Strip Mining And The 1971 West Virginia Surface Mining And Reclamation Act, Vincent P. Cardi
Strip Mining And The 1971 West Virginia Surface Mining And Reclamation Act, Vincent P. Cardi
West Virginia Law Review
This article will cover to a limited extent the vocabulary and physical process of strip mining, and its cost to society and to people individually through direct damage to people, property, and the public environment. But the main purpose of this article is to, (1) explain the basic approach of the 1971 Surface Mining and Reclamation Act passed by the West Virginia Legislature, (2) identify the legal questions raised by the Act, and (3) suggest interpretations and applications of the Code language that would answer some of these questions. This article will not discuss several major questions arising under the …

Beyond The Eye Of The Beholder: Aesthetics And Objectivity, Michigan Law Review
Beyond The Eye Of The Beholder: Aesthetics And Objectivity, Michigan Law Review
Michigan Law Review
The term "aesthetic legislation," as used in this Note, refers only to legislation that bears upon the visual character of the physical environment, rather than to legislation on problems of noise and odor. The legal system has handled problems of the latter sort much better; only the sense of sight has been left unprotected. Perhaps one reason for its neglect is that in order to make an area visually pleasing positive programs, such as zoning, must be used, as well as passive prohibitions of such noxious uses as billboards. Noise and odor problems, which can be resolved by prohibitions alone, …
Environmentally Sensitive Land Use Regulation In California, John M. Winters
Environmentally Sensitive Land Use Regulation In California, John M. Winters
San Diego Law Review
At the Federal and State levels, the National Environmental Policy Act and the California Environmental Quality Act, respectively, require certain procedures before a government takes actions that significantly affect environmental quality. This Article states the case for an environmentally sensitive package involving the National Environmental Policy Act to the California Environmental Quality Act, through Assembly Bill 1301 and the Coastal Zone Initiative, with an eye toward Just v. Marinette County, to permit a review of land use decisions and provide a clear understanding of the limits of environmental protection in California. Because the resulting package involves the National Environmental Policy …

Income Tax "Loopholes" And Political Rhetoric, Boris I. Bittker
Income Tax "Loopholes" And Political Rhetoric, Boris I. Bittker
Michigan Law Review
When used by newspaper reporters and politicians, the term "tax loophole" is always a pejorative, though the tone of disapproval may be mingled with a dash of admiration for the astute lawyer or accountant who discovered the device. Since condemnation is the predominant tone, it is always assumed that loopholes can be quickly and reliably distinguished from tax provisions that are reasonable and fair. Sometimes, to be sure, it is suggested that the only criterion is self-interest: one man's loophole is another man's relief provision. More frequently, loopholes are said to inure primarily, if not solely, to the benefit of …

Recent Developments In The Law Of The Sea Iv: A Synopsis, G. D. Greenblatt, J. R. Miller, A. J. Waldchen
San Diego Law Review
This Article presents an annual synopsis of important events pertaining to the law of the sea which occurred between February 1, 1972, and January 31, 1973. Our major sources of information included the New York Times, the Environmental Reporter, the United States Code Congressional and Administrative News, the Congressional Record, the United Nations Chronicle, and International Legal Materials. It is our hope that the search through a seemingly endless array of indices, newspapers, microfilms, and dusty shelves will prove to be of value. We regret that the synopsis must once again report more problems than solutions, but it is with …
Literature And Law: How The Literary Quality Of A Political Statement Has Affected The Development Of Law In Tanzania, Robert L. Scott
Literature And Law: How The Literary Quality Of A Political Statement Has Affected The Development Of Law In Tanzania, Robert L. Scott
IUSTITIA
The purpose of this inquiry is to demonstrate how the literary qualities of a political statement have contributed to the legal and economic development of an African nation.
It is my contention that a literary statement* is a useful tool in representing the process of events in a manner which reproduces the quality and character of the underlying reality. This more accurate reality is derived from the perspective of the artist who writes out of an experience common to his people, even though his expression is essentially a personal one: he writes according to his own sensibilities and is not …

The Closing Circle: A Review Of Barry Commoner's Book, Robert L. Scott
IUSTITIA
Commoner's book provides an opportunity to review the problems of pollution and their causes in the social, political, and economic fabric of our society. This review also provides an opportunity to compare and contrast natural and social laws. From this examination of the problem of pollution and the interface between natural and social law emerge certain ideological concerns confronting Americans as a people.

Land Use Controls In Coastal Areas, Richard C. Ausness
Law Faculty Scholarly Articles
Prolonged exploitation of coastal resources has caused extensive ecological harm. The alarming decline in the condition of the marine environment has become a matter of serious public concern. This Article will examine some of the environmental problems of the coastal zone and the resulting institutional responses. The first part will delineate a number of problems in the nation's coastal areas. The second part will review the doctrines of property law associated with the ownership of littoral land and their relation to land-use control measures. The third part will evaluate recent coastal management legislation. The fourth part will consider constitutional restraints …
