Justice And Justification In The War On Terrorism, Emma Norman

This paper offers a few preliminary reflections on some ethical implications stemming from the disconnect between the moral rhetoric and the reality of the War on Terrorism. I suggest that the Bush Administration certainly shares a large part of the responsibility for constantly attempting to justify a war that, by the standards of traditional just war theory, is almost impossible to see as just. However, I also suggest that part of the responsibility lies with a public that demands high ethical standards of its public officials, but appears to be ultimately unprepared to face the full consequences of acting ethically …

Policy studies tend to be divided between domestic matters and foreign affairs. Scholars seldom employ one another’s literature, and they largely draw on different traditions within political science. This article explores the potential for cross-fertilization and calls for greater integration of these related subfields. The argument considers the case for unity, parallelism, and overlap between domestic public policy studies and foreign policy studies. It examines the reasons for the divide and surveys a variety of attempts to find solutions for the problem of intersection at the boundary between national life and the international environment. Liberal Islam has become increasingly prominent in academic discourse with its argument that Islam is the necessary foundation to human rights in the Muslim world. This article argues that this theoretical premise is misguided. Instead of whether or not the rights regime makes sense given political, economic, and social context in Muslim-majority states, in a liberal Islam paradigm the question becomes whether or not there are convincing doctrinal arguments regarding the place of human rights in Islamic law. With increasing frequency and heightened debate, United States courts have been citing foreign and “international” law as authority for domestic decisions. This trend is inappropriate, undemocratic, and dangerous. The trend touches on fundamental concepts of sovereignty, democracy, the judicial role, and overall issues of effective governance. There are multiple problems with the judiciary’s reliance on extraterritorial and extra-constitutional foreign or international sources to guide their decisions. Perhaps the most fundamental flaw is its interference with rule of law values. Economic liberalization not only requires rules goveming economic exchange (such as multilateral trade agreements), but also institutions (such as courts) goveming how rules are enforced. However, once courts are established to govem economic exchange, they tend to expand their competence to political and social policy. Political scientists have used this theoretical framework to explain the evolution of national (for example the U.S. Supreme Court) and quasi-intemational (for example the European Court of Justice) judicial institutions.
