The Communications Decency Act: Immunity For Internet-Facilitated Commercial Sexual Exploitation, Haley C. Halverson

Dignity: A Journal of Analysis of Exploitation and Violence

This paper reviews the original intent and historical application of the Communications Decency Act (CDA), most notably Section 230, with special regard to cases of Internet-facilitated commercial sexual exploitation. Although the CDA was originally created to protect children online, Section 230 of the CDA has been interpreted by the courts to grant broad immunities to websites facilitating the sexual exploitation of children and adults alike. Through analyzing the genesis and evolution of the CDA, it becomes clear that court interpretations of Section 230 are starkly inconsistent with original Congressional intent, and that the primary way to avoid de facto decriminalization …

Dignity: A Journal of Analysis of Exploitation and Violence

Jyoshi kousei (JK) means high school girls in Japanese and “JK business” is an umbrella term for commercial activities done by high school girls to provide male customers with sexual arousal. The “JK business” is considered to promote sexual exploitation or sexual assault of minors. Currently, only two prefectures out of 47 in Japan enforce ordinances that specifically regulate the “JK business.” This paper intends to explore possible theoretical explanations of the “JK business” to raise awareness on the issue. Numerous research studies suggest that at least one in five female college students is sexually assaulted while enrolled. However, many studies exploring sexual violence prevalence on campus use methodology permitting students to self-select into the study based on interest in the topic (i.e., students receive an email offering them the opportunity to participate in a study on sexual violence). Self-selection may bias these prevalence estimates of campus sexual violence. To explore this issue, we surveyed two samples of college women on their experiences of sexual assault. In this review of recent books on public policy and prostitution, Julie Bindel’s The Pimping of Prostitution is sympathetically reviewed. Her thesis, that the libertarian movement seeking to remove prostitution from legal and public policy spheres has done grave harm to the lives of boys, girls and women, is elaborated by quotations from her chapters. This book is an important resource for those who campaign for the rights of women and children to be free of commercial sexual exploitation. Research has consistently linked residual trauma-related shame among child sexual abuse (CSA) survivors to sexual revictimization, health risk behaviors, and poorer response to mental health treatment. However, questions remain regarding the imprint of childhood maltreatment on trauma-related shame including which CSA characteristics or types of childhood maltreatment contribute to residual shame in adulthood. Using data drawn from a prospective study of 174 primarily African American women with histories of CSA and a matched comparison group, this study explores whether specific characteristics of CSA (familial CSA, CSA with penetration, force used by CSA perpetrator), repeat sexual victimization in adolescence, childhood physical …
