Law And Policy Options For Strategic Environmental Assessment In Canada, Hugh Benevides, Denis Kirchhoff, Meinhard Doelle, Robert Gibson
Denis Kirchhoff
This research paper has been produced for the Canadian Environmental Assessment Agency on behalf of the sub-committee on Strategic Environmental Assessment (the SEA sub-committee) which is in turn mandated by the Minister of the Environment’s Regulatory Advisory Committee (RAC). The immediate need for the report is a request from RAC to the SEA sub-committee to research and report on law and policy options for improving the conduct of Strategic Environmental Assessment (SEA) in Canada, with a focus on the federal level. The purpose of the paper is to provide an impartial, research-based assessment of the best approaches to designing and …

Safety Intelligence And Legal Machine Language: Do We Need Three Laws Of Robotics?, Chien Hsun Chen, Y. H. Weng, C. T. Sun
Chien Hsun Chen
In this chapter we will describe a legal framework for Next Generation Robots (NGRs) that has safety as its central focus. The framework is offered in response to the current lack of clarity regarding robot safety guidelines, despite the development and impending release of tens of thousands of robots into workplaces and homes around the world. We also describe our proposal for a safety intelligence (SI) concept that addresses issues associated with open texture risk for robots that will have a relatively high level of autonomy in their interactions with humans. Whereas Isaac Asimov’s Three Laws of Robotics are frequently …
The Very Basics Of Sustainability - An Alternative Viewpoint (Slides With Audio) (Large File! To Speed Up Download, Right-Click On "Download" Link To Save To Own Pc.), Jim Mcgovern
Other resources
This presentation sets out the very basics of ‘sustainability’, although a definition of sustainability is not attempted. Some of the very basics are the context in which the Earth and humankind exist in space and time, the Earth’s climate, the Earth’s population and humankind’s options and choices. The author advocates keeping an open mind on all available options, including the use of oil, gas, coal, tar sands, carbon capture and sequestration, nuclear power etc., as well as the technologies that are more widely considered ‘green’. The author also argues that, in addressing the challenges that humankind faces, globally concerted effort …

Toward A Coherent Test For Disparate Impact Discrimination, Jennifer L. Peresie
Toward A Coherent Test For Disparate Impact Discrimination, Jennifer L. Peresie
Indiana Law Journal
Statistics are generally plaintiffs' primary evidence in establishing a prima facie case of disparate impact discrimination. Thus, the use, or misuse, of statistics dictates case outcomes. Lacking a coherent test for disparate impact, courts choose between the two prevailing tests, statistical significance and the four-fifths rule, in deciding cases, and these tests frequently produce opposite results. Litigants thus face considerable uncertainty and the risk that a judge's preferred outcome will dictate which test is applied. This Article recognizes that the two tests perform complementary functions that both play a useful role in determining whether liability should be imposed. statistical significance …

Science Tools To Implement Ecosystem Based Management In Massachusetts (Draft), Mrag Americas, Incorporated, Massachusetts Ocean Partnership, Woods Hole Oceanographic Institute, Urban Harbors Institute, University Of Massachusetts Boston
Urban Harbors Institute Publications
In this report we provide a framework for implementing ecosystem based management (EBM) and suggest a range of science information tools and their appropriate application to the decision making process. These tools can be broadly classified as modeling tools, decision analysis tools, and indicators. Modeling tools allow the user to organize data, communicate scientific findings to management and stakeholder audiences, and test alternative management scenarios. When used unwisely, however, models can preclude options, present unusable scenarios, generate results in scales that differ from management needs, and impose huge time, data, and technical requirements (Manno et al., 2008). Decision analysis tools …
