Law Without Recognition: The Lack Of Judicial Discretion To Consider Individual Lives And Legal Equities In United States Immigration Law, John Clark Salyer

Law is not separate and apart from society but exists as a unique institution within society both being directed by social change and affecting social change. The history of U.S. immigration law shows that immigrants were welcomed or rejected depending on economic, political, and social factors (such as racial attitudes) and the legal definitions of what sorts of immigration were permissible or excludable differed over time. Since the 1990s, hostile attitudes towards certain immigrants have been represented in laws to a greater and greater extent, most significantly with the 1996 amendments to the Immigration and Nationality Act. Material culture is the aggregate of physical objects or artifacts used by or discarded by a past culture or society. Contemporary unauthorized migration at the U.S./México border has left thousands of pounds of migrant goods in what are referred to by United States Border Patrol as "lay-up sites". Since the late 1990's, undocumented migrants attempting to cross the Sonoran Desert of Arizona have been exposed to a distinctive set of material culture. As a result of exclusionary state and federal policy decisions on immigration and health care, marginalized immigrants often seek health care in the shadows of U.S. cities through practitioners such as curandera/os (healers), huesera/os (bonesetters), parteras (midwives), and sobadora/es (massagers). under the radar of biomedical practice. This research focuses on this phenomenon in the context of globalized social networks and health care practices of marginalized Latino immigrants in Milwaukee, Wisconsin, and within the broader economic and political context in this country. Framed through the standardizations of food and generalizations of people, this research explores the shifting ingredients of migrant identities and the ethnic foodways carried with them as they cross the border into the United States. Using ethnographic observational fieldwork, content analysis of menus, and semi-structured interviews with restaurant staff and migrant workers, this study examines the transnational narratives of the day laborer population and their deterritorialized food culture in post-Katrina New Orleans. This thesis examines how Colombian women within the city of Atlanta utilize Facebook as a parallel public sphere, a cultural phenomenon through which the silenced use mediums of popular culture to discuss private and public dilemmas (Dewey 2009). Through ethnographic research in Atlanta, I analyze how these young women use Facebook as they negotiate their identity through the multiple contexts of their everyday lives. Drawing from feminist critiques, I explore whether Facebook provides an alternative to the traditional public sphere, while also investigating how power structures influence freedom of expression online. Labor And Identity: Latina Migrant Women And The Service Industry Of Atlanta, Kaitlin E. Case

This thesis explores the work experiences and life histories of a group of Latina migrant women who work in specific sectors of the service industry in Atlanta, Georgia. I focus on janitorial/custodial as well as domestic labor in order to confront the social issue of the continued devaluation and exploitation of feminized wage work. This ethnography reveals how education and English proficiency tie into how migrant labor is viewed in the United States specifically, and asks how Latina migrant women might be able to achieve labor legitimacy in the future. In recent years, Florida has acquired a reputation as fertile ground for human trafficking. On the heels of state and federal anti-human trafficking legislation, a host of organizations have risen to provide a range of services. In this thesis, I discuss findings from 26 interviews conducted with law enforcement, service providers, legal representatives and trafficked persons to contextualize the variability in the way anti-trafficking work is conceptualized by stakeholders across the state. Additionally, I explore how conflicting organizational policies on the local, state, and federal levels impact stakeholder collaboration and complicate trafficked persons' attempts to navigate already complex processes of …

The Italian media, political parties, and immigrant-related social service organizations on all sides of the spectrum have contributed to the creation of various one-dimensional perceptions of Italy’s immigrant communities which have functioned to deny immigrants’ formal citizenship status and consequently, attempted to impede their access to the basic rights and privileges national membership guarantees. While left-leaning media outlets, organizations, and individuals tend to portray immigrants as victims draining Italy of its social, economic, and material resources, the Italian right often characterizes Italy’s immigrant population as villainous intruders incapable of integration due to cultural difference and in some cases, a natural …

This study explores the practice of alternative medicine among a group of senior, transnational Indian immigrants. I analyze how cross-cultural ideologies influence aging and immigrant experiences in healthcare. I explore the ways in which transnational networks nurture social relations and aid in acquiring healthcare resources. This study also examines the developments that alternative medicine underwent during the colonial rule and how those developments affected the trajectory of biomedicine. I focus on the practice of alternative medicine as a significant contributor to immigrant health. Finally, I argue that we need to strive for a symbiosis between alternative medicine and Western biomedicine …
