The following study will present an examination of factors that impact levels of voting activity among American citizens from 1972 through 2004. The subject of voter turnout has been thoroughly examined by political scientists over the years, as have aspects of youth voting and the influence of education. Many of the same variables presented by scholars in recent years will be employed in this study. However, these earlier studies tend to look only at individual level variables in explaining voter turnout. The progress of Blacks in America can, in many ways, be attributed to the advancements made by gaining the right to participate in the political process. From establishing equal opportunities in housing to leveling the playing field in the workplace, the quality of life we as African-Americans enjoy today would not be possible if those before us did not fight for the right to vote. Legal Mechanization Of Corporate Social Responsibility Through Alien Tort Statute Litigation: A Response To Professor Branson With Some Supplemental Thoughts, Donald J. Kochan

This Response argues that as ATS jurisprudence “matures” or becomes more sophisticated, the legitimate limits of the law regress. The further expansion within the corporate defendant pool – attempting to pin liability on parent, great grandparent corporations and up to the top – raises the stakes and complexity of ATS litigation. The corporate social responsibility discussion raises three principal issues about how a moral corporation lives its life: how a corporation chooses its self-interest versus the interests of others, when and how it should help others if control decisions may harm the shareholder owners, and how far the corporation must …

Justice Oliver Wendell Holmes, Jr. is often credited with creating the metaphor of “the marketplace of ideas,” though he did not use the exact phrase and his argument for free speech was not based on distinctively economic reasoning. Truly economic investigations of the marketplace of ideas have progressed in step with developments and trends in the law and economics literature. These investigations have tended to be one-sided, with writers focusing primarily either on the production of ideas (for example, Posner) or their consumption (for example, behavioral law and economics), without considering in depth how producers and consumers interact. “Regulatory capture” is central to regulatory analysis yet is a troublesome concept. It is difficult to prove and sometimes seems refuted by outcomes unfavorable to powerful interests. Nevertheless, the process of bank regulation and supervision fosters a closeness between regulator and regulated that would seem to be conducive to “capture” or at least to fostering undue sympathy by regulators for the companies they oversee. The influence of very large financial institutions has also become so great that financial regulation appears to have become excessively distorted in favor of these entities and to the detriment of many other legitimate interests, including …

In the United States, rhetoric in support of the Iraq War often focuses on discourses of patriotism and supporting the troops. These discourses hold enormous sway over the American public because of the discursive legacies of the Vietnam War and the September 11, 2001 terrorist attacks. In response, members of the peace movement who are veterans, soldiers, and military families stress their military identities during activism. These individuals have organized as an important branch of the U.S. antiwar movement that challenges the pro-war framing of patriotism and troop support by strategically deploying 'oppositional identities.' The Bush Doctrine, which was installed after the 9-11 attacks on the United States under the guise of the war on terrorism, postulated a vision of the United States as the world’s unchallenged superpower and the invasion of Iraq became one of the central fronts of this war. After failing to get approval by the United Nations for the invasion, the Bush Administration’s attempt to assemble a coalition of the willing became critical to the battle for public opinion to back the war. This article addresses whether and to what extent the Obama administration should continue the Bush administration policies relating to democracy promotion. The focus of the article is on the ADVANCE Act of 2007, a legislative enactment that institutionalized democracy promotion in the State Department. After explicating the key provisions of this Act, as well as their implementation status, the article addresses key critiques leveled at democracy promotion, as well as areas where the Obama administration can expand on what has been accomplished thus far in this field. Every day we, as human beings, maneuver through a myriad of circumstances in our individual and collective life spaces. Central to our experiences is the nature, kind, and quality of our relationships. This Essay introduces the “Anti-Interference Principle” – a new term on the meaning of equality, or at least one not yet so-named in the equality lexicon – as a necessary foundation for achieving the goal of true equality. Equality has a long-standing place in the discussion of politics and jurisprudence and remains a struggle of definition today. Rather than rehash the mass of scholarship, this Essay seeks to summarize the general equality concept, and propose that the legal discourse on equality center on a requirement that governmental power must protect and respect equal treatment and opportunity, unconstrained, not equal outcomes. …
