Of Sweatshops And Human Subsistence: Habermas On Human Rights, David Ingram
Philosophy: Faculty Publications and Other Works
In this paper I argue that the discourse theoretic account of human rights defended by Jürgen Habermas contains a fruitful tension that is obscured by its dominant tendency to identify rights with legal claims. This weakness in Habermas’s account becomes manifest when we examine how sweatshops diminish the secure enjoyment of subsistence, which Habermas himself (in recognition of the UDHR) recognizes as a human right. Discourse theories of human rights are unique in tying the legitimacy of human rights to democratic deliberation and consensus. So construed, their specific meaning and force is the outcome of historical political struggle. However, unlike …

Released prisoners are among the most difficult labor force populations to serve and least likely to be successfully engaged in sustained employment due to persistent legal problems, low education attainment levels, high recidivism rates, and driver’s license suspension and revocation restrictions. The stigma of being an ex-inmate and the limitations this places on those released and expected to become gainfully employed are compounded further by legal sanctions placed on many adults who have spent time in correctional facilities. A total of 42,046 Milwaukee County working age adults have been in the DOC system, including men and women presently incarcerated in …

The job openings survey of employers in southeastern Wisconsin (i.e., Milwaukee, Waukesha, Racine, Washington, Kenosha, Walworth, and Ozaukee counties) was prepared by the Employment and Training Institute for the Regional Workforce Alliance, with funding support from a U.S. Department of Labor Employment and Training WIRED grant. Over 3,800 employers provided data on their job openings during the week of May 25, 2009, through use of a mail survey, hundreds of follow-up phone interviews, and reviews of web postings (where such data included all current openings). Today, we cannot talk just about plain control, but we must talk about the nature of the interaction of the one who is being controlled and the one who controls, an interaction where the one that is “controlled” is asking for more control over himself/herself while expecting to be compensated by a surplus of freedom to satisfy trivial needs and wishes. Such a liberty for the fulfillment of trivial needs is being declared as freedom. But this implies as well the freedom to choose not to be engaged in any kind of socially sensible or politically articulated struggle.

This article examines the prospect for more fruitful collaborative research between labour law and industrial relations, using recent studies in labour law as a starting point. An increased and more sophisticated interest in labour law as regulation, particularly in Australia, has moved the discipline towards some of the traditional interest areas of industrial relations. However there remains a need for more empirically-based research, with the social reality of law as its primary focus.
