Legal Institutions For The Allocation Of Water And Their Impact On Coal Conversion Operations In Kentucky, Richard C. Ausness, Gary W. Callahan, Steven W. Dills, Bill H. Flynn, John S. Gillig Aug 1976

Legal Institutions For The Allocation Of Water And Their Impact On Coal Conversion Operations In Kentucky, Richard C. Ausness, Gary W. Callahan, Steven W. Dills, Bill H. Flynn, John S. Gillig

KWRRI Research Reports

The conversion of coal into other types of fuel through gasification and liquefaction has been proposed as a means of coping with America's increasing energy needs. Coal conversion plants require large quantities of water for cooling purposes and for use as a raw material.

There are three types of water allocation presently used in the United States, riparianism, prior appropriation, and administrative permit systems. The common law riparian system is undesirable because under it water rights are insecure and subject to locational use restrictions. Prior appropriation is better, but the permanent water right created under this system results in excessive …

A Rebuttal To The Attack On The Indeterminate Sentence, Sue Titus Reid Jul 1976

A Rebuttal To The Attack On The Indeterminate Sentence, Sue Titus Reid

Washington Law Review

As the preceding sentence indicates, the indeterminate sentence has recently come under attack. Although criticisms that should be considered seriously can be directed at the indeterminate sentence, the time for its abolition has not yet arrived. This article will discuss the history and treatment philosophy underlying the indeterminate sentence, but will not consider all the objections to the indeterminate sentence. Rather, the focus will be on the philosophical and practical problems of implementing the treatment philosophy. It will conclude that the system itself should not be viewed as solely responsible for its shortcomings because abuses of the system, as well …

Punitive Damages In Products Liability Litigation, David G. Owen

Michigan Law Review

The functions of punitive damages and their applicability in the products liability context will then be examined, with particular consideration given to the three complicating factors raised by Judge Friendly in Roginsky. In the following section attention will focus on the various contexts in which manufacturer misconduct has arisen in the reported decisions and a number of unreported cases that have involved this issue. Finally, guidelines will be developed from these cases for determining the appropriateness of punitive damages awards …

U.S.-Soviet Trade: Problems And Prospects, S. Osofsky May 1976

U.S.-Soviet Trade: Problems And Prospects, S. Osofsky

Mercer Law Review

Before the Second World War, U.S. trade with the Soviet Union involved the U.S. export of machinery and equipment, and the import of minerals and animal products. Imports were normally one-fourth or one third of the volume of exports. U.S. exports peaked in 1930 and 1931 with exports of $114 million and $104 million. U.S. exports to the Soviet Union never represented more than 2% of total U.S. exports, whereas Soviet imports from the United States at times constituted some 25% of total imports. With political recognition in 1933 came hopes of a dramatic upsurge in trade, but the failure …

Acquittal Of The Guilty, Alec Samuels May 1976

Acquittal Of The Guilty, Alec Samuels

Dalhousie Law Journal

Every acquittal is an injustice. Either a guilty man has escaped conviction, or an innocent man has been subjected to false accusation, with all the accompanying worry, anxiety, publicity, humiliation, perhaps detention, probably expense. Some of the difficulties undoubtedly spring from the adversary system, a system evolved in the eighteenth and nineteenth centuries to meet the then contemporary problems. It is a system with certain inherent inefficiencies and ineffectivenesses, a system designed to ascertain whether the prosecution has proved an allegation against D the defendant beyond all reasonable doubt and not designed to ascertain the truth of the incident in …
