Daubert V. Merrell Dow Pharmaceuticals, Inc.: Epistemiology And Legal Process, Margaret G. Farrell Apr 1994

Daubert V. Merrell Dow Pharmaceuticals, Inc.: Epistemiology And Legal Process, Margaret G. Farrell

Cardozo Law Review

Justice Blackmun's majority opinion in Daubert v. Merrell Dow Pharmaceuticals, Inc. acknowledges that law and science have different goals, but it fails to recognize the implications of those differences for legal process. Recent increases in the scientifically-based claims brought in the federal courts, and in the size and complexity of the litigation in which such claims are made, have raised the stakes in the debate. At the same time, scientific concepts of relativity, uncertainty, and multiple causation are at odds with simple, legal notions about fact-finding and cause and effect. This disparity between legal and scientific understandings over the admission …

Aristotle On Good And Bad Actualities, Owen Goldin Apr 1994

Aristotle On Good And Bad Actualities, Owen Goldin

The Society for Ancient Greek Philosophy Newsletter

This paper is a discussion of one of the more neglected passages in the central books of Aristotle's Metaphysics, Θ 9 105la4~19. In this passage Aristotle makes some assertions concerning relations that hold among potentialities and actualities, both good and bad. These assertions seem to be made as an afterthought, and their relation to the analysis of potentiality and actuality that precedes is unclear. I shall argue that in this passage Aristotle is in effect providing a metaphysical foundation for the normative component of a teleological analysis of composite substance. I consider certain difficulties in reconciling the text with the …

Winona Campus Life

Winona Campus Life was a weekly laboratory newspaper produced by the WSU Mass Communciation Department students and printed as a supplement to the Sunday Winona Daily News, which began in September 1983. The newspaper provided coverage of the four institutions of higher education in Winona: Winona State University, St. Mary's University, College of Saint Teresa, and Winona Area Vocational-Technical School. George Eliot- Bbc2 Night School, Ruth Harris Mar 1994

George Eliot- Bbc2 Night School, Ruth Harris

The George Eliot Review Online, ISSN: 2831-5375

It is said that Napoleon interviewed his prisoners at three o'clock in the morning when their powers of resistance were at their lowest ebb. My video recorder saved me from testing his theory between the unearthly hours of 2.00 and 4.00 a.m. on Thursday 10th March when BBC2's Night School presented its resource material on the life, work and times of George Eliot. If I had had to stay awake, however, then I think that Professor Rosemary Ashton and her able colleagues would have overcome my powers of resistance with Napoleonic skill. The material was attractively varied, and concentration was …

Archeological And Geomorphological Investigations At Prehistoric Sites 41wy50 And 41wy60, Willacy County, Texas, Karl W. Kibler

Index of Texas Archaeology: Open Access Gray Literature from the Lone Star State

In January through March 1993, archeological and geomorphological investigations were conducted at two clay dune sites, 41WY50 and 41WY60, in the outfall area of the Hidalgo-Willacy Drainage Ditch system. This work represents the final investigations of a cultural resource management program conducted for the U.S. Army Corps of Engineers and the local sponsors, Hidalgo County Drainage District No. 1 and Willacy County Drainage District No. I, by Prewitt and Associates, Inc. The results of the archeological investigations were poor. Neither site yielded materials of unquestionable cultural origin, although several small basin-shaped hearth features were encountered. Based on radiocarbon assays from …

Anna De Noailles Oui Et Non: The Countess, The Critics, And La Poésie Féminine, Tama L. Engelking

World Languages, Literatures, and Cultures Faculty Publications

Jean Cocteau pays tribute to his idol, the poet Anna de Noailles, in the 'La Comtesse de Noailles Oui Et Non.' Anna de Noailles is one of the most popular and widely admired among the 20th-century poets because of her unique talent and controversial topics. Her sensual lyricsm has received the criticism of many writers. Likewise, it has also been admired by great critics, such as Proust, Colette and Maurice Barres.
