Programmers And Forensic Analyses: Accusers Under The Confrontation Clause, Karen Neville

Recent Supreme Court cases involving the Confrontation Clause have strengthened defendants’ right to face their accusers. Bullcoming v. New Mexico explored the question of whether the testimony of the technician who performs a forensic analysis may be substituted by that of another analyst, and the Court held that producing a surrogate witness who was not sufficiently involved in the analysis violates the confrontation right.

The presumption of infallible technology is fading, and courts may soon realize programmers have greater influence over the ultimate outcome of forensic tests than do the technicians who rely on such analytical tools. The confrontation right, …

The idea of the Guantánamo detainee as a Muselmann, the lowest order of concentration camp inmates, contains within it important implications for the new understanding of sovereignty in the era of Guantánamo, in an age of exception. The purpose of this article is to explain the status of those who are detained at Guantánamo Bay. Stated broadly, in assessing that status, we will emphasize the connection between the altered meaning of sovereignty that has accompanied the placing of prisoners in an American penal colony in Cuba and the biopolitical status of the prisoners who reside there. The use of DNA tests for identification has revolutionized court proceedings in criminal and paternity cases. Now, requests by litigants to admit or compel a second generation of genetic tests – tests to confirm or predict genetic diseases and conditions – threaten to affect judicial decision-making in many more contexts. Unlike DNA tests for identification, these second generation tests may provide highly personal health and behavioral information about individuals and their relatives and will pose new challenges for trial court judges. Looking at zoos from the perspective of zoo personnel, this article explores the importance of vision in the zoo’s presentation of its animals as well as the major technologies that the zoo uses to intensify such animal visions. On the one end of the spectrum, zoogeography and immersion design are used at the zoo exhibit to enable zoogoers to see animals in their naturalistic settings. A pot experiment was carried out using 20 surface soils (0-15cm depth) in 2008 to assess soil organic phosphorus and some fraction of inorganic phosphorus in other to know their availability in the soils of the studied area and also work have not been done in this areas in respect to organic and in-organic phosphorus. The experiment was conducted using 20 soils 10 from each geological formation (Cretaceous sediments and Basement complex soils), respectively. The mean organic phosphorus of 63.51 mgkg 1 soil was obtained for Cretaceous sediment soils and 158.54 mgkg 1 soil for the basement complex soils respectively. …

This study examines the nature of urban climate, features and the challenges on the developing tropical cities in the 21st century. It argues that the use of principles of urban climate would help in providing comfortable living conditions and problem immune working environments for the inhabitants of tropical cities. The findings reveal that owing to poor environmental planning, inadequate geotechnical landscape surveys prior to the development of urban infrastructures, and non-adherence to the principles of urban climate, challenges of landscape degradation, excessive flooding of the built infrastructures, heat-island effects, and collapse of buildings have emerged. The main materials employed for this study are a land use map (1991) and Landsat ETM+satellite image (2007) of the study area. Concern about rising prices and unstable sources of petroleum fuels is driving the search for U.S. domestically produced, renewable transportation fuels, such as biodiesel. Federal incentives of up to $1.10 per gallon have been supplemented by additional incentives and mandated biodiesel use in many states. The Renewable Fuel Standard in the Energy Independence and Security Act of 2007 requires the domestic use of 1 billion gallons of biomass-based diesel fuel by 2012, most of which likely will be biodiesel. U.S. biodiesel production is primarily from soybean oil, but recent high prices have forced many producers to use lower-cost feedstocks such …

This paper introduces a new decomposition of energy consumption to reveal the effects of consumer income levels on energy use. It concludes that the great bulk of energy consumption in the US is embedded in goods and services purchased by consumers and that this component of energy demand is growing more rapidly than direct use of energy by households owing to the preferences of high-income consumers. Significantly, this embedded component of energy demand has historically experienced large rebound magnitudes.
