Ruling In The Shadows: Analysis Of The Supreme Court’S Use Of The ‘Shadow Docket’ And Its Effects, Emilee Smart
Theses and Dissertations--Political Science
The recent increased use of the shadow docket has left the public and scholars with unanswered questions about how procedures influence outcomes and behavior. Many of these shadow docket cases have been petitioned to the justices as emergencies in very important policy areas such as immigration, abortion, elections, and transgender rights. I collect a large dataset of all outcomes of the Supreme Court's shadow docket from 2010-2022. I examine the language the justices use to justify their decisions made using alternate procedures. From Experiencing Abuse To Seeking Protection: Examining The Shame Of Intimate Partner Violence, A. Rachel Camp

Shame permeates the experience of intimate partner violence (IPV). People who perpetrate IPV commonly use tactics designed to cause shame in their partners, including denigrating their dignity, undermining their autonomy, or harming their reputation. Many IPV survivors report an abiding sense of shame as a result of their victimization—from a lost sense of self, to self-blame, to fear of (or actual) social judgment. When seeking help for abuse, many survivors are directed to, or otherwise encounter, persons or institutions that reinforce rather than mitigate their shame. Survivors with marginalized social identities often must contend not only with the shame of …

Mental Health Focus As A Deterrent For Justice Involved Youth, Miyah Seckinger

Tough-on-crime policies regarding youthful offending have resulted in a pendulum swing in which the juvenile justice system has shifted from a rehabilitative focus to one of punishment. The current paper evaluates different mental health program alternatives, as an option to return to a rehabilitative focus for juveniles, with a major focus on the Juvenile Treatment and Support Court in Kent County, Michigan. Through a qualitative analysis, there were findings of initial success with the youthful offenders presented in the court. Recommendations and limitations from the study are presented to aid further policy change and research.

Johnson V. M'Intosh: Christianity, Genocide, And The Dispossession Of Indigenous Peoples, Cynthia J. Boshell

Using hermeneutical methodology, this paper examines some of the legal fictions that form the foundation of Federal Indian Law. The text of the U.S. Supreme Court’s 1823 Johnson v. M’Intosh opinion is evaluated through the lens of the Convention on the Prevention and Punishment of the Crime of Genocide to determine the extent to which the Supreme Court incorporated genocidal principles into United States common law. The genealogy of M’Intosh is examined to identify influences that are not fully apparent on the face of the case. International jurisprudential interpretations of the legal definition of genocide are summarized and used as …

Evaluation Of A Veterans Treatment Court In The Northwest United States, Jacob Davis Stalcup

This thesis provides an evaluation of a Veterans Treatment Court in the northwestern United States. Previously collected data from clients within the court was analyzed and helped format semi-structured interviews with court employees. The conclusion of this evaluation is that the court would operate more effectively if there was a focus on the recruitment and retention of veteran employees, especially peer mentors. This could be accomplished by policy changes involving hiring new employees.

During oral arguments, attorneys are given the chance to elaborate on their written briefs and answer questions from the judges deciding the case. Studying oral arguments can be a window into the power dynamics between judges and attorneys, and can shed light onto how factors like gender may affect judicial decision-making. While a growing body of research has examined gender dynamics in oral arguments in the United States Supreme Court, no existing studies have examined whether these findings hold up in the U.S. Court of Appeals, the second highest courts in the country. Following the terror attacks on the United States, an increasing number of veterans are returning to civilian life after having experienced service in active combat zones. As a result, many of these veterans are returning from their military service suffering from serious mental health issues and other injuries that include posttraumatic stress disorder, traumatic brain injury, and major depression. Since the early 1990s, several specialized therapeutic courts have been developed as part of an effort to address a specific population within the state criminal justice systems. India has the highest number of acid attacks globally every year, and despite the actions taken by the Indian Government and the Supreme Court of India, the crime is on the rise. This increase can be attributed to the patriarchal ideology that is prevalent in India and to India’s inadequate legal system, which does not deliver efficient remedies to the victims. This article will discuss the prevalence of acid attacks in India, motives behind the attacks, consequences on victims, and shortcomings in measures adopted to prevent the crime and provide justice to victims.

The paper reviewed the inclusion of computer generated evidence in Nigerian court of law with respect to its implication for law libraries. Attention was given more to the e-library system which generates and disseminates legal information via electronic format. Feminist Action Against Pornography In Japan: Unexpected Success In An Unlikely Place, Caroline Norma, Seiya Morita
Dignity: A Journal of Analysis of Exploitation and Violence
In late 2016 a feminist movement against problems of commercial sexual exploitation, and especially issues of coerced pornography filming, arose in Japan. This article describes the history of this movement as it mobilized to combat human rights violations perpetrated by the country’s pornographers. The movement’s success came not spontaneously or haphazardly; in fact, it was orchestrated earlier over a full decade-and-a-half by activists who persevered in researching and highlighting pornography’s harms in a civil environment of hostility, isolation and social derision, even among progressive groups and individuals. The Anti-Pornography and Prostitution Research Group (APP) was particularly prominent in this history. …

Indigenous Peoples in Mexico have long struggled in securing their rights in colonizing states. Applying party capability theory, this paper seeks to empirically understand the Mexican Supreme Court's behavior in cases pertaining to Indigenous Peoples. This paper thus evaluates the degree to which the Mexican Supreme Court is indeed an impartial actor that produces "equal protection under the law" for everyone (Galanter, 1974). Specifically, this paper examines the questions: To what extent does the Mexican Supreme Court protect Indigenous Peoples' rights? In October 2017, the city of Worcester began a three-month pilot program that worked to divert youth charged with domestic assault and battery crimes away from the criminal justice system and towards restorative services. Studies show that incapacitation, especially of low level offenders, does not reduce crime or produce better outcomes for individuals, families, or communities. Thus, it is essential to explore alternatives, such as diversion programs, that work to downsize the prison population, target the factors contributing to delinquency, and rehabilitate rather than purely punish offenders. Mourners In The Court: Victims In Death Penalty Trials, Through The Lens Of Performance, Sarah Beth Kaufman

This article presents findings from ethnographic research in death penalty trials around the United States, focusing on the role of victims and their supporters. Victim impact testimony (VIT) in death penalty sentencing has received intense legal scrutiny during the past thirty years. The ruling jurisprudence allows VIT with the explanation that it deserves parity with testimony about the defendant's background. Drawing on observations and interviews with participants in 15 death penalty trials, I demonstrate that this framing confuses the central role of victim supporters in the courtroom. Victim supporters function as mourners, which grants them a socially elevated position in …
