Settlers And Immigrants In The Formation Of American Law, Aziz Rana

Aziz Rana

This paper argues that the early American republic is best understood as a constitutional experiment in “settler empire,” and that related migration policies played a central role in shaping collective identity and structures of authority. Initial colonists, along with their 19th century descendants, viewed society as grounded in an ideal of freedom that emphasized continuous popular mobilization and direct economic and political decision-making. However, many settlers believed that this ideal required Indian dispossession and the coercive use of dependent groups, most prominently slaves, in order to ensure that they themselves had access to property and did not have to engage …

This paper seeks to look at the changes in people’s socio-political incentives to corrupt given the changes in political and legal structure, analyzing it in the context of its contribution to Indonesia’s socio-economic development. Despite the common defamation of the states’ rights theories acted upon in the Nullification Crisis of 1832, there exists a great deal of historical support for the nullifiers’ positions. Nullifiers believed in a decentralized constitutional system, while nationalists believed in a centralized constitutional system. This tension between central and decentralized positions had been at issue in the American struggle for independence though the exact manner in which these problems manifested themselves was different in the two events. Why did the Tsarist Empire opt for different governance strategies in each of the territories of the Western Borderlands (here defined as Poland-Lithuania, the Baltic territories, Finland, and Hetman Ukraine)? The existing political science literature tends to reduce such a question to a distinction between direct and indirect rule, usually developing in the context of a Western European maritime empire. This literature falls short of explaining the Tsarist case and requires the addition of intervening variables concerning the role of local elites and leadership choice. Particular attention is given to two of his most neglected works, The New Leviathan and "What 'Civilization' Means." The New Leviathan in particular was written in the context of the rise of fascism and the prosecution of World War II. To support the war effort, Collingwood reconceptualized notions of civilization and linked it to a rationality of self-determination. This paper analyzes the changes in immigration policy since the terrorist attacks of September 11, 2001 in terms of how immigrants are viewed in the United States. The goal is to address the recent criminalization of immigration in that the perceptions of terrorists and immigrants have become relatively synonymous since 2001. Although deportations have decreased, immigrant detention has increased significantly. Detention centers pose threats to the basic human rights of the immigrants residing in them, as well as perpetuate the culture of fear enveloping recent immigrants, whether they are legally or illegally in the country, and native United States citizens …

Once a relatively sleepy agrarian kingdom, Cambodia has experienced some of the most horrific violence since the close of the Second World War. Between 1970 and 1999, the country was the victim of both a brutal civil war as well wider regional conflicts. The Khmer Rouge seizure of power in 1975 brought four years of forced collectivisation and mass killings that have haunted the Cambodian psyche ever since. The decade of Vietnamese occupation that followed only further exacerbated the country’s massive humanitarian problems. In this article, the relations between various colleges (with special attention to Michigan State University) and the United States Government are explored in relation to America’s effort in nation building in South Vietnam in the late 1950s.
