The Troubled Intersection Of The Interests Of Christ And Commerce : Appellate-Court Review Of Virginia Sunday Closing Laws In Historical Overview Through 1942, William Robert Vanderkloot Jan 2005

The Troubled Intersection Of The Interests Of Christ And Commerce : Appellate-Court Review Of Virginia Sunday Closing Laws In Historical Overview Through 1942, William Robert Vanderkloot

Master's Theses

Virginia's Supreme Court of Appeals, between 1900 and the conclusion of this thesis in 1942, consistently narrowed Virginia's Sunday closing law, enacted in 1786 to prevent Sunday labor. While paying lip service to the statute's purpose, the court almost unhesitatingly chose statutory interpretations encouraging more Sunday labor, particularly by expanding its ''necessity" and "charity" exceptions. The legislature also granted additional statutory closing law exceptions. This reflected the preferences of the public as well, which increasingly depended on the services of others laboring on Sunday. These results were also due, in part, to inherent confusions and contradictions in the law itself, …

Spirits Of Defiance: National Prohibition And Jazz Age Literature, 1920-1933, Kathleen Morgan Drowne Jan 2005

Spirits Of Defiance: National Prohibition And Jazz Age Literature, 1920-1933, Kathleen Morgan Drowne

English and Technical Communication Faculty Research & Creative Works

National Prohibition (1920-1933) ranks as one of the most divisive political controversies of the twentieth century, and its reverberations echoed through nearly every facet of American popular culture. Not surprisingly, many novelists and short story writers added their voices to this contentious public debate by incorporating into their works their interpretations of the wildly controversial federal liquor laws. In Spirits of Defiance, the first book to examine how American writers responded to the far-reaching effects of the Eighteenth Amendment, Kathleen Drowne analyzes the literary portrayals of bootleggers, moonshiners, revenuers, speakeasies, cabarets, and other specifically Prohibition-era characters and settings in a …

The Heavenly Sanctuary/Temple Motif In The Hebrew Bible : Function And Relationship To The Earthly Counterparts, Elias Brasil De Souza Jan 2005

The Heavenly Sanctuary/Temple Motif In The Hebrew Bible : Function And Relationship To The Earthly Counterparts, Elias Brasil De Souza

Dissertations

The present dissertation investigates the function of the heavenly sanctuary/temple and its relationship to the earthly counterparts, as reflected in forty-three passages of Hebrew Bible.

Following an introductory chapter, the second chapter of this dissertation is devoted to a survey of the heavenly sanctuary/temple motif in the ANE literature, as represented by Sumerian, Akkadian, Hittite, Ugaritic, and Egyptian texts. The investigation of these texts reveals that the heavenly sanctuary/temple motif was part of the worldview of the ANE, where the heavenly sanctuary was not only assumed as existing in heaven, but also as functioning in close relationship to the earthly …

The Faux Pas Of A Vert Galant: The Historiography Of Henry Iv's Military Leadership, Annette Finley-Croswhite Jan 2005

The Faux Pas Of A Vert Galant: The Historiography Of Henry Iv's Military Leadership, Annette Finley-Croswhite

History Faculty Publications

Even though many modern historians agree that Henry IV was less than a brilliant military commander, a small but growing body of revisionist historians believe that his reputation deserves to be reassessed. While acknowledging his military innovations and battlefield successes, his critics see him primarily as an opportunist with a reckless streak who failed time and again to take full advantage of his victories. The revisionist school, however, believes that these interpretations are based on an inaccurate assessment of early modern warfare and its unique political, religious, and social components. Henry's modern defenders further note that his reputation has suffered …

Rüdiger Kinsky (Ed.), Diorthoseis. Beiträge Zur Geschichte Des Hellenismus Und Zum Nachleben Alexanders Des Grossen. Bza, 183 (Book Review), Walter Stevenson

Classical Studies Faculty Publications

This volume presents five elaborations on lectures given at a seminar for Gerhard Wirth's 75th birthday (December, 2001). Kinsky explains in his terse introduction that the papers are dedicated to revising standard views of Alexander's reception and the history of Hellenism. In this spirit, the title "Diorthoseis" refers to a continuous process of reconstructing ancient history and periodically revising these reconstructions by reassessing all evidence. The breadth of this description fits the essays, but whatever is lost in focus is made up for in clearly formulated issues and engaging syntheses.

