Since 1978, the People’s Republic of China (PRC) has long been viewed as an economic trading partner of the United States of America (US). The PRC has grown to be an economic powerhouse, and the US directly helped with that process and still benefits from it. However, during the mid-2010’s, US rhetoric began to turn sour against the PRC. The American government rhetoric toward the PRC, beginning with the Obama administration, switched. This thesis demonstrates the essential role human rights activists play in the process of transitional justice. Through an analysis of the conceptualizations of transitional justice, in which I argue we must understand the process in broader terms that include both judicial and non-judicial practices, I enter into a comparative analysis of the case studies of Argentina and Spain. I explore Argentina’s Dirty War and the wound that was subsequently created. I question how this wound came to be and how the country chose to deal with it. Is it morally defensible to single Russian president, Vladimir Putin, out as a dictator? The popular impression that he is a dictator has been used to legitimize a dangerously adversarial policy towards what a U.S. Army general described as “the only country on earth…that could “destroy the United States.” I argue that this perception is in some ways misleading, and has contributed to escalating tensions with Russia, which is both unnecessary and harmful both to Russia and the U.S.

This paper will address the illegality of Morocco’s nationalist annexation of Western Sahara and how the United States plays the accommodating role through the selling of arms, economic aid, and diplomatic support. Considered as Africa’s last colony, the Saharawi people have not experienced the basic human right to self-determination and the right for independence. These rights are continued to be withheld for the sake of Moroccan nationalism and their “rightful and ethnic” claims to the territory, disregarding the International Court of Justice (ICJ)’s advisory opinion ruling in favor of Saharawi self-determination. Early literature in the field of transitional justice was dominated by debates over the meaning of justice, with retributivists arguing for the need for criminal prosecutions following mass human rights violations and advocates of restorative justice claiming that non-prosecutorial forms of justice like truth-telling are better suited for post-conflict societies. This debate was eventually settled, at least in the field, by a belief that post-conflict societies require both criminal prosecutions and truth-telling. Despite ample literature on the topic of populism itself, much less has been written on the specific relationship between populism and human rights. First, I discuss the relationship between populist ideology and human rights in theory. I argue that populism is inconsistent with human rights accounts because of its rejection of pluralism and vilification of the ‘other.’ Second, I explore the relationship between populism as a political strategy and its impact on human rights under two Latin American regimes.
