The Politics Of Revenue Allocation In Nigeria Since Independence: An Overview, Ozy B. Orluwene Jp May 2008

The Politics Of Revenue Allocation In Nigeria Since Independence: An Overview, Ozy B. Orluwene Jp

Dr Ozy B.Orluwene,JP

Abstract This paper is designed primarily to offer a historical overview of the politics of revenue allocation in Nigeria since independence. Revenue generation and allocation among the federating units of Nigerian federalism is a crucial issue in that as soon as there exist two or more levels or tiers of governments, it becomes necessary to introduce a system of sharing fund to various tiers of government to particularly meet constitutionally assigned and specified functions. There is the problem of how to allocate revenue to these different tiers of government in relation to the constitutionally assigned functions. The discordance between fiscal …

Refining Search Terms For Nanotechnology, Alan L. Porter, Jan Youtie, Philip Shapira, David J. Schoeneck May 2008

Refining Search Terms For Nanotechnology, Alan L. Porter, Jan Youtie, Philip Shapira, David J. Schoeneck

Philip Shapira

The ability to delineate the boundaries of an emerging technology is central to obtaining an understanding of the technology’s research paths and commercialization prospects. Nowhere is this more relevant than in the case of nanotechnology (hereafter identified as “nano”) given its current rapid growth and multidisciplinary nature. (Under the rubric of nanotechnology, we also include nanoscience and nanoengineering.) Past efforts have utilized several strategies, including simple term search for the prefix nano, complex lexical and citation-based approaches, and bootstrapping techniques. This research introduces a modularized Boolean approach to defining nanotechnology which has been applied to several research and patenting databases. …

Gesellschaftliche Herausforderungen Durch „Intelligente Umgebungen“, Michael Friedewald, Ralf Lindner

Michael Friedewald

Constitutional Provisions And Challenges To Local Government Administration In Nigeria, Ozy B. Orluwene Jp Apr 2008

Constitutional Provisions And Challenges To Local Government Administration In Nigeria, Ozy B. Orluwene Jp

Dr Ozy B.Orluwene,JP

Abstract The primary focus of this paper is to identify and explain the various flash points and problems of constitutional provision in Nigeria with emphasis on local government administration as enshrined in section 7 (1 and 2) of the 1999 constitution which restores to the states, the power to create and control local government among others. The paper regrets to note the gains made in local government after the 1976 local governments reforms have been depreciating. This is particularly true since the inception of the 1999 constitution of the federal republic of Nigeria and the deliberate actions of the state …

The Niger Delta Crisis: A Three Dimensional Discourse, Ozy B. Orluwene Jp Apr 2008

The Niger Delta Crisis: A Three Dimensional Discourse, Ozy B. Orluwene Jp

Dr Ozy B.Orluwene,JP

ABSTRACT This paper is motivated by the desire to examine the origin of the Niger Delta crisis in Nigeria. It explains why rural poverty, insecurity and state failure are the major reasons behind the volatile conflicts that have come to engulf majority of the once peaceful state of the Niger Delta region of Nigeria. It argues that the Niger Delta region is the home of the oil and gas industry in Nigeria. Petroleum exploration accounts for over 80% of Nigeria’s foreign earnings. The petro-dollar wealth translates into a big curse for the people and the environment. An ungrateful Nigerian state …

Democratisation, Identity Transformation And Rising Ethnic Conflicts In Kogi State, Nigeria, Shola J. Omotola Apr 2008

Democratisation, Identity Transformation And Rising Ethnic Conflicts In Kogi State, Nigeria, Shola J. Omotola

Shola J. Omotola Mr

This article explores the linkages between democratization, identity transformation, and rising ethnic conflicts in Kogi State, Nigeria. It argues that the changing character of identity politics in the state, partly a reflection of the contradictory character of the state such that it empowers some people and disempowers others, has been boosted by the democratization process. Ethnic identities have thus become an instrument for the construction and deconstruction of trust in the struggle for power among the competing ethnicities, which the democratization process typifies. The result has been rising ethnic conflicts across the state that do not bode well for sustainable …

Polycentric Governance Of Normative Technologies: Democratic And Constitutional Issues / Gouvernance Polycentrique Des Technologies Normatives: Enjeux Démocratiques Et Constitutionnels., Antoinette Rouvroy

Antoinette Rouvroy

English abstract: This personal project, funded by the FNRS, addresses the relationships between Law and the myriad of norms generated by non-state actors involved in the governance of the Information Society. A first question is about both the specificities, if any, of the legal norms, or of the Law, in the regulatory landscape of the Information Society, and the role that the law might have in the assessment and guarantee of the legitimacy of 'non-state norms'. Assuming that a basic condition of the legitimacy of norms, whatever their kinds, would reside in the possibility that individuals have to contest them, …

Finding Order In Complexity: A Typology Of Local Public Health Delivery Systems, Glen Mays Mar 2008

Finding Order In Complexity: A Typology Of Local Public Health Delivery Systems, Glen Mays

Glen Mays

Public health decision-makers and researchers currently lack an evidence-based framework for describing, classifying, and comparing public health delivery systems based on their organizational components, operational characteristics, and division of responsibility. Related typologies developed in the health services sector have proven extremely valuable for policy and administrative decision-making as well as for ongoing research. Performance assessment, quality improvement, and accreditation activities are now blossoming in public health—adding urgency to the need for classification and comparison frameworks. This brief describes a newly-developed empirical typology for local public health systems and highlights its policy and managerial applications.

