By evaluating the case recommendations following a preliminary hearing from military sexual assault cases from fiscal years 2016-2018, this study aims to assess whether or not extralegal factors are influencing decisions of case recommendations of assigned convening authorities. Using secondary data from the Department of Defense’s annual reports on sexual assault in the United States military (n=5,171), this study aims to answer the following questions: Do extralegal factors contribute to convening authorities’ recommendations following Article 32 hearings? If so, what extralegal factors contribute to convening authority's decision on non-judicial hearing recommendations? The results of the following analyses identified several extralegal …

This qualitative legal study explored statutory immunity protection provided to Texas educators under the Texas Education Code §22.0511 and §22.0512. The Texas legislature enacted the statutory immunity provisions as part of House Bill 4 and tort reform in 2003. Researchers have called for more balance when providing immunity protections for educators. The researcher limited the study to Texas Commissioner of Education decisions and Texas appellate court cases. The study utilized a legal framework to determine under what circumstances the rulings of statutory immunity shields educators from liability. This dissertation is theoretically informed by General Strain Theory (GST) (Agnew 1992, 2002), and examines binge drinking within a military veteran population. It begins with an assessment on reform and focuses on shaping knowledge around the issue of binge drinking by military veterans. The current study uses Agnew’s GST to argue for an understanding of how strain and stress can affect individuals who have served in the military and acknowledges how this strain can lead to negative coping mechanisms such as binge drinking. This thesis explores the political and demographic obstacles facing the Fairness movement in Kentucky in regards to local employment protection ordinances for LGBTQ+ persons (Fairness Ordinances). Using case studies on recent Fairness debates in Berea and Bowling Green, this thesis explores the concern some Kentuckians have about LGBTQ+ nondiscrimination ordinances in their communities. From these cases studies, it can be concluded that many of the concerns espoused by opponents of Fairness are simple scare tactics with no evidence supporting their claims. Current research indicates an association between intense adolescent work (twenty hours or more per week) and delinquent behavior. It has been widely speculated that this relationship is spurious, occurring only as a result of other factors which are common to both offending and intense employment. The current study attempts to fill a gap in the literature by utilizing the Pathways to Desistance dataset to examine the evolution of the relationship between work and self-reported offending in a longitudinal sample of juvenile offenders. As stigmatized persons, registered sex offenders betoken instability in communities. Depressed home sale values are associated with the presence of registered sex offenders even though the public is largely unaware of the presence of registered sex offenders. Using a spatial multilevel approach, the current study examines the role registered sex offenders influence sale values of homes sold in 2015 for three U.S. counties (rural, suburban, and urban) located in Illinois and Kentucky within the social disorganization framework. Grassroots Diplomacy And Vernacular Law: The Discourse Of Food Sovereignty In Maine, John Welton

This thesis studies the discourse of food sovereignty in Maine, a coalition of small-scale farmers, consumers, and citizens building an alternative food system based on a distributed form of production, processing, selling, purchasing, and consumption. This distribution occurs at the municipal level through the enactment of ordinances. Using critical-rhetorical field methods, I argue that the discourse of food sovereignty in Maine develops a ‘constitutive’ rhetoric that composes rural society through affective relationships. Advocates engage the industrial food system to both expose its systemic bias against small-scale farming and construct their own discourse of belonging. Based upon agrarian values such as …

This study explores a series of events that occurred in the spring of 1876. The relationship between the Indianapolis city government, the Marion County Courts, the Indianapolis Police Department, and the African American community came together to usher in changes never before envisioned. The Indianapolis Police Department (IPD) was formed in 1855, then disbanded 12 months later in a political dispute. From 1857-to-1876, the IPD was all white. These changes took place as the Reconstruction era was coming to a close. The first Ku Klux Klan was at its apex, terrorizing black communities, and Jim Crow was coming into its …

Prior research has found equity theory explains employee responses to falling wages in relation to other comparable workers. The present research attempts to contribute to the criminal justice literature by directly testing equity theory within the policing context, something no study has done to date. Applied to policing, equity theory predicts sworn officers employed by departments with falling or inequitable salaries (i.e., their salaries fail to keep up with those at other regional agencies) will reduce their work input (i.e., discretionary arrests) and/or quit in higher numbers than before (i.e., increase attrition). This dissertation research examines the impact of military service among an incarcerated population. It addresses the gaps identified within the prior literature by taking a closer look at the association between service experience and criminal justice outcomes. Specifically, the present study explores whether branch type, combat exposure, age of entrance, service length, and discharge status impact the number of lifetime arrests, current offense type, and institutional misconduct. This research uses data from the U.S. Bureau of Justice Statistics* 2004 Survey of Inmates in State and Federal Correctional Facilities. Privatization of juvenile facilities and services has been the norm since the inception of the juvenile justice system. However, little research has been performed examining the impact of privatization on juvenile justice, despite the possible repercussions of this policy for the juveniles served. This study explores the associations between the independent variables of organizational motivations and culture with the dependent variable of organizational commitment to local jail reentry partnerships. A cross-sectional, mixed methods design was used based primarily on a quantitative survey mailed to organizational informants involved in jail reentry activities within three central Florida counties. Qualitative data was also collected by observing conveniently sampled reentry meetings and analyzing the content of social artifacts, such as meeting handouts, minutes, e-mails, and other related documents. Concealed weapon permit issuance is one of the most contentious topics debated in modern politics today. Various information systems utilized by law enforcement agencies may be promising; however, there is little extant empirical research to validate the system's effectiveness related to increasing investigative success (Bureau of Justice Assistance, 2010). The present study utilized a mixed-methods strategy to examine the effectiveness, diffusion, and institutionalization of the Memphis Crisis Intervention Team (CIT) model. To evaluate the effectiveness of the training component of the CIT model, a panel research design was employed in which a sample of 179 law enforcement officers and 100 correctional officers in nine Florida counties were surveyed on the first day of training (pretest), the last day of training (posttest), and one month following their completion of CIT training (follow-up). Currently, the drug court treatment outcome literature provides little guidance about examining clients that fail to complete drug court. Typically, only successful clients are tracked and measured for outcome success characteristics and not much is known about unsuccessful client outcomes. A large portion of individuals who begin drug court do not complete the program. With unsuccessful rates ranging from 34 to 73%, it seems reasonable to examine the outcome of these cases. Ignoring this phenomenon is problematic because various stakeholders remain uninformed about the drug court model’s full effectiveness. The focus on successful clients may fail to fully capture and …
