In an attempt to clear Frantz Fanon’s name, on account of his opinion on the role of violence in decolonizing a nation, this paper focuses on two important chapters in his last book, The Wretched of the Earth. By closely reading his articulation of the Algerian war and the wounds brought on by mental illness at such a time, Fanon’s true opinion concerning violence becomes clear. A Kantian Revision Of The Doctrine Of Double Effect, Andrew H. Chung

In this paper, I will present a Kantian revision of the Doctrine of Double Effect (DDE). In order to do so, I will explain the concept of jus in bello – focusing in particular on the distinction between intent and foresight. I will then argue that we ought to take an agency-inspired look at the DDE. Finally, I will conclude by arguing for my thesis that Boyle’s theory of agency, while good, needs to be revised in order to accommodate concerns stemming from Kant’s Formula of Humanity… namely consent.

Citizen Responsibility For War In Imperfect Democracies, Lisa Rivera

Are individual citizens of imperfect democracies morally responsible for unjust wars waged by their state? Moral responsibility for unjust wars involves both retrospective and social responsibility. Citizens of imperfect democracies are retrospectively responsible when they choose to vote for a leader they know will wage an unjust war. This situation may occur very rarely. For example, US citizens did not have this political option at the outset of the Vietnam and Iraq Wars. However, even when citizens are not retrospectively responsible they have the social responsibility to engage in collective action to address the harms unjust war causes.

The Utah Law Review brought in a panel of experts for a symposium on the legal and ethical limits of technological warfare. This roundtable discussion crystalized the issues discussed throughout the symposium. The collective experience and diversity of viewpoints of the panelists produced an unparalleled discussion of the complex and poignant issues involved in drone warfare. The goal of this dissertation is to analyze the kinds of ethical challenges soldiers encounter during counterinsurgency operations, what decision making processes or values they use to resolve these challenges, and how military institutions and culture influence soldiers' ethical reasoning. The first part of the dissertation is an assessment of various theories of applied ethics and how these can be used by soldiers during counterinsurgency operations. The second part discusses the institutions and cultures of the American Army, British Army, and Israeli Ground Forces. In the third part, I take up the problem of how soldiers from each of these …
