Venezuela's Contribution To The Contemporary Law Of The Sea, Kaldone G. Nweihed
Venezuela's Contribution To The Contemporary Law Of The Sea, Kaldone G. Nweihed
San Diego Law Review
Two discernible instances, separated by a generation and thirty years, affirm Venezuela's major contributions to a long and patient universal legislative process in which custom and convention have alternated with one another to consolidate and emerging public order of the sea: surface, waters, bottom and subsoil. Two main issues, therefore, will be briefly dealt with in this Article. The first concerns the earliest treaty ever concluded between two States to delimit, explore and exploit a submerged area, namely, the Anglo-Venezuelan Gulf of Paria Treaty of 1942; the second brings to a focus the Venezuelan concept of the patrimonial sea, a …

Recent Developments In The Law Of The Sea V: A Synopsis, Dennis Greenwald, Robert Iglow, Jack Mann
San Diego Law Review
Each year, as part of the San Diego Law Review's symposium on law of the sea, a student article is dedicated to a synopsis of recent events in the field. The function of such as article is to provide the reader with a broadly circumscribed report of recent developments presented under the topic headings of conservation, fishing, pollution, seabed resources, shipping and sovereignty. This year's compendium covers the period between January 1, 1973 and December 31, 1973. A myriad of sources are represented including the United States Code Congressional and Administrative News, the Environmental Reporter, International Legal Materials, the United …
International Law And Radioactive Pollution By Ocean Dumping: "With All Their Genius And With All Their Skill…", Jack William Hodges
International Law And Radioactive Pollution By Ocean Dumping: "With All Their Genius And With All Their Skill…", Jack William Hodges
San Diego Law Review
What are the theories of existing and, if necessary, developing environmental international law of the sea under which these non-signatory nations can be prevented from future radioactive dumping? What international legal controls, outside the Convention, can signatory states avail themselves of to prevent the oceans of the world from becoming dangerously contaminated? These questions provide not only an interesting topic for comment, they represent vital and difficult issues for our future environment and survival. Not only is the introduction of radioactive wastes into the marine environment potentially the most dangerous of all marine pollution, the concomitant task of articulating controlling …

Sexism In Special Education, Patricia H. Gillespie, Albert H. Fink
Sexism In Special Education, Patricia H. Gillespie, Albert H. Fink
IUSTITIA
The educational establishment is now reflecting the concerns of womanhood. Grudgingly, and even painfully, it seems to some, the large and complicated system of formal education acknowledges the existence of practices which are sexist both in conception and operation. At one level this sexism is directed, at many levels of awareness, toward the functionaries of the system. The economic oppression of teachers, who are mostly female, is an obvious expression of the phenomenon. Another benchmark is the limited career development opportunities available to women as educational managers and academics.
At yet another level, not the less dangerous for being more …
Feminism And The Legalization Of Prostitution: How Far Down The River?, Marilyn C. Zilli
Feminism And The Legalization Of Prostitution: How Far Down The River?, Marilyn C. Zilli
IUSTITIA
One of the most telling issues on the state of the women's movement today is that of the legalization of prostitution. It would be inappropriate to say that the issue has caused a breach in the ranks: the term is inapplicable to a movement which has never claimed coherency and which has, in fact, consistently demonstrated an inability to reconcile the views of its various factions. The prostitution issue is important, rather, precisely because it underscores these differences of analysis and tactics which have appeared in other areas and the splits between white middle class liberal women, radical feminists, marxist …
Present Status Of Women In Professional Athletics, Debra Gaber
Present Status Of Women In Professional Athletics, Debra Gaber
IUSTITIA
The life of a female professional athlete in many ways seems undesirable. Attitudinal pressures and societal demands coupled with the rigors of competitive sport make a female pro's life draining, if not oppressive. On the outside there may appear a gleam of happiness as a photographer catches a pro in action during her moment of glory. Magazine articles assume by inference that being "number one" is glamorous and highly desirable. It does mark a tremendous achievement in an athlete's life, but for a female athlete, "getting there" is almost a nightmare. No female professional is without some battle scars.

The Fairness Doctrine And Pro-Natalism In Television, Myra Spicker
The Fairness Doctrine And Pro-Natalism In Television, Myra Spicker
IUSTITIA
It is a premise of this paper that television reflects a pro-natalist bias in its promotion of the traditional female role in society, and that such bias is evident in both commercial advertisements as well as in dramatic presentations particularly on daytime television. Those who are opposed to a pro-natalist point of view will find it virtually impossible to air their opposition effectively. At best anti-natalist groups may be able to garner only meager financial resources to air spot commercials, but this is hardly adequate to combat the subtle onslaught of the opposition. Suggestions have been made that pro-natalist attitudes …

Development Of The Rio Grande Compact, Raymond A. Hill
Development Of The Rio Grande Compact, Raymond A. Hill
Publications
Thirty-six years have elapsed since the Rio Grande Compact of 1938, N.M.S.A. Section 75-34-3 (Repl. 1968), was entered into by Colorado, New Mexico, and Texas, and approved by the United States of America. Administration of the Compact since then has been the responsibility of many different persons, few of whom had personal knowledge of the circumstances of the negotiation of this Compact. Consequently, there has been a growing tendency towards interpretation of some of the provisions of the Rio Grande Compact in a manner contrary to the intent of those who participated in its negotiation.
Mr. Hill has intimately connected …

Approaches To The Regulation Of Franchises, Founder-Member Contracts, And Referral Sales Agreements Student Symposium - Interpreting The Statutory Definition Of A Security: Some Pragmatic Considerations., Patrick K. Sheehan
St. Mary's Law Journal
Franchises, founder-member contracts, and referral-sales agreements are marketing practices used to expand retail businesses and typically categorized as investment contracts. These marketing schemes continue to leave investors susceptible to fraud and misrepresentation because security regulations may fail to adapt to continuously varying methods in which promoters acquire capital. The Securities Act of 1933, the Securities Exchange Commission of 1934, and the Blue Sky Laws were attempts to regulate marketing schemes by establishing purposefully broad definitions of investment contracts. Securities laws were meant to have a liberal application for the purpose of being flexible and adaptive. In 1946, the landmark case …
The Monkey Laws And The Public Schools: A Second Consumption?, Frederic S. Le Clercq
The Monkey Laws And The Public Schools: A Second Consumption?, Frederic S. Le Clercq
Vanderbilt Law Review
Recent events suggest that the creationist movement is both potent and truly national. in scope. In California, the science curriculum guidelines for public schools were modified by a sympathetic state board of education to accommodate the creationist position.' Science textbooks for use in the public schools of California are being edited to dilute passages on evolution, and creationists almost achieved express recognition of their beliefs in the science texts. In Tennessee, a law has been passed that requires inclusion of the Biblical account of creation in biology textbooks used in the public schools." Similar legislation to require treatment of creationist …
