When the parties in a divorce have, with the benefit of legal counsel, gone through mediation and negotiated an agreement to settle the ancillary issues of maintenance and the division of matrimonial assets, is there any reason for the court to exercise its statutorily conferred discretion to ignore such an agreement or should it seek to uphold it despite objections from one of the parties? In the last few years, there has been a dramatic increase in the use of remote-controlled copters – often given the convenient but misleading epithets of unmanned aerial vehicles or “drones” – by recreational users to capture aerial photographs and videos on an unprecedented scale. Asia is no exception. The convergence of cutting-edge technological developments in gyroscopic gimbals, long-range wireless transmissions, GPS-enabled stabilisation, GPS-enabled flightpath-preprogramming, first-person-views, and compact digital imaging has led to the proliferation of affordable camera-carrying “drones” that even hobbyists can pilot with reasonable safety. In 2012, Singapore’s venerable Evidence Act (EA), which is based on Stephen’s Indian Evidence Act of 1872, underwent major amendments for only the third time in 120 years. Previously, conflicting case law had created long-standing confusion as to whether the Singapore courts possessed any discretion to exclude evidence even when was found relevant under the EA. The main reason driving this jurisprudential inconsistency was that while the relevancy provisions in the EA were meant to provide exhaustive definitions of admissibility, Stephen’s then-revolutionary ‘inclusionary’ approach to relevance was simply at odds with modern conceptions of relevance and modern litigation practice. The right to presumption of innocence is said to exist in almost all criminal justice systems, including Singapore. Curiously, however, no Singapore case has ever attempted to establish the exact source and contours of this longstanding right. This is unsatisfactory, as this diminishes the meaningfulness of what is supposed to be a fundamental right in the criminal justice process. The primary aim of this article is thus to conduct a preliminary survey of the law on the presumption of innocence in Singapore. Russia’s seamless presidential succession produced no major changes in domestic politics or foreign policy. Ties with Asia remained strong, though several key relationships—with China, Japan, and the Central Asian states—frayed under the impact of Russia’s military action in Georgia. Impressive economic performance in the first half of the year boosted Russian confidence as a great power, but its vulnerability to the global financial crisis together with the heavy-handed operation in the Caucasus undermined Moscow’s standing with both Asia and Europe by the end of the year.

Russia in 2007 moved further away from a constitutional order governed by the rule of law as President Vladimir Putin's second term drew to a close and the country prepared for parliamentary and presidential elections. High oil and gas prices buoyed the economy, but little progress was made in addressing Russia's serious social problems. In foreign policy, confrontation with the West was balanced by excellent relations with most of Asia.

This paper examines U.S. engagement in Central Asia over the past two decades, with specific reference to the Shanghai Cooperation Organization. While alarmist voices occasionally warn of the threat to American interests from China and Russia through the SCO, the organization’s influence appears limited. Washington has engaged it only sporadically, preferring to conduct relations bilaterally with the Central Asian states.

In Burma (Myanmar), the Abhidhamma, a rigorous and abstract soteriological treatise situated within the vast Pali Buddhist canon, is the focus of both monastic and lay practitioners’ close study and popular veneration. In particular, the Paṭṭhāna, the last and most complex volume of the Abhidhamma, is envisioned as a keystone in the long-term preservation of the Buddha’s teachings, which are also understood to inevitably disappear. The story of Srivijaya begins with a geopolitical preface. Just as all roads once led to Rome, so too maritime trade in Asia converged on the narrow sea route that became known as the Strait of Malacca. Unlike ancient Rome, however, the Malacca Strait has retained its geographical salience at different times in history. One such era was well conveyed by the sixteenth century Portuguese adventurer, Tomé Pires, who wrote shortly after his country’s acquisition of the port city of Malacca: “Whoever is lord of Malacca has his hands on the throat of Venice” (Courtesao 1944). This article explores the relationship between popular representations of soccer and the rise of neoliberal discourse celebrating a new individualism in Japan at the turn of the millennium, a time when the country experienced sharp economic decline and consequent economic restructuring. Examining dominant vocabularies and practices present in coaching discourse, on soccer fields, and in media portrayals of Japanese men’s and women’s professional leagues, the author argues that rather than a coincidental, coeval mirroring between two seemingly unrelated realms—sports and economic transformations—these relationships point to the positioning of soccer over the past 20 years in Japan as a site to …

The Singapore Management University (SMU) Library was tasked with documenting the early history of SMU by the chairman of its board of trustees. An oral history project to interview the pioneers involved in the formation of the university began in 2011. The project team included the Library, the Information Technology department, and a researcher/interviewer who was familiar with SMU. It was a steep learning curve for the team. As they conducted and processed the interviews, they learned about and made decisions on interviewing, recording, transcribing, storage, website design, discoverability, usability, and sustainability. In 2012, the Ministry of Education, Afghanistan, engaged the Australian Council for Educational Research (ACER) as a partner to support the development of a national learning assessment program in Afghanistan. To achieve this goal, the Learning Assessment unit of the Ministry of Education and ACER have collaborated to design and implement the Monitoring Trends in Educational Growth (MTEG) program in Afghanistan.
