estuaries include the coastal zone which is affected by both the run-off of fresh water from the land and the salt water from the sea. This zone includes tidal rivers, marshes, bays and river mouths. The value of these estuarine regions has been well established by biologists. However, this value is fully appreciated by …

Notes And Comments: Third Party Beneficiaries Of Warranties In Maryland, Allen J. Katz

University of Baltimore Law Review

The Maryland Legislature in 1969 provided for increased consumer protection for third party beneficiaries of warranties. This comment explores the effectiveness of that legislation and concludes that it is sufficient if the courts apply it liberally. If the courts cannot use the present law effectively, suggested legislative alternatives are presented.
