The goal of this paper is to illuminate the debate concerning the economics of ecosystem services. The sustainability debate focuses on whether or not ecosystem services are essential for human welfare and the existence of ecological thresholds. If ecosystem services are essential, then marginal analysis and monetary valuation are inappropriate tools in the vicinity of thresholds. The justice debate focuses on who is entitled to ecosystem services and the ecosystem structure that generates them. Answers to these questions have profound implications for the choice of suitable economic institutions. The efficiency debate concerns both the goals of economic activity and the …

Nantucket’s shellfish resources are an important part of the Island’s history, culture, and economy. Nantucket waters support one of the country’s last wild-caught bay scallop fisheries. Elsewhere along the Atlantic coast, fishing pressure, habitat loss, and disease have severely depleted bay scallop populations. Although Nantucketers continue to make a living harvesting shellfish from the Island’s waters, many do so with concern for the future of the resources and the habitats that support them. Urban Harbors Institute (UHI) provided technical assistance to the community to develop a Shellfish Management Plan (SMP) that addresses issues of water quality, habitat loss, climate change, …

The authors revisit Hart's natural-resource-based view (NRBV) of the firm and summarize progress that has been made in testing elements of that theory and reevaluate the NRBV in light of a number of important developments that have emerged in recent years in both the resource-based view literature and in research on sustainable enterprise. Many new and ambitious energy efficiency and conservation laws are being enacted at all levels of government—and with greater financial incentives than provided previously. These innovations are intended to overcome or minimize market barriers such as principal-agent problems, information and transaction costs, high internal discount rates, and up-front capital needs that discourage cost-saving investments. Innovations such as public-private partnerships also require significant legal input and creativity for the client to reap the often remarkably large energy and cost savings. This article reviews a range of these tools, especially financial legal mechanisms, that could help significantly reduce U.S. energy consumption.

Although the broadly observed increase in nutrient loading rates to coastal waters in the last 100 years may increase aboveground biomass, it also tends to increase soil metabolism and lower root and rhizome biomass—responses that can compromise soil strength. Fourteen different multiyear field combinations of nutrient amendments to salt marshes were made to determine the relationship between soil strength and various nitrogen, phosphorus, and nitrogen+phosphorus loadings. There was a proportional decline in soil strength that reached 35% in the 60- to 100-cm soil layer at the highest loadings and did not level off. These loading rates are equivalent to those …

Sustainable development would require the United States to maintain and improve human prosperity while at the same time greatly reducing its consumption of energy, materials, water, and land. The scope of the challenge includes, but is not limited to, climate change. This Article suggests the elements of a legal structure for achieving sustainability.

Because achieving sustainable development is a significant learning experience, the United States will need to employ a form of governance—reflexive governance—that requires constant learning and supportive citizens and stakeholders who are also working to ensure sustainability in their own activities. Open pit mining usually results in a void that, over time, fills with water and becomes a pit lake. The goal for pit lakes is to create sustainable systems that positively contribute to local and regional watersheds. One long-standing hypothesis for attaining the goal of sustainability has been to create and maintain meromictic lakes (lakes that do not completely mix on a yearly cycle). It is believed that meromixis minimizes atmospheric oxygen exposure to pit walls and concomitant acid generation and minimizes reentrainment of metals to the upper waters during seasonal mixes.
