This panel will discuss the role of lawyers — particularly government lawyers — in addressing questions of legal policy. We will discuss fundamental questions such as: Should lawyers decide legal policy? Or, is that best left to the policymakers? Should lawyers give advice as to legal policy, or should they stick to providing answers as to what the law is? How should lawyers respond to what a policymaker thinks is the legal question, but is really a question of legal policy? If lawyers find the law vague or lacking, should they fill in the gaps, advising as to what the …

Human Rights In The Arab World: Independent Voices, Anthony Chase, Amr Hamzawy
Anthony Chase
Human Rights In The Arab World: Independent Voices is an anthology of essays by learned authors about the unfortunate and longstanding marginalization of human rights in the Arab world, the obstacles that bar the way to implementing these rights, and pathways to improve human rights and welfare in the future. Individual essays also discuss the intersection of globalization and human rights, the especial plight of women's rights in the Arab world, case studies in Yemeni, Egypt, and Morocco, the difficulties faced by activists and NGOs pushing for human rights, and much more. A sober, serious-minded compilation of a vital current …

Global Public Policy, Transnational Policy Communities And Their Networks, Diane Stone
Global Public Policy, Transnational Policy Communities And Their Networks, Diane Stone
Diane L Stone
Public policy has been a prisoner of the word ‘state’”. The state is re-configured by globalization. Through ‘global public-private partnerships’ and ‘transnational executive networks’ new forms of authority are emerging through global and regional policy processes that co-exist alongside nation-state policy processes. Accordingly, this paper asks what is ‘global public policy’? The first part of the paper identifies new public spaces where global policies occur. These spaces are multiple in character and variety and will be collectively referred to as the ‘global agora’. The second section adapts the conventional policy cycle heuristic by conceptually stretching it to the global and …
More Revisions In Realism: Hobbesian Anarchy, The Tale Of The Fool, And International Relations Theory, Giulio M. Gallarotti
More Revisions In Realism: Hobbesian Anarchy, The Tale Of The Fool, And International Relations Theory, Giulio M. Gallarotti
Giulio M Gallarotti
Thomas Hobbes has been hailed as a major intellectual precursor of realist theory among international relations scholars. Such veneration has brought about ample reactions from various scholars who aver that the use of Hobbes and his vision of anarchy as analogies for building greater theories of international relations is problematic at best. Yet while such critiques of the realist analogy have been abundant, they have devoted scant attention to important passages in the Leviathan (i.e., the tale of the fool in Chapter 15) that would produce greater clarity about Hobbes’ logic regarding the state of nature. Indeed, a careful textual …
Canada And Russia In The North Pole: Cooperation, Conflict, And Canadian Identity In The Interpretation Of The Arctic Region, Nick J. Sciullo
Canada And Russia In The North Pole: Cooperation, Conflict, And Canadian Identity In The Interpretation Of The Arctic Region, Nick J. Sciullo
Nick J. Sciullo
The Arctic debate touches on a number of important international issues: national security, energy exploration and policy, environmental concerns, and maritime commerce are but a few. The North Pole, the Arctic more generally, is becoming increasingly important to a number of international actors as climate change causes ice to melt and the Arctic's waters become increasingly navigable. The pressure to lay claim to the Canadian North is intense, as countries clamor for the right to firmly plant their flags and lay the foundations for their military bases and research facilities.
Canadians must confront threats to sovereignty that they have not …

Political Globalisation And Citizenship: New Sources Of Security Threats In Africa, Shola J. Omotola
Political Globalisation And Citizenship: New Sources Of Security Threats In Africa, Shola J. Omotola
Shola J. Omotola Mr
This article analyses the interface between political globalization, citizenship and security threats in Africa. Political globalization is assumed to be capable of engendering inclusive citizenship; in the same way, citizenship is considered to be central to the national question in Africa. It is around citizenship that most issues of human rights revolve, both at individual and group levels. The article argues that political globalization in Africa tends to limit the meaning, essence and substance of citizenship, even if the latter is defined from a minimalist perspective of duties-rights relationships. The marginalization and/or exclusionary politics engendered by political globalization, especially for …

Globalization, Power, And Integration: The Political Economy Of Regional And Bilateral Trade Agreements In The Americas, Kenneth C. Shadlen
Globalization, Power, And Integration: The Political Economy Of Regional And Bilateral Trade Agreements In The Americas, Kenneth C. Shadlen
Ken Shadlen
This article explores the dynamics of regional economic integration in the Americas. Economic globalisation, or an increased volume of trade and investment and increased mobility of capital, presents developing countries with new opportunities and challenges. In particular, the emergence of south-east Asia as a major site for the production and export of manufactured goods has generated intense competition among developing countries for foreign investment and export-market shares. In this article, globalisation and ensuing competition is linked to the process of economic integration between the United States and countries of Latin America and the Caribbean. Fundamental changes in global patterns of …
The Soft Power And Persuasion Of Translations In The War On Terror: Words And Wisdom In The Transformation Of Legal Systems, Donald J. Kochan
The Soft Power And Persuasion Of Translations In The War On Terror: Words And Wisdom In The Transformation Of Legal Systems, Donald J. Kochan
Donald J. Kochan
The power of words is the power of persuasion. The exportation of the foundational legal principles that helped form the American republic can serve as instrumental "soft power" tools in the war on terror. Efforts promoting projects like the Arabic Book Program are important vehicles to cross-cultural and cross-lingual international relations. This Article argues that an arsenal of words can be as, or more, powerful than an arsenal of artillery. The West has much to offer, but the rest of the world needs to be able to read it without getting lost in translation. Providing linguistic access to the documents …
