Given the ongoing work on a multilateral restructuring process for sovereign debt in the UN, consideration of the content and implementation of a sovereign debt restructuring mechanism (SDRM) is timely. The framework and content of the SDRM proposed here differs from earlier proposals in several important respects. For the classification and supermajority voting of claims in the approval a restructuring plan, it would mimic the structure and operation of the model collective action clauses (Model CACs) proposed by the International Capital Markets Association. This paper examines the way in which gendered violence is carried out as a way for the formal state and the Catholic Church to negotiate power. While examples of a much larger trend, three Latin American countries are discussed in detail. The first case occurred in Nicaragua, where a 9-year-old victim of rape was denied an abortion by both the state and the Church. The second case examined is the use of rape as a torture tactic by the military junta in Argentina during the Dirty War from 1976 to 1983. The final case examined is that of the forced …

Major historical events that blatantly defy human rights are typically common knowledge and recognized by most historians. For instance, everyone knows about the Holocaust. Even smaller-scale massacres, like Tiananmen Square, are included in most history textbooks. The Dirty War of Argentina, a brutal seven-year ordeal that violated the basic human rights of thousands of people, is not usually an era discussed by history textbooks. The society of Argentina is still healing from the effects of this war, but how can they be expected to heal when history will not even acknowledge their past or their pain?
