Environmental Impact Assessment (EIA) aims to embed consideration of the significance of predicted environmental consequences (the findings) of proposed developments into approval decision making. Achieving this aim relies on adequate communication of the findings of the EIA to the stakeholders, especially the decision makers responsible for the approval decision. However, the naïve assumption that this communication of findings can be effectively achieved through the publication of a written report pervades legislation worldwide, despite decades of evidence to the contrary. The theme of this portfolio is how different tools and approaches can be used for advancing transportation equity. Broadly defined, transportation equity is about fairness in transportation. There are a number of ways this fairness can be assessed. The most common way to assess transportation equity is by looking at the fairness of outcomes, distributed geographically, socially, or even by mode of transportation. Equity can also be defined by the fairness of processes. Section 369(d)(1) of the Energy Policy Act of 2005, Public Law 109-58 (H.R. 6), enacted August 8, 2005, directs the Secretary of the Interior to prepare a programmatic environmental impact statement (PEIS) for a commercial leasing program for oil shale and tar sands (OSTS) resources on public lands in Colorado, Utah, and Wyoming (see Figure 1). The Bureau of Reclamation (Reclamation) has completed a final environmental impact statement (EIS) on the operation of Flaming Gorge Dam. The EIS describes the potential effects of modifying the operation of Flaming Gorge Dam to assist in the recovery of four endangered fish, and their critical habitat, downstream from the dam. The four endangered fish species are Colorado pikeminnow (Ptychocheilus lucius), humpback chub (Gila cypha), razorback sucker (Xyrauchen texanus), and bonytail (Gila elegans).
