Youth Activism, Art And Transitional Justice: Emerging Spaces Of Memory After The Jasmine Revolution, Arnaud Kurze

This chapter explores the creation of alternative transitional justice spaces in post-conflict contexts, particularly concentrating on the role of art and the impact of social movements to address human rights abuses. Drawing from post-authoritarian Tunisia, it scrutinizes the work of contemporary youth activists and artists to deal with the past and foster sociopolitical change. Although these vanguard protesters provoked the overthrow of President Zine El Abdine Ben Ali in 2011, the power vacuum was quickly filled by old elites. The conduct and quality of investigations pursued by the Office of the Prosecutor of the International Criminal Court have come under increasing scrutiny and criticism from judges on the Court. Criticism is directed at the time and length of investigations; the quality of the evidence advanced in court; the inappropriate delegation of investigative functions, and the failure to interview witnesses in a way that is consistent with the Prosecution’s obligation to conduct investigations fairly under Article 54 of the Rome Statute. There is an ever widening gap between conflict resolution policy makers and scholars—a tragedy given practitioners’ dire need for new ideas to help resolve deadly conflicts and the growing knowledge researchers have to share. Research tends to swing like a pendulum between analytic and rigorous methods and accessible and relevant approaches. We reject this tradeoff. We believe that research can be simultaneously rigorous and relevant, and analytic and accessible. Given the devastating loss of life associated with armed conflict, the need for translating research results into policy prescriptions is especially strong in peacemaking. I have just returned from five days in the earthquake disaster zone in Sichuan province, where I was a member of the “People’s Olympic Education Promotion Team” that visited Deyang city to conduct “Youth Olympic Games Re-enactments” at six local primary and secondary schools. There I realized that for the people we encountered, The Torch is a sacred object. The primacy accorded individual civil and political rights is often touted as one of the United States' greatest achievements. However, mass incarcerations of indefinite duration have occurred consistently throughout U.S. history and have primarily targeted people of color. The dominant narrative insists that the United States is a political democracy and portrays each instance of indefinite detention in exceptionalist terms. This essay argues that the historical patterns of indefinite detention are better explained by recognizing the United States as a settler colonial state whose claimed prerogative to expand its territorial reach and contain/control populations over which it exercises jurisdiction inevitably …

On June 12, 2016, Omar Mateen killed 49 people and injured 53 at the Pulse Nightclub in Orlando, Florida. We may never know or understand what was in Mateen’s mind, but we can situate his attack within the history of eliminationism in America. Islamist terrorism is just part of a larger phenomenon: right wing eliminationism. But despite centuries of right wing eliminationist words and deeds in the U.S., there is little or no mainstream recognition of the phenomenon. Vaclav Havel, Jan Patocka: The Powerless And The Shaken, Daniel Brennan

This article makes a case for considering Vaclav Havel's political theory of the nature of dissent as more politically grounded than that of his mentor fan Patoka. Against the criticism of Havel, which describes him as a less rigorous repeater of Patocka's ideas, this paper demonstrates how Havel appropriated Patocka's idea that the dissident is, similarly to a World War I trench soldier, fighting in a contemporary front in a demobilized war. However I argue that in Havel's thought, the understanding of dissent takes on a more practical and useful complexion than that of Patocka. This paper will explain and …

This essay explores the ways States use their domestic laws to regulate activities that cross national borders. Domestic-law enforcement decisions play an underappreciated role in the development of international regulatory policy, particularly in situations where the enforcing State's power to apply its law extraterritorially is not contested. Collective action problems suggest there will be an undersupply of enforcement decisions that promote global welfare and an oversupply of enforcement decisions that promote national welfare. These collective action problems may be mitigated in part by government networks and other forms of regulatory cooperation.

Avoiding The Guillotine: The Need For Balance And Purpose In Determining Fundamental Rights Under The Fourteenth Amendment, Timothy A. Campbell

This Article examines the need to bridge the two fields of thought in fundamental rights jurisprudence. This Article argues two points. Broadly, an objective principle to determine fundamental rights is non-existent because rights by their nature are subjective. Hence, the Court must accept some subjectivity, but it needs to install guideposts to direct the judge’s discretion. The Court also needs to adopt a balanced approach that combines rationalism and traditionalism. They need to look at the purpose of the asserted right, the specificity of the asserted right, legal precedent, and history in formulating a balanced approach.

The telegraph was the first practical use of electricity. It revolutionized commercial communication and facilitated the globalization of business. As the telegraph developed as a medium of international communication, regulation was needed to overcome administrative and technical issues, and, importantly, to establish accounting procedures for the distribution of the revenue to multiple national partners. This paper traces the evolution of revenue allocation models through three international organizations that ultimately lead to the creation of the International Telecommunications Union (ITU) in 1932. The shifts in revenue allocation methods are consistent with a shift in focus of regulation from growth to efficiency …

The term postindustrial society presupposes categorizing society based on an economic means of classification. Its use rests on assessing the relative status of manufacturing industry as an economic sector. Significant adjustment in sectoral location and nature of employment precipitated by late-twentieth-century deindustrialization in the developed world led many social theorists and critics to predict broad changes throughout domains of everyday life. Some began to speak not only of sectoral transformation but also of an emergent ‘ postindustrial society. ’ Following earlier agrarian and industrial ‘ revolutions, ’ postindustrialism suggested yet another revolution that would again transform how societies were organized.
