Commentaire Du Livre De Jacques Chevallier « L'État Post-Moderne » (3Ème Édition), Javier Agudo Nov 2011

Commentaire Du Livre De Jacques Chevallier « L'État Post-Moderne » (3Ème Édition), Javier Agudo

Javier Agudo

Mapping Chinese Development Assistance In Africa: An Analysis Of The Experiences Of Ethiopia, Cosmas Milton Obote Ochieng Ochieng Jul 2011

Mapping Chinese Development Assistance In Africa: An Analysis Of The Experiences Of Ethiopia, Cosmas Milton Obote Ochieng Ochieng

Cosmas Milton Obote Ochieng Ochieng

In November 2008 AFRODAD published a report “Mapping Chinese Development Assistance in Africa – An analysis of the experiences of Angola, Mozambique, Zambia, and Zimbabwe.” This report specifically looking at Ethiopia is a follow up to that report.

China is one of the fastest-growing countries in the world, and is expanding its presence in Africa. According to the Economist (19/02/2011) China officially passed Japan to become the world’s second biggest economy. China’s GDP amounted to $5.9 trillion against Japan’s $5.5 trillion. In addition, China has been more than willing to play the role of key development aid partner and investor …

Legal Mechanization Of Corporate Social Responsibility Through Alien Tort Statute Litigation: A Response To Professor Branson With Some Supplemental Thoughts, Donald J. Kochan Jul 2011

Legal Mechanization Of Corporate Social Responsibility Through Alien Tort Statute Litigation: A Response To Professor Branson With Some Supplemental Thoughts, Donald J. Kochan

Donald J. Kochan

This Response argues that as ATS jurisprudence “matures” or becomes more sophisticated, the legitimate limits of the law regress. The further expansion within the corporate defendant pool – attempting to pin liability on parent, great grandparent corporations and up to the top – raises the stakes and complexity of ATS litigation. The corporate social responsibility discussion raises three principal issues about how a moral corporation lives its life: how a corporation chooses its self-interest versus the interests of others, when and how it should help others if control decisions may harm the shareholder owners, and how far the corporation must …

The Administrative System Of The European Union-From Concept To Reality, Lucica Matei, Ani Matei Jun 2011

The Administrative System Of The European Union-From Concept To Reality, Lucica Matei, Ani Matei

Ani Matei

At the beginning of the 21st century,

the European Union (EU) governance and

administration are undergoing some significant

transformations, not without obstacles, from concept

to reality, revealing characteristics that aim both the

European and national elements in a permanent

interpenetration, whose complexity is superior

to other processes and phenomena specific for

the construction of a United Europe. The major

objective of the current paper is to substantiate and

describe systemically the process of affirmation and

transformation of the EU administration as a core

pillar of European governance. A doctrinal overview

on the debated topic reveals an atypical concept in

terms …

Media Evolution And Public Understanding Of Climate Science, Ann Williams Dec 2010

Media Evolution And Public Understanding Of Climate Science, Ann Williams

Ann E Williams

This paper employs public opinion data from a nationally representative probability sample to examine how information encounters and exposure to different media sources relate to individuals' beliefs about global warming. The analyses indicate that media source exposure (i.e., exposure to news and information about science presented through different media outlets), intentional information exposure (i.e., deliberate exposure to global warming news coverage), and inadvertent information exposure (i.e., unplanned exposure to news and information about science that is encountered online while searching for other forms of information) relate to beliefs about global warming, in significant and meaningful ways. Namely, the findings show …

Two Memoirs Tell The History Of The Alaska Dividend, Karl Widerquist Dec 2010

Two Memoirs Tell The History Of The Alaska Dividend, Karl Widerquist

Karl Widerquist

Alaska’s Permanent Fund Dividend is closer to a basic income than almost any other policy in the world today. The lessons of how it was created and how it became so popular and successful are extremely important to the basic income movement. Two autobiographies available now tell different parts of the story of the Alaska Dividend. One is by Jay Hammond, the governor who, more than anyone else, is responsible for creating the fund and dividend. The other is by Dave Rose, the first executive director of the Alaska Permanent Fund Corporation. This review essay draws lessons for the basic …

Duress, Péter Cserne

Péter Cserne

This chapter is to appear in Contact Law and Economics, part of the Elgar Encyclopedia of Law and Economics, 2nd ed. Its purpose is to provide an overview of the economic analyses of contractual duress. The focus is on the distinctive features of the economic perspective on the duress doctrine, as developed in the theoretical literature of law and economics. Along with the results of economic analysis, the legal background and some non-economic theories of duress are also briefly presented.