Defining Modernity: Mentality And Ideology Under The French Second Empire, Gavin Murray-Miller Jan 2005

Defining Modernity: Mentality And Ideology Under The French Second Empire, Gavin Murray-Miller

LSU Master's Theses

This study intends to examine the relationship between popular conceptions of modernity and Republican ideology during the Second Empire, 1852-1870. With the advent of the industrial revolution in France, scientific knowledge came to be equated with notions of progress and innovation, leading intellectual elites to design philosophical and social systems predicated upon the authority of scientific analysis and objectivity. Influenced by the intellectual currents under the Second Empire, a new generation of Republican political theorists incorporated notions of science into their ideological outlook, ultimately engendering a moderate brand of Republicanism which played a significant role in the founding of the …

Problems Of Modernization In Late Imperial Russia: Maksim M. Kovalevskii On Social And Economic Reform, Evgeny Badredinov

LSU Doctoral Dissertations

The problems of social and economic reform were at the center of academic and political activities of Maksim M. Kovalevskii (1851-1916), a prominent Russian historian and sociologist. The comparative study of rural communal institutions led him to conclude that the village commune remained a viable social and economic institution in late imperial Russia. Although he believed firmly in private agriculture, he criticized the Stolypin land reform for attempting to pressure peasants to separate from communes. Kovalevskii argued that in a country dominated by communal traditions the state must not destroy the collective economy by legislative fiat. He urged Russian policy-makers …

Recent New Testament scholarship has illuminated the patron-client relationships implicitly described in the epistle to the Hebrews. Utilizing this scholarship, this article explores the patron-client relationships illustrated in the epistle to the Hebrews seeking biblical principles to guide missionary life and practice.

Two Liberals On Religion: Constant And Tocqueville Compared, Helena Rosenblatt Jan 2005

Two Liberals On Religion: Constant And Tocqueville Compared, Helena Rosenblatt

Publications and Research

As founding fathers of modern liberalism, Benjamin Constant and Alexis de Tocqueville shared a common sensibility as well as a number of key concerns. Of central importance to both men was the need to protect individual rights and freedoms against what they saw as an encroaching social power. Having learned the lessons of the French Revolution, they knew that power, whether concentrated in the hands of one man, or executed in the name of the "people", was a dangerous thing. Thus they worked throughout their lives to establish and defend a representative system with constitutional guarantees that would protect fundamental …

The Colonial Dynamic: The Xhosa Cattle Killing And The American Indian Ghost Dance, Aaron Mcarthur Jan 2005

The Colonial Dynamic: The Xhosa Cattle Killing And The American Indian Ghost Dance, Aaron Mcarthur

Psi Sigma Siren

In 1856, a fourteen year old girl named Nongqawuse (non-see) had a vision on the banks of the Gxarha River in southern Africa. Entranced, she saw dearly departed ancestors, their cattle hiding in the rushes, and she heard other cattle underground waiting to come forth. She was told that if her people would but kill all their cattle, their ancestors would arise from the dead, the cattle lowing in the subterranean passages would come forth, and all the whites would be swept into the sea. Nongqawuse’s prophecy provoked the colonially embittered Xhosa (cōe-săh) people to rise up and kill their …

The Promises And Pitfalls Of Reminiscences As Historical Documents: A Case In Point, Daniel W. Stowell

Documentary Editing: Journal of the Association for Documentary Editing (1979–2011)

How did Abraham Lincoln get an acquittal for his client Duff Armstrong, on trial for his life in a murder case in 1858? His co-counsel and a prosecution attorney remembered that it was Lincoln's eloquent closing argument that recounted how the accused's parents had been kind to Lincoln when he was a young man, alone and without friends. Another co-counsel was certain that Lincoln's carefully worded jury instructions paved the way for Armstrong's acquittal. The judge recalled that it was a doctor's expert testimony that a blow to the back of the victim's head by someone other than Armstrong was …

