By evaluating the case recommendations following a preliminary hearing from military sexual assault cases from fiscal years 2016-2018, this study aims to assess whether or not extralegal factors are influencing decisions of case recommendations of assigned convening authorities. Using secondary data from the Department of Defense’s annual reports on sexual assault in the United States military (n=5,171), this study aims to answer the following questions: Do extralegal factors contribute to convening authorities’ recommendations following Article 32 hearings? This dissertation is theoretically informed by General Strain Theory (GST) (Agnew 1992, 2002), and examines binge drinking within a military veteran population. It begins with an assessment on reform and focuses on shaping knowledge around the issue of binge drinking by military veterans. The current study uses Agnew’s GST to argue for an understanding of how strain and stress can affect individuals who have served in the military and acknowledges how this strain can lead to negative coping mechanisms such as binge drinking. From American Service To Disservice: An Exploration Of The Impact Of Military Experience Among An Incarcerated Population, Erika Brooke

This dissertation research examines the impact of military service among an incarcerated population. It addresses the gaps identified within the prior literature by taking a closer look at the association between service experience and criminal justice outcomes. Specifically, the present study explores whether branch type, combat exposure, age of entrance, service length, and discharge status impact the number of lifetime arrests, current offense type, and institutional misconduct. This research uses data from the U.S. Bureau of Justice Statistics* 2004 Survey of Inmates in State and Federal Correctional Facilities.
