Third Party Access And Refusal To Deal In European Energy Networks: How Sector Regulation And Competition Law Meet Each Other, Michael Diathesopoulos
Michael Diathesopoulos
In this paper, we will analyse the issue of concurrence between competition and sector rules and the relation between parallel concepts within the two different legal frameworks. We will firstly examine Third Party Access in relation to essential facilities doctrine and refusal of access and we will identify the common points and objectives of these concepts and the extent to which they provide a context to each other’s implementation. Second, we will focus on how Commission uses sector regulation and objectives as a context within the process of implementation of competition law in the energy sector and third, we will …

Between Market And State: Directions In Social Science Research On Disaster, Daniel P. Aldrich
Between Market And State: Directions In Social Science Research On Disaster, Daniel P. Aldrich
Daniel P Aldrich
In this extended review, I discuss three recent books on disaster: Governing after Crisis: The Politics of Investigation, Accountability, and Learning edited by Arjen Boin, Allan McConnell, and Paul ‘T Hart, Learning from Catastrophes: Strategies for Reaction and Response , edited by Howard Kunreuther and Micheel Useem, and The Next Catastrophe: Reducing Our Vulnerabilities to Natural, Industrial, and Terrorist Disasters by Charles Perrow. All three books invoke the market and state as core forces at work in mitigation and disaster recovery, overlooking the critical role of social capital.

As the People's Republic of China shifts toward a more market-oriented economic system, it has also begun exploring another Western institution: scientific public opinion polling. As Yang Guansan, one of China's leading pollsters, said recently in the Beijing Review: "Only five or six years ago, the public opinion poll was considered to be a 'bourgeois' or 'capitalist' method of social survey ... Now the taboo has been swept away in the strong tide of reform, which is challenging all of China's traditions, stereotypes and prejudices."

Poland's New Trade Unions, David S. Mason
Poland's New Trade Unions, David S. Mason
David S. Mason
With the declaration of martial law in December 1981 and the formal banning of Solidarity in October 1982, the Polish regime created for itself a dilemma: how to provide a channel for participation by the workers without reactivating Solidarity and without allowing that participation to assume political dimensions. The Jaruzelski leadership professed a desire to achieve reconciliation and understanding in the aftermath of the heady days of Solidarity and the depressing denouement of martial law. One of the principal means to do this was through the creation of new institutions, allegedly independent, which would absorb some of the creative and …
Solidarity, The Regime And The Public, David Mason
Solidarity, The Regime And The Public, David Mason
David S. Mason
This paper examines the extent to which Solidarity acted as a link between the population and the regime and as a representative of the interests of the workers. It looks first at the reasons for the emergence of Solidarity, and Solidarity's subsequent embodiment of the society's desire for a political and economic order more in line with the ideals of socialism, and more genuinely representative of the workers' interests. It concludes by assessing the charges against Solidarity made by the martial law authorities, the extent of current support for the union and the regime, and the possibilities for a resolution …

The State-In-Society Approach To Democratization With Examples From Japan, Mary Alice Haddad
The State-In-Society Approach To Democratization With Examples From Japan, Mary Alice Haddad
Mary Alice Haddad
How does an undemocratic country create democratic institutions and transform its polity in such a way that democratic values and practices become integral parts of its political culture? This article uses the case of Japan to advocate for a new theoretical approach to the study of democratization. In particular, it examines how theoretical models based on the European and North American experiences have difficulty explaining the process of democratization in Japan, and argues that a state-in-society approach is better suited to explaining the democratization process diverse cultural contexts. Taking a bottom-up view of recent developments in Japanese civil society through …

The Power Of People: Social Capital’S Role In Recovery From The 1995 Kobe Earthquake, Daniel P. Aldrich
The Power Of People: Social Capital’S Role In Recovery From The 1995 Kobe Earthquake, Daniel P. Aldrich
Daniel P Aldrich
Despite the regularity of disasters, social science has only begun to generate replicable knowledge about the factors which facilitate post-crisis recovery. Building on the broad variation in recovery rates within disaster-affected cities, I investigate the ability of Kobe’s nine wards to repopulate after the 1995 Kobe earthquake in Japan. This article uses case studies of neighborhoods in Kobe alongside new time-series, cross-sectional data set to test five variables thought to influence recovery along with the relatively untested factor of social capital. Controlling for damage, population density, economic conditions, inequality and other variables thought important in past research, social capital proves …

Forest Governance In India: Collective Rights And Claims In The Forest Rights Act, Prakash Kashwan

The note is intended as an intervention within an ongoing policy debate around questions of forest governance in India. The need to keep this note short has forced the author to assume readers’ familiarity with these debates. Given this, some readers may be interested in the reports on Forest Rights Act (FRA), 2006 available at http://www.forestrights.nic.in/ and

Data Usage In Quantitative Comparative Politics, Cas Mudde, Andreas Schedler
Data Usage In Quantitative Comparative Politics, Cas Mudde, Andreas Schedler
Cas Mudde
The quantitative study of comparative politics is often described as a data-driven enterprise. Employing an original dataset of comparative politics articles published in leading academic journals between 1989 and 2007, this article offers the first empirical analysis of data usage in comparative research. Tracing potential biases induced by data dependence, it assesses the structure of quantitative comparative research (by year, research design, geographic focus, and subject area), the use of country-specific and region-specific datasets, the introduction of original data, and the degree of concentration in data usage. Its empirical findings question cherished assumptions about the structure of the discipline.
Fixing Recovery: Social Capital In Post-Crisis Resilience, Daniel P. Aldrich
Fixing Recovery: Social Capital In Post-Crisis Resilience, Daniel P. Aldrich
Daniel P Aldrich
Disasters remain among the most critical events which impact residents and their neighborhoods; they have killed far more individuals than high salience issues such as terrorism. Unfortunately, disaster recovery programs run by the United States and foreign governments have not been updated to reflect a new understanding of the essential nature of social capital and networks. I call for a re-orientation of disaster preparedness and recovery programs at all levels away from the standard fixes focused on physical infrastructure towards ones targeting social infrastructure. The reservoirs of social capital and the trust (or lack thereof) between citizens in disaster-affected communities …

Después De La Década De Los Pueblos Indígenas, ¿Qué? El Impacto De Los Movimientos Indígenas En La Arenas Políticas De América Latina., Salvador Marti I Puig
Salvador Marti i Puig
The Polish Party In Crisis, 1980-1982, David S. Mason
The Polish Party In Crisis, 1980-1982, David S. Mason
David S. Mason
Over the last three years, the Polish United Workers' Party has suffered a major crisis, the most substantial crisis of any Communist party in any Communist party state. The disintegration of the party was at least partly responsible for both the development of Solidarity in the summer of 1980 and the imposition of martial law in December 1981. The lack of trust in the party and its authoritarian and unrepresentative character led the workers to demand an institution more responsive to their own needs. But the growth of Solidarity during 1981 and the continuing disintegration and fragmentation of the party …
Attitudes Toward The Market And Political Participation In The Postcommunist States, David S. Mason
Attitudes Toward The Market And Political Participation In The Postcommunist States, David S. Mason
David S. Mason
In the aftermath of the anti-communist revolutions of 1989-1991, the new governments in eastern Europe faced the herculean task of attempting simultaneously to build market economies and democratic political institutions. Though capitalism and democracy are often considered to be natural allies, in the cases of these new states they sometimes pull against each other.