Searching For The Transatlantic Freedom: The Art Of Valerie Maynard, Karen Berisford Getty Jan 2005

Searching For The Transatlantic Freedom: The Art Of Valerie Maynard, Karen Berisford Getty

Theses and Dissertations

This thesis focuses on an African-American female artist, Valerie Maynard, examining how she synthesizes African and American elements in her works. It provides detailed formal and iconographical analyses, revealing concealed meanings and paying special attention to those works with which the artist mirrors the Black experience in the United States and Africa on the other side of the Atlantic. In the process, the thesis sheds new light on the significance of Valerie Maynard's work and how she has used some of them to embody the Black quest for freedom and social justice during the Civil Rights struggle of the 1960s …

Jesus of Nazareth has been the center of significant media attention in recent years. Even before Mel Gibson's "The Passion of the Christ," Jesus had been the focus of featu re articles in Time, Newsweek, and U.S. News and World Report. Jesus was also the subject of television documentaries by PBS, A&E, T LC, the History Channel, the Discovery Channel and even a fu ll length prime time special by ABC News. Most presentations focus on Jesus as a man of history. In fact, the last 20 yea rs have been part of what scholars are now calling the "Third …

Inducing Knowledge By Enduring Experience: The Function Of A Postmodern Pragmatic Aesthetic In Linda Montano's "Living Art"., Alisa Anne Brandenburg

Electronic Theses and Dissertations

In Has Modernism Failed? (1984), Suzi Gablik calls for a postmodern art that has preserved the values that modernism lost over the 20th century, stating that only through "direct knowing" may we be shocked out of art-for-art's-sake. In Art As Experience (1934), John Dewey similarly proposes that "thinking is a kind of doing," recommending an instrumental art in one's drive to better him/herself.

Contemporary artist Linda Montano challenges the status quo by exploring the nature of art beyond its material value. In her Living Art performances (1970-1986), Montano creates a postmodern pragmatic aesthetic that is conducive to the unique …

African Americans In Pwls: A Post-Caste Conundrum , Richard Sigwalt Nov 2004

African Americans In Pwls: A Post-Caste Conundrum , Richard Sigwalt

Different Perspectives on Majority Rules: 9th Annual Conference (2004)

This paper proceeds from a historical study in progress of caste in the United States. That study will argue that the distinctive feature of slavery in the United States was that --unlike in Brazil or the Caribbean -servitude in the Anglophone mainland developed a caste ideal, ideologized as "race ". As with dalits in India, people identified as "black" in what became the United States an excluded hereditary caste destined ascriptively to the meanest labor, and excluded systematically and ideologically from the dominant ("white”) group. Slavery ended in the 1830s in most of the North, but because caste and slavery …

Valorizing Racial Boundaries: Hegemony And Conflict In The Racialization Of Filipino Migrant Labour In The United States, Richard Baldoz Nov 2004

Valorizing Racial Boundaries: Hegemony And Conflict In The Racialization Of Filipino Migrant Labour In The United States, Richard Baldoz

Faculty & Staff Scholarship

This article examines the role of the “racial state” in delimiting the socio-economic mobility of Filipino immigrants in the United States during the first half of the twentieth century. I illustrate how racial statecraft was deployed to restrict the access of Filipino immigrants to citizenship, family formation and land ownership through exclusionary racial criteria. I argue that the state instituted ascribed racial categories as the principal means of differentiating the civic status and social resources available to racialized collectivities. Filipino immigrants in the United States offer an interesting case study because of their status as colonial subjects of the United …

Spirituality In Limbo: An Observation And Analysis Of Mongolia’S Modern Religious Climate, Dustin Saldarriaga

Independent Study Project (ISP) Collection

This paper is essentially a history of religion in Mongolia with the purpose of illuminating the present state of religion at a socially, culturally, and politically unique point in Mongolia’s history. It has only been fourteen years since Mongolia experienced a political transition from totalitarianism to democracy, and the country now finds itself in a kind of “Limbo” with respect to not only the political state of the nation, but also the spiritual state of its individuals. The result is a religious climate filled with uncertainty and speculation, but also with passion and love. I attempt to explore this current …
