Dimensions Of Delegation, Cary Coglianese Nov 2019

Dimensions Of Delegation, Cary Coglianese

All Faculty Scholarship

How can the nondelegation doctrine still exist when the Supreme Court over decades has approved so many pieces of legislation that contain unintelligible principles? The answer to this puzzle emerges from recognition that the intelligibility of any principle dictating the basis for lawmaking is but one characteristic defining that authority. The Court has acknowledged five other characteristics that, taken together with the principle articulating the basis for executive decision-making, constitute the full dimensionality of any grant of lawmaking authority and hold the key to a more coherent rendering of the Court’s application of the nondelegation doctrine. When understood in dimensional …

It's Capitalism, Stupid!: The Theoretical And Political Limitations Of The Concept Of Neoliberalism, Bryant William Sculos Oct 2019

It's Capitalism, Stupid!: The Theoretical And Political Limitations Of The Concept Of Neoliberalism, Bryant William Sculos

Class, Race and Corporate Power

This polemical essay explores the meaning and function of the concept of neoliberalism, focusing on the serious theoretical and political limitations of the concept. The crux of the argument is that, for those interested in overcoming the exploitative and oppressively destructive elements of global capitalism, opposing "neoliberalism" (even if best understood as a process or a spectrum of "neoliberalization" or simply privatization) is both insufficient and potentially self-undermining. This article also goes into some detail on the issues of health care and climate change in relation to "neoliberalism" (both conceptually and the material processes and policies that this term refers …

How U.S. Government Policy Documents Are Addressing The Increasing National Security Implications Of Artificial Intelligence, Bert Chapman

Libraries Faculty and Staff Presentations

Artificial intelligence is affecting many areas of our lives and governmental policy. National security is one arena in which artificial intelligence is playing an increasingly important and controversial role. U.S. Government and military agencies are producing a steadily expanding corpus of publicly available literature on this topic. This literature documents how these agencies have this topic's national security implications historically and currently while also addressing potentially emerging national security issues where artificial intelligence will intersect with national security. This presentation demonstrates examples of the growing variety of publicly available national security artificial intelligence literature while also addressing the implications of …

How News Media Coverage Of Crises Promotes Conspiracy Beliefs, Richard Kornrumpf, Adam Enders Phd

Posters-at-the-Capitol

While scholars of conspiracy theories have recently made great strides in understanding the basic nature and correlates of conspiratorial thinking, we still know little about how conspiracy beliefs are disseminated and communicated, especially when it comes to traditional media. In this instance, we use a unique experiment to investigate whether media coverage of mass shootings – complete with the uncertainty, conflicting reports, and dubious official narratives that characterize such coverage – provides the raw material for conspiracy theories and promotes conspiracy beliefs among viewers. We find that implicit conspiratorial information – that which causes confusion and foments uncertainty – does …

Gender And Representation: Economic Performance And The Emergence Of Women In State Politics, Chris Jackson Oct 2019

Gender And Representation: Economic Performance And The Emergence Of Women In State Politics, Chris Jackson

Posters-at-the-Capitol

A plethora of literature in gender and representation has been devoted to understanding disparities that occur during campaigns. More recently, the shift has been toward candidate emergence and the decision of individual women to run in the United States. In this vein, we are curious whether women are likely to run for office following times of economic prosperity or disparity, respectively. We hypothesize that when the state of the economy is generally decreasing in terms of declining GDP per capita and growing unemployment rates, fewer women will emerge to run for office. In times of worse economic performance, we argued …

U.S. House of Representatives Documents

I must share the deep disappointment and dismay I have felt as these events have unfolded. I have served this nation honorably for more than 30 years. I have proudly promoted and served American interests as the representative of the American people and six different presidents over the last three decades. Throughout that time, I—likemy colleagues at the State Department—have always believed that we enjoyed a sacred trust with our government. ... Today, we see the State Department attacked and hollowed out from within. State Department leadership, with Congress, needs to take action now to defend this great institution, and …
