Getting To Rights: Treaty Ratification, Constitutional Convergence, And Human Rights Practice, Zachary Elkins, Tom Ginsburg, Beth A. Simmons

This Article examines the adoption of rights in national constitutions in the post-World War II period in light of claims of global convergence. Using a comprehensive database on the contents of the world’s constitutions, we observe a qualified convergence on the content of rights. Nearly every single right has increased in prevalence since its introduction, but very few are close to universal. We show that international rights documents, starting with the Universal Declaration of Human Rights, have shaped the rights menu of national constitutions in powerful ways. The Politics Of Rights-Based Approaches In Conservation, Prakash Kashwan

Scholars and advocates increasingly favor rights-based approaches over traditional exclusionary policies in conservation. Yet, national and international conservation policies and programs have often led to the exclusion of forest-dependent peoples. This article proposes and tests the hypothesis that the failures of rights-based approaches in conservation can be attributed in significant measure to the political economic interest of the state in the tropics. To this end, the article presents findings from the empirical analysis of the Forest Rights Act of 2006 in India. Two key recommendations emerge from this analysis. This exploratory article attempts to interrogate the emerging responses of the traditionally powerful Singaporean city-state as it is confronted by the upsurge of social media networks. This inquiry is premised on the assertion that Singapore’s city-state, historically dominated by the People’s Action Party (pap), acts as an overall enforcer by employing tactical globalization. In its drive towards development and nation-building, the city-state has identified protecting social cohesion among its diverse and multicultural population as one of its key vulnerabilities. Debatendo A Política De Imigração Europeia: Perspectivas Para Liberalização Da Imigração De Terceiros A Ue (Debating European Union Immigration: Policy: Prospects For Third Party Immigration Liberalization), Gaspare M. Genna

This paper assesses the likelihood of developing an European Union level immigration control policy and the liberalization of third party immigration by using hypotheses developed from social identity theory. Through an analysis of Eurobarometer data collected in 2000, I confirm prior work which indicates that support for an EU level policy is more likely if individuals hold an EUropean identity. However intergroup competition (EU citizens vs. third party immigration) will lower the likelihood, even among European identity holders. Also the belief that an EU level policy would liberalize third party immigration also lowers the likelihood of supporting such a policy. …

The unprecedented synchronized automated elections of May 201 in the Philippines saw how results of presidential elections could be obtained nearly overnight. Such nation-wide occurrences dramatically altered the mode in which Philippine elections had always been propagated: Typified by arduous and oftentimes onerous delays in the publication of results stretching all the way to several months after the day of the elections. This inquiry explores the implications of this change to prevailing theories and practices of election reforms. This inquiry attempts to address the question: How has the Singapore city-state used its education system in integrating three important cornerstones of nation-building? Using selected data from the National Orientations of Singaporeans Survey complemented by policy documents, this article explores three specific questions: (1) How is citizenship education pursued? (2) How is national identity forged? And (3) How is political socialization engendered? The inquiry concludes with challenges that the Singapore education system faces as it tries to address its nation-building project.

Exclusionary Vs. Inclusionary Populism: Comparing The Contemporary Europe And Latin America, Cas Mudde, Cristobal Rovira Kaltwasser

Although there is a lively academic debate about contemporary populism in Europe and Latin America, almost no cross-regional research exists on this topic. This article aims to fill this gap by showing that a minimal and ideological definition of populism permits us to analyse current expressions of populism in both regions. Moreover, based on a comparison of four prototypical cases (FN/Le Pen and FPÖ/Haider in Europe and PSUV/Chávez and MAS/Morales in Latin America), we show that it is possible to identify two regional subtypes of populism: exclusionary populism in Europe and inclusionary populism in Latin America.

The populist radical right constitutes the most successful party family in postwar Western Europe. Many accounts in both academia and the media warn of the growing influence of populist radical right parties (PRRPs), the so-called ‘verrechtsing’ (or right turn) of European politics, but few provide empirical evidence of it. This lecture provides a first comprehensive analysis of the alleged effects of the populist radical right on the people, parties, policies and polities of Western Europe. Analyzing The Determinants Of Group Identity Among Alevis In Turkey: A National Survey Study, Cigdem V. Sirin

This study systematically explores the factors that affect collective identity associations within the Alevi community in Turkey by employing the social identity approach and examining survey data collected through fieldwork. The results show that Kurdish Alevis express lower levels of attachment to their religious identity as compared to Turkish Alevis. The results also indicate that personal experiences of discrimination tend to increase one's prioritization of Alevi identity. Last, no significant differences are observed regarding group identity between Alevis who reside in urban areas and those who live in rural areas.

Deterring The ‘Boat People’: Explaining The Australian Government's People Swap Response To Asylum Seekers, Jaffa Mckenzie, Reza Hasmath

This article examines why Australia has taken a tough stance on ‘boat people’, through an analysis of the Malaysian People Swap response. The findings support the view that Australia’s asylum seeker policy agenda is driven by populism, wedge politics and a culture of control. The article further argues that these political pressures, in sum, hold numerous negative implications for the tone of Australia’s political debate, the quality of policy formulation, as well as for asylum seekers and refugees themselves.

Using data on more than 300 census blocks from across New Orleans, Louisiana, this article investigates two steps in the placement of temporary housing after Hurricane Katrina. First, the authors seek to understand the factors that determined whether census blocks were selected for Federal Emergency Management Agency (FEMA) trailers. Then, in light of the widespread resistance to the trailers, they focus on variables that influenced whether trailers were successfully placed on those sites.
