The purpose of market definition in antitrust law is to identify a grouping of sales such that a single firm who controlled them could maintain prices for a significant time at above the competitive level. The conceptions and procedures that go into “market definition” in antitrust can be quite different from those that go into market definition in IP law. When the issue of market definition appears in IP cases, it is mainly as a query about the range over which rivalry occurs. Both climate change and technical change are uncertain. In this paper we show the importance of including both uncertainties when modeling for policy analysis. We then develop an approach for incorporating uncertainty of technical change into climate change policy analysis. We define and demonstrate a protocol for bottom-up expert assessments about prospects for technologies. We then describe a method for using such assessments to derive a probability distribution over future abatement curves, and to estimate random return functions for technological investment in different areas. The recent housing foreclosure crisis has had devastating impacts on individuals, communities, organizations and government. In response, several community development corporations (CDCs) have sought new ways to assist neighborhoods suffering from the myriad effects of high foreclosures, including neighborhood instability, increased vandalism and crime, lower property values, and economic disinvestment. This research project focuses on activities of community-based organizations that acquire and redevelop foreclosed properties to support neighborhood stabilization and revitalization. The adoption of mobile technologies for emergency management has the capacity to save lives. In Australia in February 2009, the Victorian Bushfires claimed 173 lives, the worst peace-time disaster in the nation’s history. The Australian government responded swiftly to the tragedy by going to tender for mobile applications that could be used during emergencies, such as mobile alerts and location services. These applications, which are becoming increasingly accurate with the evolution of positioning techniques, have the ability to deliver personalized information direct to the citizen during crises, complementing traditional broadcasting mediums like television and radio. Economic recovery in the Intermountain West’s major metropolitan areas edged forward in the third quarter of 2011, after idling for much of the year. Nationally, high technology and automotive-oriented metros showed the strongest signs of recovery; in the Intermountain West, manufacturing-intensive and technology-oriented metros had the strongest quarter. Employment and output grew in most metropolitan areas, and the unemployment rate fell throughout the region. At the same time, the housing market freefall came to an end—or at least paused—across most of the region, as home prices ticked upwards for the first time since the Monitor began tracking recession and recovery. …

Microbial analysis has long been used as an indicator of water quality. Since the passing of the Safe Drinking Water Act in 1974, microbial standards have been strictly set by the Environmental Protection Agency (EPA) to ensure that the public health is protected from bacterial pathogens. The bacteriological quality of water generally deteriorates as it travels from water treatment facilities through the main distribution system and into private plumbing and distribution systems. For example, Heterotrophic Plate Count (HPC) values typically increase once the water has entered plumbing devices such as beverage vending machines. This paper examines trends in potential ‘primary care’ presentations at EDs, comparing these with other ED presentations and to primary care attendances in the community.MethodsThe study draws on EDIS data (Emergency Department Information System), which at December 2005 covered 76 per cent of attendances in New South Wales, and MBS data from Medicare Australia. Annual counts of potential ‘primary care’ presentations to EDs are compared with those of other ED presentations and to primary care presentations in the community. The plaintiffs claimed the city had committed intentional discrimination or disparate treatment against them when the city disregarded the results of promotion examinations that had an adverse effect on black and Hispanic applicants. The Supreme Court sustained the claim. In his concurring opinion, Justice Scalia invited attorneys in subsequent cases to consider arguing that the disparate impact theory of employment discrimination is unconstitutional. The purpose of this critical qualitative study was to develop a theory of the competencies of a sustainability leader, grounded in research. A sustainability leader is generally described as an individual who creates profit for his/her stakeholders, while protecting the environment and improving the lives of those for whom he/she impacts as a result of his/her leadership. Nearly 60 individuals familiar with sustainability were asked to characterize an effective leader of a sustainability initiative or a sustainability organization.

[Excerpt] The U.S. Social Security system faces serious financial difficulties in both the short and the long run. The short-run problem is that the system has very meager financial reserves. In the long run—after the year 2010, when the post-World-War-II baby-boom generation reaches retirement age—the financial problems of Social Security will intensify because of population aging and the consequent decline in the ratio of workers to retirees.

In 2011, McGinnis, Kohn, and Kara reported the effects of overall logisties strategy (OLS) on logistics coordination effectiveness, customer service effectiveness, and organizational competitive responsiveness. This manuscript empirically compares the three dimensions of the Bowersox Daugherty typology to logisties strategies among U.S., Turkish, and Guatemalan companies. US, Turkish, and Guatemalan subjects (logistics managers) were chosen to test the underlying factor structure and measurement equivalences of the scales used. Using confirmatory factor analysis (CFA), findings indicate that the three dimensions of the Overall Logistics Strategy (OLS) - Process Strategy, Market Strategy, and Information Strategy - hold in all three country environments …

Numerous LTL carriers struggled during the recent recession as customers demanded lower prices. This study is designed to qualitatively evaluate the data gathered from three industry segments regarding LTL pricing. Researchers used semi-structured interviews to conduct an in-depth investigation with over two dozen industry experts who represented shippers, carriers, and 3PLs. Interview transcripts were analyzed using a grounded theory coding technique. Five major themes emerged from the interview transcripts. These themes are used to describe possible future adjustments to industry pricing structure.

The early experience of the airline industry under deregulation was very much as expected, with increased competition and new entrants offering highly competitive rates. However, there are approximately 130 airlines operating today, and the industry remains more heavily concentrated than it was prior to deregulation. This study reports on concentration in the US airline industry between 1970 and 2009, as measured by the Hcrfindahl-Hirschman Index (HHI) and Concentration Ratio, together with changes in industry costs. The results show a trend of industry-wide reduced costs per available seat mile that is negatively correlated with the increased level of industry output over …

The selection of civil society institutions (which the author refers to as strands) around which the volume is woven is interesting because it contains several novel elements in a novel combination: civil society is said to consist of philanthropy, the common good, rule of law, nonprofit and voluntary institutions, individual rights, free expression and tolerance. This book is important reading for political philosophers, doctoral students and theorists interested in the connection of civil society and philanthropy. Yet it has a number of weaknesses that are enumerated in the review.
