Pre-trial detention as it is practiced in France seems to be the paradigm of the “indetermination postulate” that founded the critical legal studies: changes in “words” cannot easily create changes in legal practices. While pre-trial detention has been reformed countless times since the second half of the 20th century, there is little evidence that any of these reforms has had an impact on judicial practices. One possibility is that we are not able to reform the institution because we do not understand its unofficial social functions. Cet article soulèves trois remarques sur la litérature scientifique relative au risque de récidive. La première remarque concerne la tendance de certains spécialistes à minimiser les difficultés fondamentales liées à la recherche empirique dans le domaine de la récidive. La seconde consiste a montrer que contrairement à d'autres champs, les chercheurs qui interprêtent les résultats des suivis de cohorte sur le risque de récidive ont souvent tendance à voir le verre à moitié plein. In deze bijdrage hebben we getracht een te enge blik op wetenschapsfraude als individueel wangedrag in vraag te stellen. Dat deden we door het spanningsveld uit te tekenen waarin de fraude wortel schiet : een complex spanningsveld tussen 1. de generische constraints die alle wetenschappen onder dezelfde noemer van wetenschap doen toebehoren (“objectiteit” en “collectieve verantwoordelijkheid”), 2. de pluraliteit aan wetenschappelijke praktijken en 3. de kolonisatie van deze pluraliteit door de logica van de knowledge economy en, hiermee verweven, door het evaluatiemodel van de experimentele wetenschappen. Few studies have examined public response to unethical or illegal behavior by firms, despite some research on institutional investors, organized protest groups or shareholder activists. Although a robust research literature shows that corporations invest heavily in impression management the relevant audiences for these messages have generally been construed by scholars as other organizations, obscuring the micro-foundations of market activity. This paper will address the knowledge gap by drawing on evidence from a long term field study of retail investors.
