Twelve writers challenge the structures and priorities of traditional Catholic colleges and universities: contemporary “reality TV” for anyone who values social justice in Catholic education. Throughout the book the writers confront the status quo of Catholic universities, questioning even those who have embraced feminist theology. The editors divided the book into three parts with subheadings that overstate their contents: “Feminist Border Work: Tensions and Contradictions” (3 chapters), “Living Experiences: Identity, Empowerment, and Action” (4 chapters), and “Social Justice: The Ideal, the Reality, and the Quest” (3 chapters). Speaking Freely In A Time Of War, Barry J. Mauer

Anti-speech advocates have made several arguments aimed at critics of the Iraq War. Many of these anti-speech arguments are enthymemes. If the purpose of these rhetors is to deceive others into accepting a weak claim, then enthymemes are ideal forms because they hide the weakest parts of the argument. By exposing their hidden premises, the parts that are implicit but left unstated, I demonstrate that the anti-speech arguments used against critics of the war are not sound. This essay examines the logos, ethos, and pathos in these anti-speech arguments.

In any elementary school classroom, a teacher will occasionally observe students involved in activities that seem neither honest nor ethical. What can teachers do to stimulate moral reasoning skills and principled attitudes in the elementary grades? This article suggests that situational learning is ideal for developing moral reasoning in today's young learners. Situational learning allows students to choose their own situations and structure personalized outcomes that may or may not be predicted by the teacher. There are no right and wrong answers or anticipated outcomes; the process entails risk-taking and uncertainty, for teacher and students alike. Situational learning permits individuals …

This essay, however, does not press any particular agenda; rather, it tries to make our thinking about the topic more flexible. It is my hope that some conduct-specific rule as was adopted in the defamation context will eventually be adopted for intellectual property. Copyright law cannot continue forever closing its eyes and hoping its house will stop being haunted.

This Commentary on Lydia Pallas Loren, Untangling the Web of Music Copyrights, 53 Case W. Res. L. Rev. 673 (2003), observes that debates over a variety of copyright law issues can be - and in fact, often are - structured in narrative terms, rather than in terms of doctrine, policy, or empirical inquiry. I suggest a series of such narratives, each framed by a theme drawn from a feature film. The Commentary suggests that we should recognize more clearly the role of narrative in intellectual property discourse, and that intellectual property narratives should be examined critically.

Legal scholars, lawmakers and, increasingly, the general public seem to place ever-increasing hope in the potential of law and legal theory, and of enforceable uniform international legal standards. Many appear to believe that identifying and enacting laws and a legal framework that correspond worldwide to human rights will solve the age-old problem of legalized barbarism. The historical propensity of courts, even in democratic states, to legitimate and enable racist policies provides compelling evidence that the current level of faith in law is misplaced.

This Essay suggests we bifurcate our thinking. Conventional copyright rules by money, so let it rule the money-bound. Let a different set of rules evolve for more complex uses, particularly when the users have a personal relationship with the utilized text. Much recent scholarship contains dramatic suggestions to secure a freedom to be creative, rewrite, and be imaginative. My work has long sought to defend such freedoms, but I believe we understand imagination and its conditions too little to employ it as a starting point. I suggest instead that we acquire a better conceptual map of the generative process and …