The (First) American State Litter Scorecard (2008), Stephen [Steve] L. Spacek Mar 2008

The (First) American State Litter Scorecard (2008), Stephen [Steve] L. Spacek

Stephen [Steve] L Spacek

ABSTRACT Littering is an American environmental crime, creating a danger to public health and safety. Experts nationwide have done little research on litter’s impingement upon state jurisdictional environmental degradation. Unfortunately, the 50 American states do not collect uniform litter data measures, such as volumes of waste collected, total litter eradication expenditures, the number of persons injured or killed by litter/dumping-related incidents. For the first time, a "litter scorecard" is created, measuring each state’s environmental quality indicators and litter eradication programs. The research first examines salient social and political mores that influence littering and statewide environmental degradation through a review of …

Memorandum Of Amicus Curiae In Opposition To Uspto's Motion To Strike Exhibits, Ron D. Katznelson Feb 2008

Memorandum Of Amicus Curiae In Opposition To Uspto's Motion To Strike Exhibits, Ron D. Katznelson

Ron D. Katznelson

In response to USPTO's Motion to strike the exhibits of my Amicus brief (see USPTO's motion attached below), this memorandum establishes that such exhibits are properly before the Court. It details the legal standards of review under the Administrative Procedures Act for including extra evidence beyond the agency administrative record and establishes that all subject exhibits in my Amicus brief meet the criteria for augmenting the record in this case. On April 1, 2008, the Court issued its decision in favor of Plaintiffs and permanently enjoined the USPTO rules. (See Order and Opinion attached below). The USPTO's subsequent appeal of …

Transnational Corporations (Tncs) And The Effective Implementation Of Social And Economic Rights: Current And Prospective Avenues, Analia Marsella Feb 2008

Transnational Corporations (Tncs) And The Effective Implementation Of Social And Economic Rights: Current And Prospective Avenues, Analia Marsella

Analia Marsella Sende

In this Essay, I explain the role and impact of transnational corporations in the process of development and implementation of economic and social rights at a global scale and identify the solutions that I regard as plausible. I do so from an international human rights perspective that integrates both the legal and non-legal approaches. I concentrate on the international aspects of legalization, adjudication, and policy making. First, I analyze social and economic rights in the current context, the old and most recent understandings, and the challenges posed by the phenomenon of globalization together with the rising of corporations in the …

A Comparative Analysis Of Mandated Private Pension Arrangements, Mark Hyde Jan 2008

A Comparative Analysis Of Mandated Private Pension Arrangements, Mark Hyde

Mark Hyde

Abstract Purpose – According to one influential set of arguments, the privatization of public pensions has been informed by neoliberalism, and has thus been an integral element of a broader program of welfare retrenchment, which is inconsistent with social cohesion. The paper aims to take issue with this negative characterization of pensions privatization. Design/methodology/approach – The argument is illustrated by a cross-national comparative analysis of the principal design features of 32 mandated private pension arrangements. Findings – The market orientation of mandated private pension arrangements is generally ambivalent. Whilst the architects of these arrangements have embraced market principles, they have …

Federalism And Impediments To National Integration In Nigeria: An Appraisal, Ozy B. Orluwene Jp Jan 2008

Federalism And Impediments To National Integration In Nigeria: An Appraisal, Ozy B. Orluwene Jp

Dr Ozy B.Orluwene,JP

ABSTRACT This paper is primarily an appraisal of how the practice of Federalism in Nigeria is faced with many impediments. Theoretically, Federalism is established or adopted with a view to ensuring the unity of the people and faith in their fatherland so as to further the end of liberty; equality and justice in the country. With the data on governance being replete with contradictions controversies, paradoxes and crises emanating from the persistently fragile practice of federalism in multi-ethnic Nigeria. The situation tends to validate the French saying that “the more things change, the more they stay the same”. The governance …

Space Settlements, Property Rights, And International Law: Could A Lunar Settlement Claim The Lunar Real Estate It Needs To Survive?, Alan Wasser, Douglas Jobes Jan 2008

Space Settlements, Property Rights, And International Law: Could A Lunar Settlement Claim The Lunar Real Estate It Needs To Survive?, Alan Wasser, Douglas Jobes

Alan Wasser

The settlement of space and the expansion of the habitat of humanity beyond Earth will benefit all mankind but will be astronomically expensive. Private enterprise would do it if there were a sufficient profit potential, something only Lunar and Martian real estate is valuable enough to provide. Utilization of this tremendous potential value as an incentive has been prevented by the mistaken assumption that the 1967 Outer Space Treaty's prohibition of "national appropriation" and requirement of national supervision of private activities prohibit private property in space. This paper attempts to demonstrate, by expert legal consensus, that the 1967 Outer Space …
