Intellectual Property (IP) includes ideas, innovations, methodologies, works of authorship (viz., literary and artistic works), emblems, brands, images, etc. This property is intangible since it is pertinent to the human intellect. Therefore, IP entities are indisputably vulnerable to infringements and modifications without the owner’s consent. IP protection regulations have been deployed and are still in practice, including patents, copyrights, contracts, trademarks, trade secrets, etc., to address these challenges. Aspects of a local lagged adapted generalized method of moments (LLGMM) dynamic process are described herein. In one embodiment, the LLGMM process includes obtaining a discrete time data set as past state information of a continuous time dynamic process over a time interval, developing a stochastic model of the continuous time dynamic process, generating a discrete time interconnected dynamic model of local sample mean and variance statistic processes (DTIDMLSMVSP) based on the stochastic model, and calculating a plurality of admissible parameter estimates for the stochastic model using the DTIDMLSMVSP. Apparatus and method securely transfer first data from a source device to a target device. A wireless signal having (a) a higher speed channel conveying second data and (b) a lower speed channel conveying the first data is transmitted. The lower speed channel is formed by selectively transmitting the wireless signal from one of a first and second antennae of the source device based upon the first data. Inventing Around Edison’S Lamp Patent: The Role Of Patents In Stimulating Downstream Development And Competition, Ron D. Katznelson, John Howells

We provide the first detailed empirical study of inventing around patent claims. The enforcement of Edison’s incandescent lamp patent in 1891-1894 stimulated a surge of patenting. Most of these later patents disclosed inventions around the Edison patent. Some of these patents introduced important new technology in their own right and became prior art for new fields, indicating that invention around patents contributes to dynamic efficiency. Contrary to widespread contemporary understanding, the Edison lamp patent did not suppress technological advance in electric lighting. The market position of General Electric (“GE”), the Edison patent-owner, weakened through the period of this patent’s enforcement.

The human P2X7 receptor is a trimeric ligand-gated cation channel coded by the P2RX7 gene located at chromosome position 12q24. P2X7 is expressed in a wide variety of normal and disease-associated cell types. Activation of this receptor by extracellular adenosine 5’-triphosphate results in numerous downstream events including the release of pro-inflammatory mediators, cell proliferation or death, and killing of intracellular pathogens. As a result, P2X7 plays important roles in inflammation, immunity, bone homeostasis, neurological function and neoplasia. The P2RX7 gene encodes a P2X7 subunit 595 amino acids in length, however splice isoforms that can alter receptor expression and function, and …

This Article reports an empirical study of the network composed of patent “nodes” and citation “links” between them. It builds on an earlier study, in which we argued that trends in the growth of the patent citation network provide evidence that the explosive growth in patenting in the late twentieth century was due at least in part to the issuance of increasingly trivial patents. We defined a measure of patent stratification based on comparative probability of citation; an increase in this measure suggests that the USPTO is issuing patents of comparatively less technological significance. This paper draws attention to fundamental deficiencies in studies that have been relied upon as authoritative sources on patent grant rate comparisons among national patent offices. The two prominent studies analyzed here had employed erroneous methods to compare patent grant rates, resulting in false high indications of such rates at the U.S. patent office compared to foreign patent offices. This paper reports results of a network theory approach to the study of the United States patent system. We model the patent citation network as a discrete time, discrete space stochastic dynamic system. From patent data we extract an attractiveness function, A(k, l), which determines the likelihood that a patent will be cited. A(k, l) shows power law aging and perferential attachment, the exponent of the latter is increasing since 1993, suggesting that patent citations are increasingly concentrated on a relatively small number of patents. Computer software is somewhat of a problem child for intellectual property law. Courts and legislatures have struggled to encourage innovations in software development while, at the same time, attempting to avoid undesirable digital information monopolies. Neither the patent nor the copyright system has provided a particularly satisfactory paradigm for software protection.
