Acquittal Of The Guilty, Alec Samuels
Acquittal Of The Guilty, Alec Samuels
Dalhousie Law Journal
Every acquittal is an injustice. Either a guilty man has escaped conviction, or an innocent man has been subjected to false accusation, with all the accompanying worry, anxiety, publicity, humiliation, perhaps detention, probably expense. Some of the difficulties undoubtedly spring from the adversary system, a system evolved in the eighteenth and nineteenth centuries to meet the then contemporary problems. It is a system with certain inherent inefficiencies and ineffectivenesses, a system designed to ascertain whether the prosecution has proved an allegation against D the defendant beyond all reasonable doubt and not designed to ascertain the truth of the incident in …

Federal Regulations Pertaining To Collection, Import, Export, And Transport Of Scientific Specimens Of Mammals, Hugh H. Genoways, Jerry R. Choate

These regulations were necessary largely because of the activities of non-scientists, but their provisions have had a tremendous impact on the activities of scientists (especially museum-based systematists and ecologists). "Solicitation" And "Delivery" Under Public Law 86-272: An Uncharted Course, Paul J. Hartman
Vanderbilt Law Review
In 1959, in response to pressure from multistate business and over the protest of state tax authorities and others, Congress passed Public Law 86-272 limiting the power of state and local governments to tax net income derived from interstate commerce.' The provisions of Public Law 86-272, briefly stated, prohibit state or local governments from imposing net income taxes on sellers of tangible personal property whose business activities in the state are limited to one or more of the following:. solicitation of orders for sales of tangible personal property by the seller or his own representative when the orders are sent …

Paul J. Hartman And The Vanderbilt Law Alumni, Wilson Sims
Vanderbilt Law Review
One of the greatest assets of the Vanderbilt Law School is Professor Hartman's obvious love and appreciation for the School. When the Dutchman gets serious, this comes across in a powerful way. His unending effort on behalf of the Law School in working with the alumni over these many years has resulted in numerous tangible benefits for the Law School, but even more importantly, in many intangible ways, including the great sense of loyalty held by many of these alumni, all of them the Dutchman's former students. The School has no better salesman. He and his wife Dorothy command the …

California "Consenting Adults" Law: The Sex Act In Perspective, Mary Lee Tayrien
San Diego Law Review
The viability of the contrary arguments on decriminalization of specific sexual behavior must now be considered in light of the enactment of a "consenting adults" law in California. A few of the potential and diverse ramifications of this legislation are the subject of this Article.
