Justice And Justification In The War On Terrorism, Emma Norman Nov 2006

Justice And Justification In The War On Terrorism, Emma Norman

Emma R. Norman

This paper offers a few preliminary reflections on some ethical implications stemming from the disconnect between the moral rhetoric and the reality of the War on Terrorism. I suggest that the Bush Administration certainly shares a large part of the responsibility for constantly attempting to justify a war that, by the standards of traditional just war theory, is almost impossible to see as just. However, I also suggest that part of the responsibility lies with a public that demands high ethical standards of its public officials, but appears to be ultimately unprepared to face the full consequences of acting ethically …

On Homo-Diplomacy, Costas M. Constantinou Oct 2006

On Homo-Diplomacy, Costas M. Constantinou

Costas M. Constantinou

This article explores alternative cultures of diplomacy that have been neglected in diplomatic studies
and global politics. It is concerned firstly with the human dimension of diplomacy, that is to say,
the interpersonal dealings of the homo sapiens, or the experimental and experiential diplomacy of
everyday life. It is concerned secondly with the spiritual and transformative potential of diplomacy,
a form of diplomacy that engages in heterology to revisit and rearticulate homology, whose mission
is not only, not just, the knowledge and control of the Other but fundamentally the knowledge of
the Self and this knowledge of the Self as …

Public Policy And Foreign Policy: Divergences, Intersections, Exchange, Howard H. Lentner Dec 2005

Public Policy And Foreign Policy: Divergences, Intersections, Exchange, Howard H. Lentner

Howard H. Lentner

Policy studies tend to be divided between domestic matters and foreign affairs. Scholars seldom employ one another’s literature, and they largely draw on different traditions within political science. This article explores the potential for cross-fertilization and calls for greater integration of these related subfields. The argument considers the case for unity, parallelism, and overlap between domestic public policy studies and foreign policy studies. It examines the reasons for the divide and surveys a variety of attempts to find solutions for the problem of intersection at the boundary between national life and the international environment. It places the dichotomy in a …

Liberal Islam And 'Islam And Human Rights': A Sceptic's View, Anthony Chase Dec 2005

Liberal Islam And 'Islam And Human Rights': A Sceptic's View, Anthony Chase

Anthony Chase

Liberal Islam has become increasingly prominent in academic discourse with its argument that Islam is the necessary foundation to human rights in the Muslim world. This article argues that this theoretical premise is misguided. Instead of whether or not the rights regime makes sense given political, economic, and social context in Muslim-majority states, in a liberal Islam paradigm the question becomes whether or not there are convincing doctrinal arguments regarding the place of human rights in Islamic law. This accepts, in essence, the need for literalist religious justifications for human rights, making an argument for rights a dispute over religious …

The Beautiful Nation: Reflections On The Aesthetics Of Hellenism, Costas M. Constantinou Dec 2005

The Beautiful Nation: Reflections On The Aesthetics Of Hellenism, Costas M. Constantinou

Costas M. Constantinou

An aesthetics of Hellenism affirming an exclusivity and localization
of the beautiful oscillates along a political axis from
domination to liberation. This article seeks to unsettle such
accounts of “the beautiful nation” so as to enable other mediations
of the real and the ideal, and thus a more open and
heterodox vision of nation and homeland.

Boyakasha, Fist To Fist: Respect And The Philosophical Link With Reciprocity In International Law And Human Rights, Donald J. Kochan Dec 2005

Boyakasha, Fist To Fist: Respect And The Philosophical Link With Reciprocity In International Law And Human Rights, Donald J. Kochan

Donald J. Kochan

From Grotius to Hobbes to Locke to an unconventional modern pop-culture manifestation in Ali G, the concept of “respect” has always been understood as important in human interaction and human agreements. The concept of mutual understanding and obligation pervades human interaction, and, for purposes of this Article, international relations. Almost all basic principles in English, United States, and other country’s laws that value human and individual rights have based, over time, the development of their laws on the philosophical principle of respect. So much of common and statutory law is designed to enforce respect for others. The principle question in …

Sovereignty And The American Courts At The Cocktail Party Of International Law: The Dangers Of Domestic Invocations Of Foreign And International Law, Donald J. Kochan Dec 2005

Sovereignty And The American Courts At The Cocktail Party Of International Law: The Dangers Of Domestic Invocations Of Foreign And International Law, Donald J. Kochan

Donald J. Kochan

With increasing frequency and heightened debate, United States courts have been citing foreign and “international” law as authority for domestic decisions. This trend is inappropriate, undemocratic, and dangerous. The trend touches on fundamental concepts of sovereignty, democracy, the judicial role, and overall issues of effective governance. There are multiple problems with the judiciary’s reliance on extraterritorial and extra-constitutional foreign or international sources to guide their decisions. Perhaps the most fundamental flaw is its interference with rule of law values. To borrow from Judge Harold Levanthal, the use of international sources in judicial decision-making might be described as “the equivalent of …

A Theoretical And Political Analysis Of The Wto Appellate Body, Shoaib A. Ghias Dec 2005

A Theoretical And Political Analysis Of The Wto Appellate Body, Shoaib A. Ghias

Shoaib A. Ghias

Economic liberalization not only requires rules goveming economic exchange (such as multilateral trade agreements), but also institutions (such as courts) goveming how rules are enforced. However, once courts are established to govem economic exchange, they tend to expand their competence to political and social policy. Political scientists have used this theoretical framework to explain the evolution of national (for example the U.S. Supreme Court) and quasi-intemational (for example the European Court of Justice) judicial institutions. In this article, I explain how this model can be extended to a truly intemational "judicial" institution, the WTO's Appellate Body. In short, the Appellate …
